SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

AMENDMENT TO SOLICITATION

The purpose of this amendment is to (1) provide clarification of information as a result of questions submitted in accordance with the solicitation provisions and (2) corrections to solicitation HDEC02-09-R-0006; (3) to change the date of closing on the solicitation; and (4) to add FAR 52.247-30, F.O.B. Origin, Contractor’s Facility.

1. Question and Answers

Question: 1. What is the basis for estimated value of the new contract and what is the basis for historical pricing?

Answer: The estimated value of the new contract is based on historical sales from the current contract. Historical pricing is based on the publisher’s price on each magazine minus the discount applicable under the current contract.

The historical sales amounts at Attachments C1 and C2 are based on sales from the current contract. Price is the percentage of savings offered off the publisher’s price to include all discounts. The value of the newly awarded contract is the dollar value of the percentage of savings offered off the publisher’s price. It is calculated using Historical Sales. This percentage may vary between offerors and may vary year to year for the contract.

Question 2. Please clarify the fact that CLIN 0002 AA, AB, AC and AD are listed as FOB Destination and the statement on page 13, paragraph 3 under the listing “Proposal Package” states: “All deliveries associated with CLIN 0002 are coded ‘FOB Variable’ and will allow for second destination transportation charges to commercial bills of lading to pay for overseas support.”

Answer: For commissaries listed in CLIN 2 (OCONUS stores): The CLIN listing as FOB Destination is incorrect. The CLIN 0002, 0002AA, 0002AB, 0002AC and 0002AD should be FOB Contractor’s Facility. The contractor is responsible for costs associated with the transfer of the magazines from the publisher to the contractor’s warehouse, and for packaging the magazines for the specific stores. Refer to FAR 47.303-2 F.o.b. origin, contractor’s facility. The Defense Commissary Agency is responsible for costs of transportation of the magazines from the contractor’s facility to the commissaries listed in the Schedule. See Addendum to FAR 52.212-1, Instructions to Offerors, A.2.a. for additional information.

2. Corrections to Solicitation:

Page 8 ITEM NO 0002AB and 0002AC: FOB Destination is changed to FOB Contractor’s Facility.

Page 9 ITEM NO 0002AD: FOB Destination is changed to FOB Contractor’s Facility.

3. The closing date of the solicitation (see SF 1449, BLOCK 8) is changed from 04:00 PM January 12, 2010, to 04:00 PM January 20, 2010.

4. FAR Clause 52.247-30 f.o.b. Origin, Contractor’s Facility (FEB 2006) is added to the solicitation in full text as follows:

(a) The term “f.o.b. origin, contractor’s facility,” as used in this clause, means free of expense to the Government delivered on board the indicated type of conveyance of the carrier (or of the Government, if specified) at the designated facility, on the named street or highway, in the city, county, and State from which the shipment will be made.

(b) The Contractor shall-

(1)(i) Pack and mark the shipment to comply with contract specifications; or

(ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements to protect the goods and to ensure assessment of the lowest applicable transportation charge.

(2)(i) Order specified carrier equipment when requested by the Government; or

(ii) If not specified, order appropriate carrier equipment not in excess of capacity to accommodate shipment;

(3) Deliver the shipment in good order and condition to the carrier, and load, stow, trip, block, and/or brace carload or truckload shipment (when loaded by the Contractor) on or in the carrier’s conveyance as required by carrier rules and regulations:

(4) Be responsible for any loss of and/or damage to the goods-

(i) Occurring before delivery to the carrier;

(ii) Resulting from improper packing and marking; or

(iii) Resulting from improper loading, stowing, trimming, blocking, and/or bracing of the shipment, if loaded by the Contractor on or in the carrier’s conveyance;

(5) Complete the Government bill of lading supplied by the ordering agency or, when a Government bill of lading is not supplied, prepare a commercial bill of lading or other transportation receipt. The bill of lading shall show-

(i) A description of the shipment in terms of the government freight classification or tariff (or Government rate tender) under which lowest freight rates are applicable;

(ii) The seals affixed to the conveyance with their serial numbers or other identification;

(iii) Lengths and capacities of cars or trucks ordered and furnished;

(iv) Other pertinent information required to effect prompt delivery to the consignee, including name, delivery address, postal address and ZIP code of consignee, routing, etc.:

(v) special instructions or annotations requested by the ordering agency for bills of lading; e.g., “This shipment is the property of, and the freight charges paid to the carrier(s) will be reimbursed by the Government”, and

(vi) The signature of the carrier’s agency and the date the shipment is received by the carrier, and

(6) Distribute the copies of the bill of lading, or other transportation receipts, as directed by the ordering agency.

5. All other terms and conditions contained in the solicitation remain unchanged.
