JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)
Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10.U.S.C. 2304(c)(1).

3. DESCRIPTION OF SUPPLIES/SERVICES: (FAR 6.303-2(b)(3))
This action is to purchase an extension of the warranty coverage for two (2) Network Appliance
(NetApp) FAS3240A clusters made up of four (4) filers and the associated shelves. This warranty coverage is required to support the Global Command and Communication System-Joint
(GCCS-J) Management Center (GMC) Server Enclaves as the NetApp FAS3240A filer clusters are essential to maintain the hardware, system reliability and the keep software up-to-date. The
FAS3240A filer clusters are the core of the Storage Area Network (SAN) used by the GMC to meet the data requirements in support of Operational and Information Assurance functions. The listing below describes each item required:

The expected contract type will utilize FY14 Operations and Maintenance funds. Additionally, three (3) option years are included.
4. IDENTIFICATION OF STATUTORY AUTHORITY: (FAR 6.303-2(b)(4))
The statutory authority for this specific make and model acquisition is 10 U.S.C.2304(c)(1)
(FAR 6.302-1/DFARS 206.302-1) - Only one responsible source and no other supplies or services will satisfy agency requirements. This requirement is to purchase brand name NetApp specific make and model warranty coverage.
5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: (FAR 6.303-
2(b)(5))
NetApp Warranty Renewal is an item peculiar to the manufacturer (e.g., a particular brand name, product, or a feature or a product, peculiar to one manufacturer.) This action is for the purchase of one (1) six-month base period plus three (3) 12-month option periods of NetApps Warranty renewals.
JSSC requires renewal of the NetApp warranty for the current hardware, which has already been approved under the system baseline for the GMC. The JSSC Certification and Accreditation provides security review and NSA acceptance for operations of IT equipment within the GMC
Classified environment. NetApp FAS3240A filer clusters are the only filer clusters that have undergone all security, accreditation, and acquisition requirements necessary for operational employment in the GMC. Introducing a new hardware and/or operating system platform would invalidate the certification and become an unnecessary security risk to the IT infrastructure. The warranty coverage can only be purchased from the manufacturer or an authorized reseller.
NetApp is the proprietor of the existing hardware infrastructure currently in use. NetApp sells this equipment and warranty renewals commercially and has authorized resellers that are approved to sell these products; therefore, this is a brand name acquisition. The NetApps warranty agreement is the only available product that will meet the Government’s need as delineated above.
NetApp warranty renewal meets or exceeds all the security requirements set forth by Defense
Information Systems Agency (DISA) and Department of Defense (DoD) security certification requirements. Standardization on this platform simplifies cross network communications within
DISA and maintenance contracts for DISA.
This warranty coverage is required to support the Global Command and Communication System-
Joint (GCCS-J) Management Center (GMC) Server Enclaves as the NetApp FAS3240A filer clusters are essential to maintain the hardware, system reliability and the keep software up-to-date. The FAS3240A filer clusters are the core of the Storage Area Network (SAN) used by the
GMC to meet the data requirements in support of Operational and Information Assurance functions.
Utilization of another manufacturer’s brand to replace NetApp filer clusters would put the
GCCS-J at risk and possible downtime. If the NetApp warranty is not renewed, the hardware on the GCCS-J will be unsupported. This is unacceptable to current DISA Network security policy as required security patches and system upates would not be available to JSSC to mitigate any discovered vulnerabilities associated with the appliance.
In addition, utilization of another manufacturer’s brand would create substantial duplication of costs, which cannot be recovered through competition. NetApp products are an integral part of several processes such as data storage, data backup, system log storage and archiving, database storage, and virtual machine data file storage.. To use another product at this point in time would be cost prohibitive in manpower, system development, training/knowledge management, and overall impact to current and ongoing system development and integration plans. A reinvestment into a different filer cluster solution that would require technical analysis, planning, software licenses, maintenance, implementation, infrastructure, re-training current expertise and deployment costs which would cost substantially more than this warranty renewal. It is estimated that the Government would incur substantial duplication of cost in the amount of $1,088,291.80.
This cost includes the cost of purchasing new hardware, software, maintenance for both, technical support, and extensive operational, functional, security testing and integration, and training, required for a new system prior to implementation within the GMC baseline. It would take approximately 11 months to implement a similar system from another manufacturer, during which time both systems would have to be supported through dual operations until all monitored assets migrated to the new system.
NetApp brand named appliances and software are essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the Agency’s needs. The selection to continue with this manufacturer was made based primarily on certification and accreditation, compatibility, reliability, interoperability, and cost effectiveness.
6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES: (FAR 6.303-2(b)(6))
The required NetApp warranty renewal is commercial in nature. As such, a combined synopsis/solicitation will be issued to the Government-wide Point-of-Entry, FedBizOpps
(www.fbo.gov), in accordance with FAR Part 12. NetApp’s authorized reseller list was obtained and direct contact was made to vendors during market research phase.

7. DETERMINATION OF FAIR AND REASONABLE COST: (FAR 6.302-2(b)(7)).
The Contracting Officer will determine that the cost to the Government will be fair and reasonable based on the anticipated adequate price competition in accordance with FAR 15.403-
1(c)(1).
8. MARKET RESEARCH: (FAR 6.302-2(b)(8)).
Market research was conducted by the JSSC-J PMO and the contract specialist in August 2013.
The original equipment manufacturer (OEM), NetApp, authorized Federal reseller list was obtained via NetApp website. The Program Management Office (PMO), in preparing their budgetary estimates, contacted three (3) NetApp resellers with GSA contracts. The interested sources identified through market research are as follows.

NetApp only has one primary GSA supplier, Arrow ECS, which is a large business.
Government task orders may be placed with Arrow directly or via small businesses. However, the task order must utilize Arrow’s GSA contract. NetApp employs a similar distribution channel for the NASA SEWP contract. By reviewing budgetary quotations, it is determined that posting under GSA may not provide the best prices, maximum price competition, nor maximum opportunity for small businesses. Some small businesses are not able to utilize Arrow’s contract but are still authorized resellers of NetApp.
Therefore, in order to obtain the best available price and maximize price competition amongst all authorized small business resellers, the proposed procurement method is to post an open market RFQ to authorized NetApp resellers on Federal Business Opportunities using the
Commercial Item Procedures of FAR Part 12.

Procurement History. NetApp Warranty Renewals for JSSC-J have been acquired previously under the following contracts:

Small Business Set-Aside.
This is a warranty renewal contract. The brand name NetApp warranty renewal is available through numerous authorized resellers as delineated in Paragraph 8 above. The NetApp products are required for the GMC SAN and selected by JSSC/Joint C2 Support Division (JC3). The
Government will continue to research the capabilities in the marketplace to determine if similar products from other manufacturers may be utilized to fulfill this firewall requirement in the future.
12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP):
The instant procurement does not meet the threshold for the preparation of an Acquisition Plan.
