Note : Unde r Executive Order (EO) 13658, an hourly minimum wage of $10.15 for calendar year 2016 applies to all cont r acts subject to the Service Contract Act for wh ich the solicitation was issued on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification l i sted on th i s wage determinat i on at least $10 . 15 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in cal endar year 20 16 . VACATION: 2 weeks paid vacation after l year of service with a contracto r or successor, 3 weeks after 8 years, and 4 weeks afte r 15 years . Length of service includes the whole span o f continuous se r vice wi th the presen t contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at t he same Federal fa cility. An 8 percent diff e rential is a pplicabl e to empl o yees employed in a posit ion tha t represent s a hi gh degree of haza rd whe n working with or in c l ose proximit y to o rdnance , explosives, and incendiary mate rials. Thi s include s work such as screening , blendin g , dying , mixi ng , and p ress ing o f sensitive ordnance , explos i ves, and pyrotechnic composit ions such as l ead azide, b lack powder and photoflash powder .

minima l damage to i mmediate o r adjacent work a r ea or equipment being used . All operations involving , unloading, s torage , and hauling of ordn ance, exp losive, and i ncend i a ry ordnance material othe r t han small arms ammunition . Thes e dif ferenti al s are only applicable to wo rk t hat has been specifical ly designated by t h e agency f or ordnance , e xp losives , and incendiary mate ria l d i f f erential pay .

** UNIFORM ALLOWANCE **

If empl oyees ar e required to wear unifo rms i n the performance of this contract (either by the t erms of the Government contract , by the emp l o yer, by t h e state o r local l aw , etc . ) , the cos t o f furn i s hing such uniforms and maintaining (by launder i.ng o r d ry cleaning) such unifo rms is an expense t hat may not be borne by an employee where such cost reduces the hourl y ra t e below tha t required by the wage dete rmi na tion. The Department of Labo r wil l accept payment in accordance with th e fo llowing standards as comp liance :

The con t ractor or subcontractor is requi red to f u rnish all employees with an adequate number of uniforms wi thout cos t or to reimburs e employees for the actual cost of the un~forms . In addition, where unifo rm cleaning and maint e nance is made the responsibi l ity of the employee , all contractors a n d subcontractors subject to this wage determinat ion s hall (in the absence o f a bona f i de collective bargaining agreement prov i din g for a d iffe rent amount, or the fu r nish ing of cont ra r y aff irmat ive p :coof as to the actual cost) , re i mburse all employees for such cleaning and ma i ntenance at a rat e of $3.35 pe r week (or $ . 67 cents p e r day) . However , in thos e ins tances whe re the uniforms furnished are made o f " wash a n d wear " materi al s , may b e rout inely washed a nd dr ied wi th other personal garme nt s, and do not r equi re any s pec i al tre atment s uch as dry cleaning, da il y washing , or comme rcial laundering in order to meet t he cleanliness or appearance standards set by the terms of the Government contract, by the contractor , by law , or by the nature o f the work, there is no r equirement tha t employees be reimbursed for uniform maintenance costs .

The contracting officer shal l require that a ny c l as s of servi ce employee which is not listed herein and which is to be employed u~der the contract (i . e . , the work to be performed i s not per f ormed by any classification li sted in the wage de te rmina t ion} , be classified by the cont ractor so as to provi de a r easonab le relat ionsh i p (i . e . , app r opriate level of skil l comparison} between such un l isted classifications a nd the classifications listed in the wage determination . Such conformed classes o f emp l oyees s hall be paid the moneta r y wages and furnished the fring e benef i ts as are determi ned (See 29 CFR 4. 6 (b} (2) (i}} . Such c onforming procedures shall be i nitiated by the cont rac t or pr i or to the performance of cont ra ct work by such unlisted class (es) of employees (See 29 CFR 4 . 6 (b) (2) (ii)} . The Wage and Hour Di vision shal l make a fina l de terminat ion o f confo rmed clas si ficat ion , wa ge rate , and/o r fr inge benefits which shall be ret roact i ve to the commencement date o f the contract (S ee 29 CFR 4 . 6 (b} (2) (iv) (C) (v i }) . When multiple wage determi nations are included in a contract , a sepa r ate SF- 1444 should be p r epared for each wage determination to whi ch a c l ass( es} is to be conforme d .

The process f o r preparing a conformance request is as f ollows :

1) When p reparing the bid, the contractor identifies the need for a conformed occupation(s} and computes a proposed rate(s} .

~} Aft er contract award , the c ontrac tor prepare s a written r epo r t li st i ng in order t he proposed class i ficat i on ti tl e(s} , a Fede ra l grade equival ency (FGE} for each proposed class if i cat i on(s} , job description(s) , and rationale for proposed wage rate(s) , including info rmation r egarding the agreement or disag r eement of the a utho r iz e d repre sentativ e of the emp loyee s involved, o r whe r e there is n o authorized repres e ntative , the employees themse l ves . Thi s report should be submitted tc the contracting off icer no later than 30 days after such unlisted class (es) of employees performs any contract work .

3) The cont racting officer rev i ews t he proposed action and p romptl y submits a report of the act ion, together wi th the agency ' s re commendati ons a nd pertinent information including the posit i on of the contra c to r and the empl oyees , to the Wage a nd Hour Division , U. S . Depa r tmen t of Labor , f or revi ew (See 29 CFR 4 . 6(b) (2) (ii)).

4) Within 30 days of receipt , the Wage and Hour Di vision approves , mod i fies, or d is approves the ac tion vi a transmittal to t he agency c ontract ing of ficer , or noti fie s the cont racting off i cer that a ddit ional time wil l be required to p r ocess the request .

5 ) The contr ac ting of f i ce r transmits the Wa ge and Hour decision to t he con tractor.

6) The contractor in fo rms the af fected employees .

In fo rmation r equ i red by the Regulat ions must b e submi tted on SF- 144 4 or bond paper .

When prepar i ~g a conformance request , the " Se r vice Contract Act Di rectory o f Occupations '' (the Direct ory) should be used t o compare job d e finition s t o ensure that duties r equested are not performed by a class ificat i on alre ady listed in the wage determination . Remembe r, i t is not the j ob title , but t he required tasks that determine whether a class is included i n an establi shed wage dete rmination .
