PROVISIONS
FAR PROVISIONS:
FAR 52.212-1 Instructions to Offerors – Commercial Items (Apr 2014) applies to this acquisition and is incorporated by reference. Addendum to FAR 52.212-1 is as follows:
A. INSTRUCTIONS FOR PROPOSAL CONTENT: Offeror’s proposals shall be submitted in two (2) separate volumes. Both volumes must indicate the solicitation number (HSCG23-14-R-MMC004), name, mailing address, e-mail address, telephone number, DUNS number, and Cage Code for the offeror and any team members.
Volume I – Technical Approach, Management Approach and Past Performance https://www.fincen.uscg.mil/secure/payment.htm
Volume I shall contain two (2) sections. This volume must be submitted as a .pdf file.
1. TECHNICAL APPROACH: The offeror shall describe its Technical Approach to accomplish the requirements in Section 2.0 of the SOW. Responses shall be sequentially ordered and identify the SOW paragraphs by number. The proposal shall clearly demonstrate how the approach cited relates directly to the successful performance of each requirement. The offeror shall include a comprehensive discussion of the issues relevant to successfully performing and completing the outlined tasks, the interrelation and complexity of the tasks, anticipated problems, limitations or constraints, and solutions to those limitations and constraints. The offeror shall ensure the discussion reflects a thorough understanding of and compliance with the schedule of deliverables, milestones, and timetables, as described in the SOW.
2. MANAGEMENT APPROACH: The offeror shall describe the managerial process for accomplishing the scope of work identified in the SOW. The offeror shall discuss how it will recruit and retain skilled personnel (provide examples of success at recruiting, retaining, and supplying qualified personnel on previous contracts or task orders). The offeror shall discuss technology and tools it will use to effectively manage the task order.
The offeror shall discuss how it will manage the transition to another Contractor (i.e., potential awardee in five (5) years) at the end of the task order.
The offeror shall describe its approach for ensuring that proposed key personnel possess the experience, education, training, and technical expertise required to perform the duties described in the SOW. In accordance with the SOW, the Program Manager and their alternate shall be designated as key. Include resumes for the proposed Program Manager and their alternate to demonstrate appropriate knowledge and experience. Each resume shall not exceed two (2) pages.
Offerors shall discuss in detail all Teaming Arrangements (including identification of partners and subcontractors), identifying which work is to be performed by the prime, partner(s) or subcontractor(s), if applicable, and how these efforts will be effectively managed.
Offerors shall identify labor categories and provide details regarding their roles, responsibilities, and work to be performed. Although Volume 1 shall not contain any reference to price, resource information (i.e., labor mix and labor hours) must be provided so that the offeror’s Management Approach can be evaluated.
The Management Approach shall not exceed four (4) pages, which does not include resume pages.
Volume II
Volume II shall contain the price proposal. Price proposals shall be submitted on a firm-fixed priced basis. The offeror’s price proposal shall be submitted using Microsoft Excel, Excel 97-2003 Workbook (*.xls) version. The price proposal shall include the labor categories and hours that are appropriate to meet all the requirements contained in the SOW. The labor rates shall be fully burdened. Government requests that offerors consider discounting their labor rates to the maximum extent.
The Government estimates, but does not guarantee, that 19,740 labor hours will be required to perform the requirements of the SOW for each year of the task order, inclusive of the base year and each option year. Offerors shall distribute labor hours among labor categories to support their technical approach. Offerors may use the Government’s labor hour estimate as a basis for price proposals, or offerors may choose to propose on a different basis. If the proposal is not based on the Government’s estimate, the offeror shall explain the rationale for the basis. Contractor travel will not be required to support this contract.
The offeror shall calculate the total evaluated price, to be inclusive of the base year plus four (4) option years, by multiplying proposed fully burdened labor rates by the respective hours proposed.
It is Department of Homeland Security (DHS) policy that fair and reasonable pricing be based on consideration of obtaining adequate price competition. In the event only one (1) responsible proposal is received in response to this solicitation, the offeror may be required to submit other than certified cost or pricing data for the purpose of supporting price analysis.
B. PROPOSAL PAGE LIMIT: The page limit for Volume I is 21 one-sided pages.
For Volume I, the cover letter is not included in the page limit; however, brochures and product literature are included in the page limit. There is no page limit for Volume II.
For both volumes, the minimum font size for text is 12 points. The proposal must be submitted on 8.5” x 11” pages. All pages will be printed in black and white. Any pages exceeding this limit will not be evaluated.
C. SOLICITATION AMENDMENTS: Questions and answers will be issued as an amendment.
D. PROPOSAL COSTS: The Government will not pay for costs incurred in the preparation and submission of proposals or other costs incurred in response to this announcement.
E. PERIOD FOR ACCEPTANCE OF OFFERS: The Offeror agrees to hold terms in its offer firm for 90 calendar days from the date specified for receipt of offers.
F. NOTICE FOR FILING AGENCY PROTESTS
It is the policy of the USCG to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
INFORMAL FORUM WITH THE OMBUDSMAN: Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
FORMAL AGENCY PROTEST WITH THE OMBUDSMAN: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed.
This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

FAR 52.212-2 Evaluation – Commercial Items (Jan 1999)
(a) The Government intends to award a single-award fixed price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will conduct a Best-Value Trade-Off analysis using the following evaluation factors (listed in descending order of importance):
Technical Approach Management Approach Past Performance Price
When combined, Technical Approach, Management Approach and Past Performance (non-price factors) are significantly more important than Price.
(b) Evaluation Factors:
The Government will evaluate the proposals against the following three (3) factors:
Technical Approach: The Government’s intention is to ensure that the proposed Technical Approach clearly demonstrates a thorough understanding of the SOW, and based on the level of effort proposed, the offeror is capable of doing the work. Simply restating the SOW requirements will not be rated as satisfactory demonstration of a Technical Approach. Additionally, the Government will evaluate the proposed labor mix and labor hours to determine whether it is consistent with the Technical Approach.
Management Approach: The Government will evaluate each offeror’s Management Approach for the purposes of determining how well the offeror demonstrates its ability to sustain adequate resources (e.g., personnel) throughout the life of the task order to successfully meet all the requirements delineated in the SOW. Offerors shall demonstrate plans that optimize employee recruitment, training and retention and ensure consistent staffing of USCG requirements. If used, offerors shall demonstrate plans to exert positive control over teaming partners and subcontractors or create effective managerial delegations among teaming partners and subcontractors, while retaining overall management control. Resumes will be reviewed to evaluate the knowledge and experience of key personnel as they relate to this SOW.
Past Performance: The Government’s intent is to determine whether the offeror consistently delivers quality products and services in a timely manner.
