Justification and Approval (J&A) for Other than Full and Open Competition for RFP HSFLGL-16-R-00044, 12-Month Contract Action for the Unifo1m & Equipment Issue, and Laund1y Services
FAR 6.302-2, Unusual and Compelling Urgency
Pursuant to the requirements of the Competition in Contracting Act (CICA), as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.302-2, the justification for the use of statuto1y authority under FAR Subpati 6.3 is justified by the facts and rationale required under FAR 6.302-2 as follows:
(I) Agency and Contracting Activity. The Department of Homeland Security (DHS), Federal Law Enforcement Training Centers (FLETC), Procurement Division (PRO) and Student Services Division (SSD) proposes to execute a 12-month contract to the incumbent contractor, SRM Group Inc Services Group Inc, 101 Marietta Street, Suite 3330, Atlanta GA, to continue operations for the uniform, equipment issue and laund1y support services. This action is necessa1y while these services are beirig re-solicited as corrective action in response to the U.S. General Accountability Office (GAO) post-award Protest B-412922.
between the contract actions and to maintain continuity in services. The Government has a need to continue uniform, equipment issue and laund1y support services without intenuption as this is a critical support services for the FLETC mission. Failure to maintain the continuity of services at the same quality and technical skill level currently being provided will result in serious injury, financial, or other hardship, to the Government. Training activities, which are necessmy to properly train the law enforcement officers utilizing the uniform, equipment issue and laundry suppmt services, will come to a viitual standstill should this action not be approved. This action is required to expedite procurement of critical services in suppmt of the law enforcement officer training core curriculum. It has been detennined by the Contracting Officer that it would be in the Government's best interest and most practical to procure this action through the incumbent contractor, as SRM Group Inc. has the requisite staffing and corporate knowledge within its ranks to mitigate the concern effectively and efficiently without a break in this critical function.
(5) Description of Etfprts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable. A single source will be solicited for this action as allowed by statute (FAR 6.302-2).
(6) Determination bv the Contracting Officer that the Anticipated Cost to the Govemment will be Fair and Reasonable. The Contracting Officer has reviewed the pricing schedule of HSFLGL-11-C-00007 as well as HSFLGL-16-C-00004. Each was respectively determined fair and reasonable and may be used during price analysis of the bridge contract.
(7) Description o(the Market Research. Market research was accomplished during the sources sought and pre-solicitation phase utilizing past history, market conditions at the time of solicitation, the internet, and responses from the sources sought and pre-solicitation notices. Fmther market research will not be accomplished for this immediate need, but has been conducted as mandated for the follow-on action.
(8) Any Other Facts supporting the use of other than Full and Open Competition. No other facts are available for this action.
(9) A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the Acquisition. FedBizOps synopsis is not required for this action in accordance with FAR Pait 5.202(2). As outlined herein, a request for a proposal will be issued to the incumbent contractor, SRM Group Inc., for a 12-month period pending finalization of conective action as a result of the aforementioned protest.
(I OJ A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required. Synopsis shall be issued for the follow-on solicitation corrective action as a result of the aforementioned protest. It is not anticipated there will be any barriers to future competition.
