In accordance with FAR 8.405-6, the ordering activity contracting officer shall document the circumstances when restricting consideration under FAR 8.405-6(b) “Limited Sources Justification and Approval”.
1. [FAR 8.405-6(a)] Orders placed or BPAs established under Federal Supply Schedules are exempt from the requirements in Part 6. However, an ordering activity must justify its action when restricting consideration in accordance with paragraphs (a) or (b)-
Of schedule contractors to fewer than required in FAR 8.405-1 or FAR 8.405- 2; or
[FAR 8.405-6(b)] To an item peculiar to one manufacturer (e.g., a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on or more schedule contracts, is an item peculiar to one manufacturer. Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet the agency’s need.
JUSTIFICATION:
Below provides further justification of OUSD(P)’s need for the Microsoft Surface Pro 4 Tablet System brand based on this product’s unique capabilities:
Microsoft Surface Pro 4 Tablet Systems and specified accessories are currently an installed base of tablets systems in the Enterprise that Joint Service Provider (JSP) supports. The additional MS Surface Pro’s and accessories will be added into JSP’s inventory and configured using their current configuration for these devices. Purchasing a different tablet and accessory would require a new configuration to be tested and installed which would add to the cost of a new device. These devices operate on NIPRnet to assist in continuity and crisis management tasks within OSD which are on the JSP approved hardware list.
OUSD(P) is adding additional systems onto their existing installed base and infrastructure. Purchasing any other brand would cost the government a substantial amount of money to replace the established base.
2. Circumstances that may justify restriction cited in paragraph (a)(1) of this subsection include-
Only one source is capable of responding due to the unique or specialized nature of the work;
The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under a sole source or limited source procedures;
An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays.
3. Description of Market Research:
How many businesses provide this equipment?

- En-Net Services
