1. Contracting Agency: Department of Defense Education Activity (DoDEA) Headquarters, 4800 Mark Center Drive, Alexandria, VA 22314.

2. Description of Action: DoDEA HQ plans to award a firm-fixed price contract for VMAX Maintenance Support through the use of full and open procedures with a brand name justification in accordance with FAR 13.501(a).

3. Description of Supplies/Services: This procurement is for one year (12 months) of EMC’s VMAX Maintenance Support. VMAX systems are currently being utilized at the DoDEA Data Center in Peachtree City, GA and provide core federated tiered data storage maintenance support for all critical systems. The VMAX Maintenance Support is necessary in order to maintain continuity of storage support through proactive maintenance and remote monitoring. The estimated dollar value of this procurement is .

4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full an open competition is 41 U.S.C § 1903, as implemented by Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii).

5. Reason for Authority Cited: The authority for this action is FAR 13.501(a)(1)(ii)- Only one source reasonably available – brand name. In this situation, only VMAX maintenance support is compatible with the VMAX system currently be utilized. The maintenance support is for the VMAX systems at the DoDEA Data Center in Peachtree City, GA which provide storage for all of the Center’s critical systems. Due to the proprietary hardware and software of the storage systems, VMAX Maintenance Support is required to ensure compatibility, continuity of operations, as well as ensure maximum up time for the core data storage systems. DoDEA’s Data Center operates 24/7/365 providing education and business services to 85,000 users in over 170 schools and offices globally. The VMAX Maintenance Support also provides proactive monitoring and support to identify potential problems with the ability to affect repair prior to system failures, mitigating maintenance and repair costs.

If VMAX Maintenance Support is not acquired, the Government risks the integrity of the information being stored by the VMAX systems. Additionally, the Government risks incurring substantial maintenance and repair costs that can be avoided and/or mitigated with proactive support and remote monitoring. Due to the critical nature of the information being stored and the user base affected by the VMAX systems, it is not in the best interest of the Government to abstain from acquiring the maintenance support.

6. Efforts made to Ensure Competition: This justification is being prepared in accordance with FAR 6.303-2(b) and will be posted with the solicitation on the Government-wide Point of Entry (GPE), FedBizOps (FBO) as required by FAR 5.102(a)(6). 7. Fair and Reasonable Cost Determination: In accordance with FAR 13.106-3(a)(1) it is anticipated that the prices received in response to the solicitation will be fair and reasonable based on the competitive quotes received.

8. This market research resulted in identifying several large and small business capable of fulfilling the requirement. However, by applying filters to the SBA’s DSBS over twenty (20) 8(a) firms were identified that are capable of fulfilling this requirement. Based on the results of the market research it was determined to set this procurement aside for 8(a) companies on a competitive basis.

9. Other Facts: As a result of the findings stated in paragraph 8, it is determined to be in the best interest of the Government to set-aside this requirement for 8(a) small businesses.

10. List of Sources: SBA’s DSBS, GSA Advantage!/e-Buy, NASA SEWP, GSA Stars II GWAC.

11. Actions to Overcome Barriers to Competition: Due to the proprietary nature of the VMAX systems, the long term effects of purchasing such hardware and software can place the Government in a perpetual sole-source environment for any future maintenance, configuration or expansion of the VMAX systems.

However, during the one year period in which the support is being acquired, DoDEA intends to conduct an assessment of the Data Center’s storage systems. This assessment will ultimately result in an analysis of the system-wide lifecycle of existing systems at the Data Center. Upon conclusion of the assessment and dependent upon the results, DoDEA intends to solicit a competitive solicitation for a storage system that will potentially replace the current VMAX systems.
