3. Statutory Authority: The following paragraphs, in accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), are provided to support sole source justification for proposed orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold.
4. Description of Action:
Commercial off-the-shelf, brand name software renewal support is required from the original equipment manufacturer (OEM), CA, Inc. (formally Automic Software, Inc.). The NAVSEA MSSD and the Navy shipyards, including NNSY, PSNS, PHNSY, and PNS, require the software support. The CA, Inc.’s software products are web-based information technology (IT) tools used for batch scheduling, and various interfaces between applications and report distribution. The period of performance is January 1, 2019 - December 31, 2019. The total estimated contract value of the procurement is $135,075. This acquisition is to renew software updates and upgrades; support currently provided under purchase order HC102818P0020, which expires December 31, 2018. The applicable North American Industrial Classification System Code is 511210 Software Publishers, with a sales size standard of $38.5 million. Fiscal year 2019 operations and maintenance funding will be used for this procurement under N4215819MP90033, N4523A19MP012V3, N3225319MP14115, and N3904019MP90024.
The information assurance branches use Automic Applications Manager across the four shipyards. It is an enterprise job scheduler that automates applications and balance workloads across platforms. It reduces IT operation expenses by improving application automation. The master and agent software takes the individual components of script-like programs, schedules, printers, and conditions and allows the user to define them as discrete objects. The user can combine the objects in an unlimited number of groupings to handle various needs. The object can be changed, and then rolled-out to every object user.
The Government has invested over $2,700,000 in Automic licenses and software support since 2012. The application was specifically designed to utilize Automic functionality, which includes process automation, batch job scheduling, and other capabilities. There are over 40,000 users of the Automic program, which controls the Material Access Technology and cost software. Without the Automic software support, the naval shipyards would not receive the upgrades, patches, and fixes to the Automic software, which could result in work stoppage and resulting detrimental impacts to the Navy. The NNSY, PSNS, PHNSY and PNS personnel would not have access to the critical software tool required for completing mission tasks.
Procuring an alternative source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. An extensive number of modifications would be required to meet the mission. There would be unacceptable delays in fulfilling the agency’s requirements.
5. Proposed Source: Government market research is detailed in paragraph 6, supporting the brand name requirement.
6. Market Research:
CA, Inc. is the sole provider of the requirement items. Based on current market research performed in October 2019, the Navy determined that only the Automic software support could fully support the Government’s need. Government market research, in October 2018, revealed the required items are not available through Department of Defense Enterprise Services Initiative Blanket Purchase Agreement, General Services Administration Federal Supply Schedule, or National Aeronautics Space and Administration Solutions for Enterprise-Wide Procurement contract vehicles. This open-market procurement will be sole sourced to the OEM, CA, Inc., a large business. The request for quote and Government intent to issue a purchase order to CA, Inc. will be advertised on FedBizOpps.
Based on current market research, dated October 2018, it has been determined that only the aforementioned brand name CA, Inc. Automic software renewal support can fully support the Government’s need. From the conducted market research, it is known that the CA Inc.’s, Automic software support is proprietary, and upgrades and support are only available through CA, Inc. via an open market procurement. No competitor functional replacement products exist in the market at this time to meet the Government’s need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the OEM releases ownership rights of product, or it is economically feasible to procure a new system.
7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this limited sources justification for the proposed contract action pursuant to the authority cited above as the particular product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.
Based on the justification provided by the US Navy, a determination has been made to issue a sole source solicitation for the above-described requirement.
