JUSTIFICATION FOR OTHER THAN FULL AND

OPEN COMPETITION (OTFAOC)

Federal Acquisition Regulation (FAR) Part 6 Justification & Approval (J&A), Supporting Procurements under FAR Part 12, and FAR Part 15

Purchase Request Number: HC108919CMTBW04 Contract Number: To be determined Procurement Title: TeleGeography Annual Enterprise Licenses Estimated Lifecycle Value:

Statutory Authority: 10 U.S.C. 2304(c)(1)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)

Justification for OTFAOC Number: Not Applicable

Upon the basis of the following justification, I, as the Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C. 2304(c)(1).

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requiring Agency:

Defense Information Systems Agency (DISA)/Infrastructure Executive, Transport Division (IE) 6910 Cooper Avenue Fort Meade, Maryland 20755

Contracting Office:

DISA/Defense Information Technology Contracting Organization/PL8321 2300 East Drive, Building 3600 Scott Air Force Base, Illinois 62225-5406

2. NATURE/DESCRIPTION OF ACTION(S): The nature of this action is to procure brand name TeleGeography annual enterprise licenses in support of DISA IE. The period of performance (PoP) is date of award through one year with four option years, estimated to begin

Fiscal year 2019 defense working capital funds were provided for the base year on . The applicable North American Industrial Classification System code is 541519, Other Computer Related Services, with a sales size standard of A firm-fixed-priced purchase order is anticipated for a base year and four 1-year options in the total estimated lifecycle amount of as detailed below.

3. DESCRIPTION OF SUPPLIES:

a. DISA IE has a requirement to purchase brand name TeleGeography enterprise software licenses to access four proprietary software databases (Wholesale Bandwidth Pricing, Global Bandwidth Research Services, and Local Access Pricing Services, and Ethernet Pricing Service.), which allows the Government to cost effectively manage their circuit leases. The database information required includes: standard commercial prices for leased bandwidth;

international networks, undersea cables, service providers, and wholesale circuit pricing;

international internet networks, service providers, capacity traffic, and internet transit pricing;

enterprise multiprotocol label switching virtual private network, Ethernet, dedicated internet access, and international private line service providers and pricing; International long distance traffic, service providers cost and pricing; retail mobile, broadband, and fixed-line service providers and markets; comprehensive industry pricing information with the availability of world-wide competitive rates; Ethernet pricing service – a database of international Ethernet service prices for large enterprises.

b. In order to meet the above need, DISA IE requires the annual renewal of the

TeleGeography software licenses to access (user name and password) the four proprietary software databases. DISA IE16 found that TeleGeography Research is the only firm that will meet agency needs in providing a complete spectrum of data required by the Government for the management of leases. These proprietary software databases are owned and controlled by Primetrica, Inc., doing business as (DBA) TeleGeography Research. The information from the proprietary databases will be analyzed and used in circuit provisioning procedures to reduce the Government’s megabits per second (Mbps) costs, and using commercial rates on the applicable Mbps and their total costs associated with the Government’s circuit leases at commercial rates is expected to be substantially reduced, as a result. Presently DISA IE manages about 2,500 circuit leases, and estimates that the Government is capable of saving approximately 24% on its commercial circuit leases with the implementation of the information from the TeleGeography Research software databases.

4. IDENTIFICATION OF STATUTORY AUTHORITY: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c)(1). (FAR 6.302-

1/DFARS 206.302-1)

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The OEM, PriMetrica, Inc. DBA TeleGeography Research, does not authorize resellers to provide on-line web access to their software databases which makes them the only entity capable of meeting the Government’s needs.

Description of events and Justification.

(1) Minimum Government requirements. TeleGeography Research is the only firm that will meet agency needs in providing a complete spectrum of data required by the Government for the management of leases. Other solutions will not provide the full spectrum of services bulleted below:

Page 3 of 6 Pages

- Standard commercial prices for leased bandwidth.

- International networks, undersea cables, service providers, and wholesale circuit pricing,

- International internet networks, service providers, capacity traffic and IP transit pricing,

- Enterprise MPLS VPN, Ethernet, dedicated internet access, and international private line service providers and pricing;

- International long distance traffic, service providers cost and pricing;

- Retail mobile, broadband, and fixed-line service providers and markets.

- Comprehensive industry pricing information with the availability of world-wide competitive rates.

- Ethernet Pricing Service - a database of international Ethernet service prices for large enterprises.

(2) Proposed sole source contractor. The sole source for this requirement is the OEM, PriMetrica, Inc. DBA TeleGeography Research. The OEM owns and operates their proprietary databases and they do not authorize any other entity to provide licensing or access to their systems.

(3) Discussion regarding cause of the sole source situation. This is for the renewal of existing licenses that grant access to proprietary databases. The OEM does not authorize resellers to provide on-line web access to their software databases.

(4) Impact. Without the services provided by this proprietary software DISA IE will not be able to streamline the research required for circuit provisioning and commercial lease rate comparison. Without the access to the information in this database, the Government could risk losing any potential savings on its commercial circuit leases.

Currently, TeleGeography is the only identified source to meet agency requirements to allow for benchmarking of DISA's circuit lease costs against the average industry competitive rates.

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES: A notice of intent to sole source this requirement will be published on FedBizOpps, as required by FAR 5.2.

7. DETERMINATION OF FAIR AND REASONABLE COST: To determine fair and reasonable, the provided quote will be compared to the independent Government cost estimate, commercial list price, historical pricing, and an analysis of the average price increase on a national average.

8. MARKET RESEARCH: DISA IE conducted market research, which consisted of searches on the internet and Government Schedules for acceptable products. Market research confirmed TeleGeography is the only identified source to meet agency requirements to allow for benchmarking of DISA’s circuit lease costs against the average industry competitive rates.

Additionally, DISA reviewed the System for Award Management (SAM) site to confirm business size and valid registration, and the SBA Dynamic Small Business Database website, which confirmed the OEM, is a small business and confirms the results from review of the SAM site. A review of existing DISA-wide and DoD multiple award contract vehicles and other

Government-wide Acquisition Contracts included General Services Administration, National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement V, and the Department of Defense Enterprise Software Initiative Blanket Purchase Agreements. Market research confirmed that this is a sole source, open market requirement to PriMetrica, Inc. DBA TeleGeography Research, a small business, and manufacturer of the required proprietary database software.

9. ANY OTHER SUPPORTING FACTS: None.

10. LISTING OF INTERESTED SOURCES: PriMetrica, Inc. DBA TeleGeography Research

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

a. Procurement History.

(1) Contract Number: HC102818P0011

Contractor: PriMetrica, Inc. DBA TeleGeography PoP: November 16, 2017 – November 15, 2018 Competitive Status: Brand name, sole source, open market Total Contract Value: $65,000.00

(2) Contract Number: HC102817P0006

PoP: November 16, 2016 – November 15, 2017

Total Contract Value: $65,000.00

(3) Contract Number: HC102814P0100

PoP: June 4, 2014 through June 3, 2015

Total Contract Value: $52,500.00

b. PriMetrica, Inc., DBA TeleGeography Research is the only provider of the required

TeleGeography annual enterprise software licenses subscriptions for this requirement. If PriMetrica, Inc. elects to surrender their legal ownership, copyright, and/or intellectual property software rights and move toward a complete open source selection, then the DISA IE will further analyze other alternative approaches. Regardless, the Government will continue to search the marketplace yearly to determine if alternative solutions exist that can meet the required needs.

The software product will be continually monitored, updated, and re-assessed as the Government moves forward to remove barriers to competition. Additionally, the Government will continue to conduct market research to determine if there are changes in the marketplace that would enable future competitive actions; i.e., there are similar products in the marketplace that provide the same functionality, or PriMetrica, Inc. releases ownership rights of the product. If similar requirements arise, every effort will be made to compete it to the maximum extent practicable.
