These parts directly support the propulsion components of the

WMSL.

Proper or safe operation cannot be accomplished without these parts.

These items are to stock for planned and unplanned maintenance casualty repairs.

These specific parts on this

PR

include a hub overhaul kit, hub inspection kits and blade install kit.

These kits are being requested in

WASCHE

upcoming

SEDA.

Coast

Guard does not possess the manufacturing and technical data to procure these parts from another vendor.

The

CG

does not have the ability to certify another vendors after m arket parts due to the lack of technical data available.

Failure of these parts will seriously impact the cutters ability to perform its mission.

These parts are required for stock, maintenance and repair.

The parts have known to have longer than unusual lead time and should be considered in the procurement process.

This acquisition must be made using sole source brand name parts and assemblies.

The applicable statutory authority applicable is

USC

2304(c)

(1) because the

OEM

is the only known source that possesses the required capabilities, drawings, specifications, engineering control procedures and proprietary methods to ensure the latest design configuration, manufacturing and quality control required to produce parts to the latest engineering specifications and requirements.

The

Coast

Guard does not possess or own the technical data required to solicit these parts from a source other than the

OEM

or an

OEM

distributor.

The

Coast

Guard does not own the rights to

Rolls-Royce Marine

North

America’s technical data and is not resourced with the engineering staff or funds required to reverse engineer the thousands of parts required to support the assemblies in order to determine their dimensions, tole rances, or chemical composition.

Rolls-Royce Marine

North

America has declined to sell their technical data rights upon repeated requests.

The

CG

has made several attempts to acquire them with no success, including an attempt for this requirement on

November

3, 2016.

The

Coast

Guard will continue to engage

Rolls-Royce Marine North

America for release of proprietary data prior to any subsequent requirement.
