Limited Sources/Sole Source Rationale

2. Procurement Title: ProjNet Subscription for the DoD JSP and the Washington Headquarters Service (WHS) Facilities Services Directorate (FSD)

3. Statutory Authority:

Federal Acquisition Regulation (FAR) 13.106-1(b)(1): In accordance with (IAW) FAR Part 13.106(b)(1), for purchases not exceeding the simplified acquisition threshold, the contracting officer may solicit from only one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, licensing agreements, brand name or industrial mobilization)..

4. Description of Action:

FSD has a requirement to renew brand-name, proprietary ProjNet subscription to support the development of physical infrastructure through the planning, design, and construction of a capital improvement and renovation project. ProjNet is designed to support the diverse stakeholders in the facility life-cycle processes. This procurement will be awarded as a firm-fixed price open market contract to National Institute of Building Sciences (NIBS), the original equipment manufacturer and only source for their proprietary subscriptions. The period of performance will be the date of award through May 31, 2019 for an estimated amount of . Fiscal Year 2018 funds are provided via Military Interdepartmental Purchase Request HQ064289582.

The North American Industry Classification System for this procurement is 541519, Other Computer Related Services, with a $27.5 million sales size standard.

ProjNet suite includes the following applications:

- ProjNet-DrChecks™ supports the identification and resolution of issues related to design and other documents. Identification of contentious issues and status summaries allow managers to quickly reach resolution while reducing meeting and travel costs.

- ProjNet-BID™ supports the bidder-inquiry process. It simplifies the answering of prospective bidder questions by appropriate contracting office staff. Government technical experts may assist contracting office staff.

- ProjNet-RFI™ simplifies the process by which appropriate contracting office staff answer the questions posed by awarded bidders. Government technical experts may assist contracting office staff.

- ProjNet-Submittal Register™ supports the secure exchange, review, evaluation, and approval of information managed through the construction submittal process.

ProjNet is a standard tool that has been recommended for use by Army, Navy, Air Force, and other DoD facility organizations and projects. Due to widespread use of the software, Government and contractor design and construction stakeholders are familiar with the tool for Engineering and Construction Management (ECM) projects. ProjNet provides a single, streamlined project review mechanism. Currently, all United States Army Corps of Engineers (USACE) led ECM projects are reviewed through ProjNet.

This acquisition will allow ECM to utilize the same process for internal JSP/WHS projects and allow staff to move between USACE led and WHS projects easily. Project reviewers will be able to enter project review comments from a web browser into a database and receive timely on-line design team responses.

The ProjNet software on-line environment is critical to the DoD, JSP, and WHS. The ProjNet Dr. Checks software allows the WHS’s project reviewers and the design teams’ communication process to be streamlined and documented. The software subscription allows for transparency and consistency in tracking review comments and obtaining timely responses. If a reviewer is not satisfied with a designer’s response, then the comment will remain open until resolution is achieved.

Information is captured in a database use throughout the design and construction period, and archived for future reference.

5. Proposed Sole Source Contractor: National Institute of Building Sciences. There are no authorized resellers.

6. Market Research:

Government market research was conducted between May and June 2018. The ProjNet software subscriptions are required to meet Government needs. At this time, there is no reasonable cost alternative. The software products are proprietary products of the large business, National Institute of Building Sciences. There are no authorized resellers for the proprietary software products. The software subscriptions are not available through

Government-wide contract vehicles, including DoD Enterprise Software Initiative Blanket Purchase Agreement, General Services Administration, and NASA Solutions for Enterprise-Wide Procurement. The required software products are only sold to the Government through an open-market order. A small-business set-aside is not applicable to this procurement. The redacted brand name sole source justification will be posted to FedBizOpps with a Notice of Intent to award a sole source contract. Following this posting, the solicitation will be emailed to the National Institute of Building Sciences.

NIBS administers ProjNet subscriptions and provides user support services.

Washington, DC-based NIBS is a not-for-profit, non-governmental organization providing authoritative advice for both the private and public sectors in the use of building science and technology.

7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above, as the particular brand-name product ProjNet is essential to the Government's requirements. Market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.

Based on the justification provided by JSP, a determination has been made to solicit brand name, ProjNet for the above described requirement via a sole source, open market order to NIBS.
