ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

1. Addendum to Paragraph (b) Submission of Quotes: In addition to those requirements as stated in paragraph (b), the following are added and shall apply to the submission requirements in response to this solicitation:

1. Quote Structure and Content – Vendors shall submit quote packages consisting of the following separate/distinct volumes for evaluation purposes and include the content identified herein:

1. Volume 1 - Administrative Cover Letter. The cover letter shall include the following:

0. Tax identification number (TIN);

0. Dun & Bradstreet Number (DUNS);

0. Complete Business Mailing Address;

0. Cage Code/NAICS Code; and,

0. Contact Name, Phone, Fax and Email address.

0. Completed DFARS Clause 252.209-7991, Representation By Corporations Regarding An Unpaid Delinquent Tax Liability Or A Felony Conviction Under Any Federal Law Fiscal Year 2016 Appropriations.

1. Volume 2 – Technical Capability. This quote volume shall:

1. Demonstrate the offeror’ s understanding of the requirement and ability to provide the supplies and services outlined in the Statement of Work (SOW).

1. Volume 3 – Price. This quote volume shall:

0. Be in Microsoft Excel. All items must have a price or be marked “NSP” for “Not Separately Priced.” Each item will state the description, quantity, unit, unit price, and estimated amount. A final total of the Base and Option Periods is required in the Excel Spreadsheet.

0. Reference the Contract Line Item Numbers (CLINs) Sub-CLINs in the SF1449 Schedule of services as suggested CLIN structures. In lieu of this schedule, the contractor may submit fewer or more CLINs, whichever may be appropriate to their standard commercial practice.

1. Quote Submission Requirements: Electronic submission by email.

RFQ Questions – Questions in regards to this RFQ shall be submitted in writing via email to Samra Yoseph at samra.yoseph@hq.dodea.edu with the subject line, “Questions, Lego” no later than 10:00 A.M. EST on November 21,, 2016.

Complete Quote Package (Volumes 1 - 3): The closing date for complete quote packages submissions is no later than 10:00 A.M. EST on December 16, 2016 via email to Samra Yoseph at samra.yoseph@hq.dodea.edu.

Note: DoDEA has a maximum email limit of 10MB. Vendors shall confirm receipt of their electronic copy by return email from these the above email addresses.

FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible vendor whose quote conforming to the solicitation is technically acceptable and fair and reasonably priced. The following factors shall be used to evaluate offers:

Factor 1: Technical Capability: Vendor shall demonstrate their understanding of the product and ability to perform the requirement as set forth in the Statement of Work (SOW) as well as the general quality of the proposed products and services.

Factor 2: Price - Price will be evaluated to ensure price fair and reasonableness

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. This evaluation will include an option to extend services for 6 months (as allowed by FAR 52.217-8) to run after the completion of the last annual option period. The Government will extrapolate the vendor’s pricing of the last annual option period to arrive at a price for the potential six (6) month extension of services option. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) If the subject solicitation has been issued as a Request for Quotation, all references to proposal and offeror are hereby changed to quote and vendor respectively, except for in paragraph (c), which stands as written. If a quote is provided, the Government may make an offer based on all or part of a vendor’s quote, as originally presented or as subsequently modified.

52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS—COMMERCIAL ITEMS (DEVIATION 2013-O0019) (SEPT 2016)

(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(b)

(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

(i) 52.203-13, Contractor Code of Business Ethics and Conduct (Apr 2010) (41 U.S.C. 3509).

(ii) 52.219-8, Utilization of Small Business Concerns (Oct 2014) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. If the subcontract (except subcontracts to small business concerns) exceeds $650,000 ($1.5 million for construction of any public facility), the subcontractor must include 52.219-8 in lower tier subcontracts that offer subcontracting opportunities.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 days before contract expiration.

(a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall--

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

Special Education Diagnostic Protocols

1.0 INTRODUCTION

1.1The Department of Defense Education Activity (DoDEA) serves the dependents of military and civilian employees by providing PK-12 instruction to approximately 72,000 students in seven states, eleven foreign countries, Guam, and Puerto Rico. The number of students varies based on the deployment of military troops worldwide. DoDEA’s curriculum, resources, and student achievement scores on standardized assessments compare favorably to high-performing US public schools.
1.2DoDEA is divided into eight districts that administer 167 brick-and-mortar schools. The Americas Southeast and Mid-Atlantic districts has 54 schools in seven states and Puerto Rico, and for administrative purposes, Cuba. Europe’s South, East, and West districts have 65 schools in England, Germany, Italy, Belgium, Netherlands, Spain, Turkey, and Bahrain. The Pacific’s West, East, and South districts have 48 schools in Korea, Japan (mainland and Okinawa), and for administrative purposes, Guam. In addition, DoDEA operates a fully accredited Virtual High School with its main office in Virginia and with teaching hubs in Germany and Okinawa.
2.0BACKGROUND
2.1DoDEA possesses the Woodcock-Johnson IV suite of achievement, cognitive and oral language tests. It was acquired through a sole source contract, HE1254-14-C-0004, which is now expired. It consisted of the items listed in the table below and also the complete Battery Plus (Achievement A, Cognitive, Oral Language) With Case and Achievement Form B (without case).

3.0 SCOPE

3.1DoDEA requires the following consumable items on an annual basis in the quantities shown below. DoDEA expects to award a contract with Operation and Maintenance (O&M) funds for a base year and four option years.

4.0 REQUIREMENTS

4.1 Specifications—The Contractor shall provide Woodcock-Johnson IV test records and response books as listed in SOW 3.1. These materials shall be nationally-recognized standardized oral, cognitive and achievement assessments for students in grades PK-12 that meet the following six requirements:

1. Support special education eligibility decisions as required by DoD and federal special education policies,

2. Are stand-alone measures that do not necessarily need to be supplemented by additional measures to confirm results,

3. Compare cognitive performance and achievement results using the same norm sample to ensure continuity, accuracy, and reliability of test results and decision-making,

4. Are recognized by federal courts in special education Due Process cases,

5. Are recognized by other U.S. education systems to support the highly transient DoDEA student population, and

6. Can be administered by either an educational assessor or a school psychologist, in order to adhere to DoDEA’s special education eligibility processes.

4.2Participate in a post-award video- or teleconference within five business days of the award date.
