Justification for Other than Full and Open Competition

Simplified Acquisition Threshold

1. Vessel: USCGC HENRY BLAKE WLM Buoy Tender

2. Procurement Request Number: 2117857P45C18

3. Description of Supplies or Services: Provide services to overhaul the Center

Section of the 3508 Caterpillar Diesel engine (SSDG #2)

4. Estimated Value of Procurement:

5. Source Available: Caterpillar Inc. and/ or authorized dealers certified to work on the 3508 Diesel Engine

6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available. Check the appropriate reason below:

_X_Only one responsible source and no other supplies or services will satisfy agency requirements, i.e. Unique capabilities, Limited number of sources, Proprietary data or Brand Name Mandatory

___Industrial Mobilization/Standardization

This requirement shall be solicited from limited sources. Caterpillar Inc. only certifies certain individuals / dealers who are qualified to perform services on the 3508 engine.

7. Impact Statement (describe the impact on the mission or property)

The Government would be faced with duplication of cost or unacceptable delays due to non OEM certified companies requiring proprietary information, software, repair process standards, tools and parts pertinent to the tasking held solely by the OEM and

OEM certified technical representatives.

If the Coast Guard does not use OEM Certified Technicians and parts, we would risk failure of the engine or generator and safe operation of Coast Guard Cutters and execution of their missions. This would include icebreaking, maintaining aids to navigation and properly positioning navigational aids for safe transit by marine traffic. Failure of marine diesel engine or generator would limit range of cutter and ability of Coast Guard to conduct missions. This would be a disadvantage to the government and its mission if the justification for other than full and open competition is not approved.

8. Explain why an adequate purchase description or other information suitable to solicit by Full and Open Competition has not been developed or are not suitable.

Caterpillar Inc. possesses the most up to date critical technical data and/or drawings for CAT model D3508 Marine Diesel onboard aboard USCGC HENRY BLAKE.

The OEM along with their authorized dealers is the sole authorized service and incidental parts providers for the Ship Service Diesel Generators and Main Diesel

Engine Model D3508. This data is proprietary to Caterpillar Inc., so we must continue to rely solely on the OEM and certified dealers for these specific services and incidental parts to meet our current needs. Changes to the vessel configurations and costs to develop or procure replacements to the current ship’s service diesel and propulsion system(s) would be cost prohibitive. At the present time, no other known manufacturers produce aftermarket CAT engine parts, which meet the form, fit and function of the Caterpillar Inc. OEM parts.

9. Provide a Statement of Actions, if any, the government may take to remove or overcome any barriers to competition before future acquisitions are required.

The USCG will continue its attempts to obtain proprietary data rights and to conduct market research in accordance with FAR Part 10, with a focus on locating contractors capable of meeting the requirement
