JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
PR#
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
1. Agency and Contracting Activity: USCG, Air Station Cape Cod Supply Department proposes to enter into a contract on a basis other than full and open competition.
2. Nature and/or description of the action being approved:
The approval for a sole source justification is required for the replacement of the MH- 60T Hangar’s antiquated, unsafe, and non-OSHA compliant aircraft check stands and MH-60T tail rotor inspection stand utilized in the inspection, servicing, and maintaining of the units helicopters. The previous model of check stands proved unstable, decrepit, and a true safety hazard in that the unit suffered a casualty in the form of an employee falling off the check stand due to the failed condition of the safety rails. In order to prevent future mishaps, and to comply with stringent OSHA safety regulations, Air Station Cape Cod seeks to purchase two (2) all aluminum construction work platforms and one (1) tail rotor inspection stand from Spika Manufacturing. In regards to the MH-60T tail rotor inspection stand, the height adjustment mechanism is broken beyond repair, thereby severely hampering the completion of maintenance evolutions on the tail rotor, in addition to missing key safety rails. Air Station Cape Cod researched for comparable check stand systems meeting the hangar deck’s unique maintenance and inspection needs and found no other vendors with a product with the applicable height adjustability coupled with span wise airframe coverage to prevent employee falls. Spika Manufacturing is the only vendor that manufactures the only height adjustable check stands meeting the needs of the MH-60T model helicopter.
Please note that while there are manufacturers that claim to make check stands for the “H60 family of helicopters”, these products do not meet the needs of the unique Naval variant of the MH-60T found within the United States Coast Guard. These differences are derived from the placement of the aircraft tail wheel at the mid section of the airframe, which greatly changes the height dimensions of the helicopter when compared to its non-Naval variant models (ie; UH-60A/L/M, HH-60G, SH-60S).
This height difference is most pronounced at the tail section of the helicopter, whereas it sits lower than the land based variants. Completion of maintenance with non-adjustable check stands commonly employed on the non-Naval variant of the H60 proves extremely problematic and a hazard to safety when applied to the USCG’s MH-60T.
3. Description of Supplies or Services Required and the Estimated Value:
Purchase of two (2) OSHA compliant all aluminum work platforms, Model Name:
Valor Series. Model # V69x196x64-88APFVL. Furnish and deliver two (2) OSHA compliant, all-aluminum construction work platforms 69” wide, 196” long, and manually adjustable from 64” to 88” in height. Stand must contain sliders that extend in and out of the front of the work deck from 1” to 24” and self-storing front hand rails. Work deck has an 800 lb load rating. Supplied stair cases must be variable pitch capable and can be used as an independent work platform with a 400 lb load rating. Complete system must have a standard finish of bare aluminum with safety yellow powder coated hand rails. Service air and electric receptacles are required and are to be placed on top of the work platform. Leveling jacks are required and are to be provided on the deck frame of the platform. Quote#: 10379. Total Price:
$57,069.58. Shipping: $0.00.
Purchase of one (1) OSHA compliant all aluminum MH-60T tail section phase maintenance work platform. Model Name: N/A. Model Number: PMP-UH60-T.
Furnish and deliver one (1) OSHA compliant, all aluminum construction MH-60T tail rotor phase maintenance work platform. Must include 2 work decks and 1 staircase plus the associated cross over rails. The work deck must include compressed air and electrical service receptacles. Tail rotor phase maintenance platform must include 30” height adjustability, from 66” high to 96” high, in order to allow the spinning of the tail rotor blades during the completion of various maintenance tasks. Each work deck must have an 800 lb load rating. Supplied stair case must be used as an independent work platform and have a 400 lb load rating. Complete system must have a standard finish of bare aluminum with safety yellow powder coated hand rails.
4. Identification of Statutory Authority Permitting Other Than Full and Open Competition:
The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) implemented by Federal Acquisition Regulation (FAR) Subpart.6.302-1 entitled “Only one responsible source and no other supplies or service will satisfy agency requirements”.
5. Demonstration that the Nature of the Acquisition Require Use of Cited Authority: Air Station Cape Cod researched comparable work platform manufacturers and determined that Spika Manufacturing is the only vendor that manufactures the adjustable height work platform system compatible to unit needs and of sufficient span wise width and length for the USCG MH-60T model of helicopter. Upon approval, the new check stand system will replace the older, decrepit, and non-OSHA compliant work platforms, and will assist in completing comprehensive maintenance, servicing, and inspection of the unit’s MH-60T fleet.
6. Description of Efforts Made to Ensure that Offers are Solicited from as many potential sources as is practicable: Air Station Cape Cod Engineering Department conducted market research and determined that no other company other than Spika Manufacturing builds an adjustable work platform system of sufficient span wise width and length for the USCG MH-60T model of helicopter in conjunction with height adjustability to meet stringent maintenance needs. All other portable options are too heavy, non-aluminum, restricted in their freedom of movement, and non-adjustable thus making the comprehensive maintenance, servicing, and overhaul of the unit’s fleet of helicopters extremely difficult and a hazardous evolution. The broken and non-OSHA compliant work platforms that are to be replaced are decade’s old and are beyond reasonable costs to repair, therefore necessitating full on replacement with a new height adjustable work platform system.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer determines that the anticipated price will be fair and reasonable based on information provided by the Air Station Engineering Department and Market Research.
8. Description of Market Research: Market Research was completed using FEDLOG, GSA Advantage, Catalogs and the Internet.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition:
Air Station Cape Cod researched other work platform systems, however, no other manufacture builds an adjustable work platform system of sufficient span wise width and length for the USCG MH-60T model of helicopter in conjunction with height adjustability to meet stringent maintenance needs.
10. Listing of the Sources, if Any, That Expressed, in Writing, an interest in the Acquisition: No other sources are able to provide the service expertise required for this item.
1. Action taken to remove Barriers to Competition: No other company meets this requirement and therefore barriers cannot be removed.
2. Approvals:
a. Contracting Officer’s Certification:
