Justification for Other than Full and Open Competition under 10 U.S.C. 2304( c)(1) Only One Responsible Source and No Other Supplies of Services will Satisfy Agency Requirements Pursuant to the requirements of section 4202 of the Clinger-Cohen Act (Test Program for Commercial Items) as implemented by FAR 13.501(a)(2)(ii), this justification for other than full and open competition is supported by the facts and rationale required under FAR 6.303-2 as follows:
1. Agency and Contracting Activity. U.S. Coast Guard, Aircraft Logistics Center (ALC), H-60J Supply Cell, Elizabeth City, NC, proposes to enter into a contract on a basis other than full and open competition.
2. Nature and/or description of the action being approved. The Justification for Other Than Full and Open Competition seeks approval to issue a firm-fixed price contract on a sole source basis to Stevens Manufacturing Co, Inc, 220 Rock LN, Milford CT, 06460-3853 for the purchase of: Table Assembly, LH (70850-82056-041), Table Assembly, RH (70850-82056-042), Plate Assembly Base, LH (70850-82055-043), & Plate Assembly Base, RH (70850-82055-044), Stevens Manufacturing Co, Inc is the only known source of the items listed.
3. Description of Supplies/Services. This procurement is for the purchase of new, Table Assembly, LH (70850-82056-041), Table Assembly, RH (70850-82056-042), Plate Assembly Base, LH (70850-82055-043), & Plate Assembly Base, RH (70850-82055-044)to be installed on the H60 airframe purchased from Stevens Manufacturing Co, Inc
| 70850-82056-041 | 10 each |
| 70850-82056-042 | 10 each |
| 70850-82055-043 | 10 each |
| 70850-82055-044 | 10 each |
4. Identification of Statutory Authority Permitting Other Than Full and Open Competition The statutory authority permitting other than full and open competition is 10 USC 2304(c) (1) implemented by the Federal Acquisition Regulation (FAR) Subpart Regulation 6.302-1: Only one of a limited number of responsible sources and no other supplies or services will satisfy agency requirements.
5. Demonstration That the Nature of the Acquisition Requires Use of the Authority Cited. Coast Guard aircraft operate primarily in a saltwater environment and are subject to corrosion. Corrosion is expected on equipment and will be replaced as needed. During inspection and functional test, the presence of corrosion on a table or plate assembly will constitute reason for a more thorough disassembly and inspection. These assemblies are consumable items and cannot be repaired they must be replaced. The Table and Plate assemblies are interchangeable within and throughout the Coast Guard MH-60J/T fleet.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The intent to issue a firm-fixed price contract for the acquisition of the aforementioned parts will be submitted to Federal Business Opportunities upon approval of this document. Any eligible vendor may submit a proposal. All responsible offers will be considered. However, it is known that only Stevens Manufacturing Co, Inc produces and sells these components for use on the Sikorsky HH-60J aircraft. No alternate part numbers have been identified to be used in these applications from the OEM drawing, CGTO 1H-60-4, Fig 2, Item 27, Item 79, Item 41, and Item 8. Any new source must be approved by HH60 Engineering.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. It is the Contracting Officer’s opinion that price ultimately negotiated for this procurement will be fair and reasonable based on cost and price analysis and comparison with historical prices paid.
8. Description of Market Research. A market survey has been conducted concerning the acquisition of the aforementioned parts. During my market research, there were no other supply sources identified. Research was conducted using ILSmart, WEBFLIS, FEDLOG, GSA Advantage, and HAYSTACK. Information acquired from trade shows, internet research, and posting on FEDBIZOPS will all indicate Stevens Manufacturing Co, Inc is the only known commercial source of supply.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition. The Coast Guard did not purchase data rights as a part of the initial system acquisition for the HH-60J helicopter. Therefore, it would be difficult to take steps to foster competition as the manufacturing performance and acceptance data are proprietary and the Coast Guard does not have adequate technical data to provide to potential offerors.
10. A Listing of the Sources, if any, which Expressed, in Writing, an Interest in the Acquisition.
A combined solicitation/synopsis notice will be issued upon approval of this document. To date there have not been any inquiries about this procurement.
11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required All contractors are eligible to apply for certification through the OEM to become a distributor.
12. Contracting Officer’s Certification I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
