Pursuant to the requirements of the Competition in Contracting Act, as implemented by Federal Acquisition Regulation (FAR) 6.3 and in accordance with (IAW) the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is supported by the facts and rationale required under FAR 6.303-2 as follows:
(1) Agency and contracting activity.
The Department of Homeland Security (DHS), United States Coast Guard (USCG) Aviation Logistics Center (ALC), Medium Range Recovery (MRR) Procurement Branch, proposes to enter into a purchase order on a basis other than full and open competition.
(2) Nature and/or description of the action being approved.
As the Aviation Inventory Control Point, ALC is required to provide effective supply support for all USCG Aviation Units and for Program Depot Maintenance (PDM) support. MRR has a requirement to procure three (3) Overhead Switch Pan Kits, three (3) Avionic Rack Install Kits, one (1) Relay Switch Box, one (1) Battery Monitor Panel, one (1) Mission Control Panel, one (1) Miscellaneous Panel, one
(1) Data Panel Assembly, one (1) FLAC Control Panel, and one (1) White Searchlight, hereafter referred to as Components. The Original Equipment Manufacturer (OEM) is Computer Sciences Corporation (CSC). All specifications, manufacturing drawings, data, test equipment, and tooling required to manufacture these Components are proprietary to CSC. The total estimated value for this requirement is
The proposed contractor is:

(3) Description of supplies/services.
The USCG currently operates a fleet of forty-four (44) MH-60T rotary wing aircraft. This specialized, high demand, aircraft currently enables the USCG to perform missions such as search and rescue, law enforcement, international ice patrol, marine environmental protection, and marine resource conservation. With such a demanding operational tempo, aircraft condition and availability are essential to mission success. This requirement is for the initial outfitting of a US Navy conversion aircraft to the USCG MH-60T model configuration. These Components are required to outfit the former US Navy aircraft to the current version used on all USCG MH-60T model aircraft. Delivery is anticipated to be ninety (90) calendar days after receipt of the purchase order. The requirement consists of the following Components:

(4) Identification of the justification and the rationale.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (1) as implemented by FAR 6.302-1 entitled “Only one responsible source and no other supplies or services will satisfy agency requirements.”
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
In accordance with the DHS Acquisition Decision Memorandum dated Sep 6, 2011, the DHS Acquisition Program Management Division has reviewed the USCG H-60 Segment 1 and 2 Operational Requirements Documents (ORDs) dated November 23, 2009, and May 10, 2010. These ORDs allow the end-user to accurately define the capabilities required for the acquisition program manager to enable the end-user to execute the assigned mission. The ORDs for USCG H-60 Avionics (DS1) defines systems capabilities and performance standards for the Coast Guard H-60 Avionics System and remains aligned with the Integrated Deepwater System Mission Need Statement Update, Revision 1.0. The Components specified for procurement by this requirement are restricted to sources approved by ALC MRR Engineering. ALC MRR Engineering is responsible for providing engineering policies, processes, and support necessary for design, configurations integrity, and airworthiness. CSC is the OEM and only ALC MRR Engineering approved source which possesses all the necessary data, specifications, and drawings required to manufacture these Components. These Components are universally used on the MH-60T models throughout the fleet.
(6) Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
This procurement forecast is posted as DHS – Acquisition Planning Forecast System (APFS) No:
F2015026269 on http://apfs.dhs.gov. Prior to award, a notice of intent to award a sole source purchase order fulfilling the notice requirement of FAR 5.201 will be posted to the Governmentwide Point of Entry (GPE) via http://www.fedbizopps.gov. A copy of the approved J&A will be uploaded with the notice. Any quotations or capability statements received in response to the notice will be considered prior to award.
(7) Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer anticipates prices will be determined fair and reasonable using price analysis techniques including comparison of the proposed price with prices found reasonable on previous purchases and comparison of the proposed price to the Independent Government Cost Estimate (IGCE).
(8) Description of market research.
A Federal Logistics Information System Web Search confirmed that CSC is the only source of supply.
Further market research was performed using Federal Logistics (FEDLOG), GSA Advantage, DOD- Emall, and historical information in the USCG’s database for the same and similar Components. Market research confirmed CSC is the only known source of supply for these Components. Additional sources were not identified.
(9) Any other facts supporting the use of other than full and open competition.
CSC was contacted to inquire about the release of any proprietary technology to the USCG or any other distributors. CSC responded that their technology is proprietary and resale of their proprietary technology is prohibited.
(10) A Listing of the sources, if any that expressed in writing, an interest in the acquisition.
To date, no other sources of supply have expressed interest in this requirement.
(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services.
The USCG did not purchase rights to the proprietary technology required to manufacture these Components as part of any original provisioning for use on the MH-60T aircraft and CSC has not agreed to release their proprietary technology at this time. The USCG will continue to request CSC release information required to foster a competitive environment prior to the execution of any subsequent purchases. In addition, when it is determined that technology has surpassed the current Components architecture the USCG will pursue technology refreshment techniques through full and open competition.
(12) Contracting Officer’s Certification.
I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
Contracting Officer Date
(13) Technical/Requirements Personnel Certification.
I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for the justification, is accurate and complete.
