STATEMENT OF WORK

U.S. Customs and Border Protection Seized and Forfeited Ammunition Destruction/Demilitarization Services

A. AUTHORITY

Economy Act of 1932 (31 U.S.C. 1535) with additional requirements for this Act in Federal Acquisition Regulation (FAR), 48 CFR 17.6 Others include: The Homeland Security Act of 2002 P.L. 107-296 Sec. 309; The Government Management Reform Act of 1994 (31 U.S.C. 501); and the Office of Personnel Management Revolving Fund (5 U.S.C. 1304(e)(1)). Seized Asset Management and Enforcement Procedures Handbook (SAMEPH-HB4400-01B).

B. BACKGROUND

Customs and Border Protection (CBP) Officers, Border Patrol Agents and Homeland Security Investigations Special Agents with the Department of Homeland Security (DHS), seize hundreds of thousands of rounds of various caliber ammunition as part of enforcement actions. These seizures take place at controlled ports of entry as well as uncontrolled areas along the border and interior of the United States and are aimed at stopping the flow of prohibited ammunition into the country and seizing ammunition for other violations of law.

CBP is tasked with the storage and disposition of seized and forfeited ammunition in support of these enforcement actions. Once forfeited, orders of destruction are issued by the CBP issuing authority and the ammunition must be disposed of in a secure, safe and verifiable manner as prescribed in HB4400-01B.

C. OBJECTIVE/PURPOSE

CBP is seeking to establish a contract with a vendor capable of providing services that can destroy/demil seized and forfeited ammunition in accordance with the scope and tasks outlined in this document.

Definition of Terms:

Agency: U.S. Customs and Border Protection (either employees of or designated authorized representative)

Ammunition: Powder propelled projectiles, utilized in small arms, rifles and shotguns.

Base components of ammunition: Case (generally brass, nickel, or steel).

Primer: An ignition for the propellant (typically the round dimple on the base of the cartridge).

Powder/propellant: Also known as gunpowder.

Projectile: Also known as the bullet, is the part cartridge that actually leaves the weapon and has the effect on the target.

Destruction: Any process whereby the ammunition is rendered unserviceable, ineffective and unusable in its original form.

Demil: (Demilitarize) Process whereby ammunition is manipulated (either manually or mechanically) to separate/deconstruct the base components, rendering the ammunition unserviceable and in effect destroyed.

Recycle: The repurposing of defined base components for sale to persons or entities that make ammunition from demilled components.

Lots: Ammunition shipped in bulk quantities, by groups or by single seizure.

D. SCOPE

1. This document describes the acceptance, storage, destruction/demil process, issuance of Certification of Destruction/Demilitarization (COD), accountability, and physical security of seized and forfeited ammunition that has been identified as non-evidentiary and ready for final disposition.

2. Handling and processing specifications are provided in this document.

3. The work included under these specifications consists of furnishing labor, equipment, materials, supplies, secured storage, and performing all operations necessary to destroy/demil all received ammunition in compliance with the specifications outlined in this document.

4. The vendor must provide unrestricted and without notice, site access to the agency for the purpose of oversighting the process.

5. Vendor must provide personal contact information of all personnel that have access to the ammunition in order to vet (conduct background checks) those persons that are part of the contractors labor force.

6. Notify the Contracting Officer of any changes in personnel at the vendor facility.

7. Vendor must provide a COD to the agency, certifying that the ammunition has been destroyed/demilitarized.

E. TASKS:

The vendor shall complete the following tasks as required, to comply with the SOW:

1. Receive small and large shipments of lots by postal carrier, private carrier or trucking transport service.

2. Once received, shipments are reviewed and accounted for by matching the shipment with the custodial documentation (DHS Form 6051S and/or CBP Form 7605) that accompany the lot(s).

3. Once custody has been signed for by the vendor, the vendor assumes physical control of the ammunition and all responsibility for handling and storage.

4. Custodial documentation once reviewed and verified to be accurate, must be signed for at the time of receipt/transfer by the vendor representative.

5. Signed custodial documentation must be returned to the agency within 7 calendar days of receipt of the lot(s).

6. Lot(s) are destroyed/demilled at the discretion of the vendor utilizing a verifiable process to render the ammunition in its original form unserviceable.

7. Certify the destruction/demilling and provide the agency a Certificate of Destruction/Demilitarization (COD) within 7 calendar days of the completion of processing the lot(s).

Lot(s) may be stored long term pending the destruction/demil process but must be secured in such a way to limit access to authorized personnel and secured to prevent tampering or theft.

Maintain Closed Circuit Television Cameras to monitor the destruction/demil and storage process.

9.

Provide unannounced agency access to the facility and ammunition processing and storage areas for the purposes of observation and oversight no less than 4 times annually.

10.

Maintain a DHS Form 6025 Logbook recording access to the secure storage area by all visitors.

11.

Vendor may consider recycling of the demiled components or dispose of them in a safe manner in compliance with Federal, State, and local environmental requirements.

F. DELIVERABLES:

1. Signed custodial documentation must be returned to the agency within 7 calendar days of receipt of the lot(s).

2. CODs must be completed and returned to the Agency within 7 calendar days of the demilling of the lot(s).

G. GOVERNMENT FURNISHED EQUIPMENT:

1. DHS Form 6025 Logbook – to be filled out by all visitors having access to CBP seized and forfeited ammunition.

H. PERIOD OF PERFORMANCE:

A base year from date of award, with three (3) – one (1) year option periods.

Option year(s) periods dependent on contract effectiveness and SOW adherence.
