Justification for Other Than Full and Open Competition Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3, HSAR 3006.3, HSAM 3006.3, CGAP 1206.3, and in accordance with (IAW) requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.302-1 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

1) Agency and Contracting Activity:

The US Coast Guard, Command, Control and Communications Engineering Center (C3CEN), proposes to purchase equipment on a basis other than full and open competition.

2) Nature and/or description of the action being approved:

Brand name justifications to purchase E2V Technologies Magnetron Electron Tubes are equipment proprietary to the United States Coast Guard’s Vessel Traffic system (VTS). The reason for purchasing is due to insufficient stock levels to support forecasted field requisition requests for VTS/Radar Sensor System (RDSS) for future years.

3) Description of Supplies:

The proposed acquisition consists of the following:

ELECTRON TUBE W/ BANANA PLUG, MG5239T/C, 5960-01-628-2760

ELECTRON TUBE W/ BANANA PLUG, M5089T/C, 5840-01-643-0556

ELECTRON TUBE Part NBR: M5230T, 5960-01-648-1872

4) Identification of the Statutory Authority Permitting Other Than Full and Open Competition:

The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

Section (ii) “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in— (AA) Substantial duplication of cost to the Government that is not expected to be recovered through competition…” is directly applicable.

5) Demonstration That the Nature of the Acquisition Requires Use of the Authority Cited: These E2V Magnetron Electron Tubes are part of the United States Coast Guard’s Vessel Traffic system (VTS) that have been approved through engineering testing. These are vital parts of the VTS/Radar Sensor System (RDSS and to deviate from this approved standard configuration would require additional engineering review, testing, and prototyping that will interrupt the current Ao VTS performance.

6) Description of Efforts Made to Ensure Offers are Solicited From as Many Potential Sources as Practicable:

The E2V Magnetron Electron Tubes allow a proper connection to RDSS hardware and have been proven via test to be compatible to ensure proper operation and performance. All parts must be the same in form, fit and function as the already supported assemblies to ensure proper system execution. The current stock level is insufficient to support forecasted field requisition requests.

7) Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:

Fairness of price is based on past purchases of similar equipment.

8) Description of Market Research:

Market research is the OEM general pricing for:

9) Any Other Facts Supporting the Use of Other Than Full and Open Competition:

Reengineering the RDSS to include new Magnetron Electron Tubes that are compatible would require elaborate testing of the system features, associated equipment and cost, time, and schedule to develop isn’t feasible.

10) A Listing of the Sources, if Any, That Expressed, in Writing, An Interest in the Acquisition:

No other interest has been expressed.

11) A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required:

The CG has identified that the RADAR is fast approaching the end-of life in accordance with systems development life-cycle (SDLC). The CG is in the process of identifying and validating the operational requirements to replace the RADAR system that will work on shore and ship based platforms in order to have a smaller logistics parts footprint and will provide economies of scale.

12) This justification is accurate and complete to the best of my knowledge and belief. The anticipated cost to the Government is determined to be fair and reasonable.
