JUSTIFICATION FOR SINGLE SOURCE ACQUISITION
1. Contracting Activity.
The Naval Sea Systems Command (NAVSEA), Norfolk Naval Shipyard (NNSY), Code 400 Contracts Department (C400), Portsmouth, VA.
2. Description of the Action Being Approved.
Award of a single source contract to Curtiss-Wright (CW) to perform efforts to assess, repair and test four (4) Sauer 5000 High Pressure Air Compressors (HPACs) The components to be worked are HPAC #1, HPAC #2, HPAC #3 and HPAC #4.
3. Description of Supplies/Services.
NNSY requires the Technical Representative Services necessary to provide an assessment, repair and test four (4) Sauer 5000 High Pressure Air Compressors (HPACs) during the CVN 77 FY24 Periodic Incremental Availability (PIA). The components to be worked are HPAC #1, HPAC #2, HPAC #3 and HPAC #4.The estimated period of performance for this requirement is July 05, 2023 to April 20, 2024. Type of contract FFP and funding will be from FY2023.
This Independent Government Estimate (IGE) is based on a Class “F” (+/- 40%) Engineering/Planning Dept. Cost Estimate derived from current Uniform Methods and Standards 5510-971 for the CVN-77 77E project and contract N42158-21-P-0085-P00002.
The total costs for Assessment and Overhaul Service on all four HPAC Units are calculated from the period of performance listed in JML 3095C260.
Total Cost for all Assessments, Repair and Overhauls Services with material on all four (4 ea.) HPACs: .
The estimated period of performance for this requirement is July 05, 2023 to April 20, 2024.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition. _
41 U.S.C 1901 as implemented by Federal Acquisition Regulation (FAR) Subpart 13.5 - Simplified Procedures for Certain Commercial Products and Commercial Services.
5. Rationale Justifying Use of Cited Statutory Authority.
Rationale for using cited authority is unusual and compelling urgency. There are little-to-no readily-available material(s) within the NNSY stock system, which puts a great strain on NNSY’s ability to effectively meet the Shipyard’s ever-changing ship repair and modernization efforts. Additionally, further delay will jeopardize NNSY’s ability to maintain its fleet readiness. As such, Curtiss-Wright (CW) is the only known source that is reasonably available for providing the required services on the HPACs and that can also meet the government’s technical scheduling.
Furthermore, the Contract Specialist submitted a letter from Kelly Halda, Contracts Manager for CW, stating that CW is the only authorized service provider for HPAC model AA+ and 13NL45 high pressure air compressor product lines and the ship service air compressors for the military and marine industry. CW meets all the requirements of the NAVSEA standard item 009-90.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The Contract Specialist (CS) used several sources of information including a review of previous procurements for the same/similar services, discussions with the requiring activity, and a review of SBA DSBS. The CS reached out to one small businesses inquiring if they can execute the following requirement. The CS reached out to North Shore Compressor & Machine Inc., and the POC, Chris Tolliver, advised that they are unable to accomplish the goal requested in the Statement of Work (SOW). The CS also used Sam.Gov to locate previously awarded contracts. The past contracts located were N4215823PS028, N4215822P0060, N4215822PS178, and N4215822PS091. Additionally, the CS reviewed the recent market research related to N4215821P0085. All of the recent procurements for related requirements were sole sourced to CW.
For these reasons, additional market research beyond what was conducted is not considered to be practical and is not expected to yield any additional information.
The Contracting Officer, as required by FAR 5.201, will post a synopsis to the Government Point of Entry (GPE) – SAM.gov (SAM), detailing the intended acquisition strategy.
7. Determination of Fair and Reasonable Cost.
The contracting officer has determined that the anticipated cost to the Government for the supplies/services covered by this justification will be fair and reasonable. The contracting officer intends to determine the proposed price as fair and reasonable by utilizing the techniques detailed within FAR 13.106-3.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NNSY has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NNSY will assess whether competition for future requirements is feasible.
