JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

The AFPEO Business Enterprise Systems, Human Resources Systems Division contracting organization (AFLCMC/HIBK), located at 1960 1st Street West, Bldg. 977, JBSA - Randolph, Texas 78150-4700 supports the Human Resources Systems Division Program Management Office (PMO) to fulfill the AF/A1 operational requirements. The Human Resources Systems Division provides IT support for the military Human Resource (HR) systems and certain civilian HR applications operating at all Air Force Bases (AFBs), Major Commands (MAJCOMs), and Headquarters Air Force (HAF). The Contracting Officer is Mr. David Bailey, COM: 210-565-1272, DSN: 565-1272.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This will be a new Firm Fixed Price contract action with an estimated value of $511,761.06. The action will be a new follow-on contract to the current contract with a base period of five (5) months after award and three (3) one-month options. The CLIN structure will consist of four CLINs for the monthly recurring EONet subscription.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

The subject effort is a five month contract, with three 1-month options, for a web-based application that allows data-entry, data-management, and data-retrieval to support Air Force Equal Opportunity Operations, Major Command (MAJCOM) EO Strategic Advisors, HQ USAF/A1Q (Air Staff), AFPC/EO (EO Operations), AF Reserve, and Air National Guard EO programs. The EO community is comprised of 1,500 accounts at 400+ locations across the globe to implement the following policies, Air Force (AF) and Department of Defense (DoD) EO provisions: AFI 36-2707 Military Equal Opportunity (MEO), AF Policy Directive 36-27 MEO Program, and DoD Directive 1350.2 DoD MEO Program. EO requirements are currently being met through Human Resource Technologies, Inc. (HRTec), who has provided the Air Force subscription to EEOnet since 2005. The HRTec subscription delivers “software as a service” in which software is licensed on a subscription basis and is centrally hosted. The new AF EONet product contract was awarded to Intelligent Decisions, Inc. on 18 August 2015 which included a 5 month base and 3 monthly options to operationally transition the program.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

FAR 6.301(a) requires the contracting officer to provide for full and open competition unless a statutory exception applies. The specific exception that precludes the fair opportunity process for this acquisition is FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

FAR 6.302-1 “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

Air Force EO requirements are currently being met by Human Resources Technologies, Inc. (HRTec), whose current contract expires 31 August 2015. The AF EONet program is not expected to operational until March of 2016, which would leave an unacceptable gap in service. A gap in coverage between the old contract and the new contract would mean historical case files would be lost and new cases could not be filed leading to delays in investigations and reporting of sensitive information. At this time, HRTec is the only company that can prevent a gap in services, as the new product (Air Force EONet) is brought on line. The modification will be structured as a base period with options to ensure the service is only used as long as it is needed.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICAL

HRTec is the only vendor that can continue fulfilling the current EO requirements prior to the transition to the iComplaints/Entellitrak software. A new contract has been competitively awarded through NETCENTS-2 Products to Intelligent Decisions, Inc.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer will determine price reasonableness by comparison against the independent government cost estimates as well as historical pricing on the current effort adjusted for reduced scope.

VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED

Market research was not conducted for this effort because market research has already been conducted for the iComplaints/Entellitrak acquisition. The HRTec bridge contract is solely for the purpose of ensuring there is no gap in coverage for Air Force EO requirements while the new software is brought on line.

IX. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

This modification will consist of a five-month base and three (3) one-month options. This contract structure allows for 3 months of margin to support the transition to the new product. If the product transition is ready, the options will not be exercised and the new contract will be used to provide the Air Force EO requirements.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

No other sources have expressed interest in the acquisition.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

All subsequent acquisitions will be awarded using the NETCENTS-2 contracts, per the mandatory use SAF/CIO memorandum dated 15 September 2014

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the signature page evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the signature page, the technical and/or requirements personnel have certified that any supporting data contained herein which is their responsibility is both accurate and complete.
