(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in paragraphs (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause--

II.11 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
II.12 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

II.23 HOLIDAYS AND ADMINISTRATIVE LEAVE (MAR 2003)
U.S. Customs & Border Protection (CBP) personnel observe the following days as holidays:

When any such day falls on a Saturday, the preceding Friday is observed. When any such day falls on a Sunday, the following Monday is observed. Observance of such days by Government personnel shall not be cause for an extension to the delivery schedule or period of performance or adjustment to the price, except as set forth in the contract.
Except for designated around-the-clock or emergency operations, contractor personnel will not be able to perform on site under this contract with CBP on holidays set forth above. The contractor will not charge any holiday as a direct charge to the contract. In the event Contractor personnel work during a holiday other than those above, no form of holiday or other premium compensation will be reimbursed as either a direct or indirect cost. However, this does not preclude reimbursement for authorized overtime work.
In the event CBP grants administrative leave to its Government employees, at the site, on-site contractor personnel shall also be dismissed if the site is being closed. However, the Contractor shall continue to provide sufficient personnel to perform around-the-clock requirements of critical efforts already in progress or scheduled and shall be guided by the instructions issued by the Contracting Officer or her/his duly appointed representative. In each instance when the site is closed to Contractor personnel as a result of inclement weather, potentially hazardous conditions, explosions, or other special circumstances; the Contractor will direct its staff as necessary to take actions such as reporting to its own site(s) or taking appropriate leave consistent with its policies. The cost of salaries and wages to the Contractor for the period of any such site closure are a reimbursable item of direct cost under the contract for employees whose regular time is normally a direct charge if they continue to perform contract work; otherwise, costs incurred because of site closure are reimbursable as indirect cost in accordance with the Contractor's established accounting policy.
II.24 BASIS OF AWARD (TRADE-OFF ANALYSIS) (JUN 2007)
Award shall be made to the offeror whose proposal is determined to best meet the needs of Government after consideration of all factors-- i.e., provides the "best value". "Best value" is defined here as the procurement process that results in the most advantageous acquisition decision for the Government and is performed through an integrated assessment and trade-off analysis among cost or price and non-cost or non-price factors.
The basis for the award of a contract as a result of this Request for Proposal (RFP) will be a detailed, integrated evaluation by the Government on the basis of how well the proposals satisfy the evaluation criteria contained in the provision entitled "Evaluation Criteria" in this solicitation. Accordingly, the Government may award any resulting contract to other than the lowest priced offeror(s) or other than the offeror(s) with the highest technical merit rating.
The Contracting Officer or Source Selection Authority has the right to determine whether two or more technical proposals are "substantially equal" or whether any differences in technical weighing are "significant" for purposes of evaluating the overall merit of proposals. II.24 3052.204-71 CONTRACTOR EMPLOYEE ACCESS (JUN 2006)
a) Sensitive Information, as used in this Chapter, means any information, the loss, misuse, disclosure, or unauthorized access to or modification of which could adversely affect the national or homeland security interest, or the conduct of Federal programs, or the privacy to which individuals are entitled under section 552a of title 5, United States Code (the Privacy Act), but which has not been specifically authorized under criteria established by an Executive Order or an Act of Congress to be kept secret in the interest of national defense, homeland security or foreign policy. This definition includes the following categories of information:
(1) Protected Critical Infrastructure Information (PCII) as set out in the Critical Infrastructure Information Act of 2002 (Title II, Subtitle B, of the Homeland Security Act, Public Law 107-296, 196 Stat. 2135), as amended, the implementing regulations thereto (Title 6, Code of Federal Regulations, Part 29) as amended, the applicable PCII Procedures Manual, as amended, and any supplementary guidance officially communicated by an authorized official of the Department of Homeland Security (including the PCII Program Manager or his/her designee);

(b) "Information Technology Resources" include, but are not limited to, computer equipment, networking equipment, telecommunications equipment, cabling, network drives, computer drives, network software, computer software, software programs, intranet sites, and internet sites.
(c) Contractor employees working on this contract must complete such forms as may be necessary for security or other reasons, including the conduct of background investigations to determine suitability. Completed forms shall be submitted as directed by the Contracting Officer. Upon the Contracting Officer's request, the Contractor's employees shall be fingerprinted, or subject to other investigations as required. All contractor employees requiring recurring access to Government facilities or access to sensitive information or IT resources are required to have a favorably adjudicated background investigation prior to commencing work on this contract unless this requirement is waived under Departmental procedures.
(d) The Contracting Officer may require the contractor to prohibit individuals from working on the contract if the government deems their initial or continued employment contrary to the public interest for any reason, including, but not limited to, carelessness, insubordination, incompetence, or security concerns.
(e) Work under this contract may involve access to sensitive information. Therefore, the Contractor shall not disclose, orally or in writing, any sensitive information to any person unless authorized in writing by the Contracting Officer. For those contractor employees authorized access to sensitive information, the contractor shall ensure that these persons receive training concerning the protection and disclosure of sensitive information both during and after contract performance.

III.9 52.225-25 PROHIBITION ON ENGAGING IN SANCTIONED ACTIVITIES RELATING TO IRAN--CERTIFICATION
(SEP 2010)
(a) Definition.
“Person”--
(1) Means--
(i) A natural person;
(ii) A corporation, business association, partnership, society, trust, financial institution, insurer, underwriter, guarantor, and any other business organization, any other nongovernmental entity, organization, or group, and any governmental entity operating as a business enterprise; and
(iii) Any successor to any entity described in paragraph (1)(ii) of this definition; and
(2) Does not include a government or governmental entity that is not operating as a business enterprise.
(b) Certification. Except as provided in paragraph (c) of this provision or if a waiver has been granted in accordance with FAR 25.703-2(d), by submission of its offer, the offeror certifies that the offeror, or any person owned or controlled by the offeror, does not engage in any activities for which sanctions may be imposed under section 5 of the Iran Sanctions Act of 1996. These sanctioned activities are in the areas of development of the petroleum resources of Iran, production of refined petroleum products in Iran, sale and provision of refined petroleum products to Iran, and contributing to Iran's ability to acquire or develop certain weapons.

III.10 EVALUATION CRITERIA (JUN 2007)
Major categories considered in the evaluation of proposals are as follows:
PAST PERFORMANCE
This factor will be rated on an adjectival basis as follows:
GOOD = Offer’s performance fully exceed many of the contract requirements. Offeror’s performance has resulted in a high level of efficiency and productivity and quality. Very little risk anticipated with performance or lack of customer satisfaction.
ACCEPTABLE = Offer’s performance met customer expectations or contract requirements. Some potential risk and lack of customer satisfaction anticipated based upon the offeror’s past performance.
MARGINAL = Offeror’s performance was less than satisfactory and could have stood improvement. Significant potential risk and degradation of performance anticipated based upon the offer’s past performance.
NEUTRAL = No relevant past performance available for evaluation. Proposal receives no merit or demerit for this factor.
COST/PRICE
The cost/price proposal will be evaluated for magnitude and realism. A point score rating will not be used. A risk analysis will be conducted.
Each proposal will be evaluated in accordance with the technical evaluation factors/subfactors stated below to determine if the proposal is acceptable. Full and impartial consideration will be given to all offers received pursuant to this solicitation, and the evaluation will be conducted in an equal manner.
Past Performance Risk will also be assessed.
Evaluation of the "Past Performance" portion of the proposal will be based on the following 2 items:
1. Provide up to three references for like or similar work done for federal government agencies, to include work completed for/with the Border Patrol. Contractors shall use and complete the attached Past Performance Evaluation sheet for this requirement. A maximum of Three (3) complete evaluation forms are required to be submitted along with the proposal. These references may be contacted by the Government for further information. Two of the three references may be for work done as a subcontractor rather than as the prime contractor.
2. Demonstrate corporate past performance in a contract of similar size and complexity to that contained in the Statement of Work, including specific corporate past performance with an office similar to the Office of Border Patrol . Please include a brief synopsis of all like or similar work that the company has done for the federal government. This synopsis will be used to assess the capability in doing the work specified in the SOW.
A separate evaluation team has been established to evaluate the cost or price proposal. The evaluation will be conducted as detailed in the provision entitled "COST OR PRICE EVALUATION" contained in this solicitation.

III.11 COST OR PRICE EVALUATION (MAR 2003)
Separately and apart from the technical evaluation, the Government will conduct a cost and/or price evaluation of the offeror's cost/price proposal. A price analysis will be conducted to determine if proposed prices accurately and adequately reflect the work to be performed. A cost analysis may be conducted to determine cost reasonableness and/or cost realism.
A cost realism evaluation will be performed for all cost reimbursement contract awards. (See FAR 15.305). Cost realism will be a significant factor in the award decision. In evaluation of an offeror's proposed cost, the Government's concern is to determine what the Government should realistically pay for the effort, the prospective contractor's understanding of the proposed contract objective, and the offeror's ability to organize and perform the proposed contract. The primary consideration will be which offeror can perform the contract in the manner most advantageous to the Government as determined by evaluation of the proposal in accordance with the established evaluation criteria.
As part of proposal evaluation, and in order to minimize potential or built-in cost growth, the Government intends to evaluate the realism of the offeror's proposed costs in terms of its proposed approach to determine the probable cost of performance. To assist the Government in evaluating this area, offerors are requested to furnish a brief but comprehensive statement concerning the estimating procedures used in preparing the offer and to specifically include a description of the offeror's established estimating procedures.
The realistic cost may differ from the proposed cost and should reflect the Government's best estimate of the cost of any contract that is most likely to result from the offeror's proposal. The realistic cost shall be used for purposes of evaluation to determine the best value. The realistic cost is determined by adjusting each offeror's proposed cost, and fee when appropriate, to reflect any additions or reductions in cost elements to realistic levels based on the results of the cost realism analysis (See FAR 15.404-1(d)).

SCOPE OF WORK
1. Work to be done: The task chart, attached and made a part of this contract, lists the tasks and frequencies of work to be performed by the Contractor under this contract. Square footage of finished building area is estimated at 3,420 square feet, unfinished garage area is estimated at 4,080 square feet.
The detailed specifications hereinafter set forth are also part of the contract, and prescribe the manner and method of procedure to accomplish the work, including additional work to be performed not covered in the Task Chart.
2. Supervision: The contractor will perform a minimum of 50% of the work with his own work force, and will be available at the site within 24 hours of notice of unsatisfactory performance. Contractor shall be on site to review the work requirements with the Officer in Charge prior to initial commencement of the contract. Such meetings will be at a mutually agreed upon time arranged with the Officer in Charge. At the intervals not to exceed 3 months, work under this contract will be reviewed on site with the Officer in Charge.
Failure to comply with these requirements will result in termination for default.
3. General Instructions:
a. The contractor shall comply with the following general requirements:
1. Perform all work in areas as free of obstructions as possible.
2. Move readily movable furniture and equipment from the area while cleaning his job in a satisfactory manner.
3. Furnish each employee with necessary tools, equipment, and supplies to complete his job in a satisfactory manner.
4. Ensure that the sequence of tasks is such that completed work is not soiled or blemished by subsequent tasks.
5. Ensure that upon completion of work, all tools, equipment, and supplies are returned to the designated storage place.
6. Ensure that before leaving an area, all doors and windows are closed and lights are turned off, unless otherwise instructed.
4. Floors:

a. Dust mopping/sweeping: Floors shall be dust mopped so that no dust streaks are left and no dust remains where picked up with the dustpan.
Foreign matter such as gum, candy, and caked mud shall be removed. No dirt or dust shall be left in corners, under furniture, behind doors, or on stairs. Dust mopping shall be done with dust mops, cotton sweeping mops, or vacuum cleaners in such a manner that a minimum of dust is raised. Counter brushes will be used to clean under radiator and unit heaters, or space not accessible to dust mops. Straw or fiber push brooms shall be used on porches, platforms, steps, and concrete floor sally port.
Baseboards, doors, furniture, and equipment shall not be disfigured by brush or mop in the process of moving furniture and equipment. Two garages will be swept once a quarter.
b. Damp mopping: Before mopping, floor shall be swept clean. Floors shall be damp mopped as scheduled with string-type mop to remove dirt and stains. Neutral soap solutions shall be used. Use the least amount of soap to perform the work satisfactorily. Floors shall be rinsed clean so as to remove soap residues and prevent dingy or cloudy appearances. When buckets are used, wet the floor where the bucket will stand to prevent rings. Floors shall be thoroughly dried after mopping. Standing water shall not be permitted at any time. Mop water splashed on baseboards, walls, doors, furniture, or equipment shall be removed immediately.
Workers shall be cautioned not to allow water to seep under baseboards, nor permit it to drip over ends of treads. Surface shall be wiped dry immediately if any dripping occurs. Upon completion of the work, strings left by mop shall be picked up.
c. Spot mopping: Spot mopping shall include the removal of soils or stains caused by spillage on small areas of floors. Spot mopping shall be performed in the same manner as described for damp mopping, and shall be accomplished as required between scheduled damp mopping frequencies as shown on the Task Chart.
d. Scrubbing: Scrubbing with neutral soap solution shall be resorted to only when floors cannot be cleaned by mopping. Scouring powder shall be used only on very dirty quarry tile, concrete, ceramic tile, or terrazzo floors. Water or scrubbing solution shall not be permitted to stand on floors longer than necessary to complete the cleaning job. Dirty water shall then be picked up and floors rinsed until clean and free of soap and then dried with a clean mop.
e. Waxing: Best quality brand name water emulsion liquid or paste type wax approved by the Immigration Service representative shall be used on asphalt tile, linoleum, and other resilient composition floor coverings.
