2. Procurement Title: ChemLMS Software Support Renewal

3. Statutory Authority:
The following paragraphs, in accordance with (IAW) Federal Acquisition Regulation (FAR) Part 13.106-1(b)(1)(i), Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
4. Description of Action:
Brand-name, proprietary, ChemLMS software support renewal is required for the Norfolk Naval Shipyard (NNS), Puget Sound Naval Shipyard (PSNS), Pearl Harbor Naval Shipyard (PHNS), and Portsmouth Naval Shipyard (PNS), with coordination through Naval Sea Systems Command (NAVSEA) Management Systems Support Division (MSSD). The period of performance (POP) is April 1, 2018 through March 31, 2019. The North American Industrial Classification Code is 541519 with a sales size standard of $27.5 million.
The NAVSEA Program Management Office – Information Technology (PMO-IT), SEA 04I is the Project Manager for the Laboratory Information Management System (LIMS). Currently LIMS is operating with customized Hewlett-Packard (HP) ChemLMS processes running on a HP-9000 server with UNIX operating system.
Significant customization has been completed to allow a Windows Network Termination or NT operating system Client process, QC Client to operate with LIMS.
As part of Navy Depot Maintenance Systems, the Navy Laboratories must modernize industrial laboratory management capabilities, incorporate state-of-the-art process modeling, and become and remain, fully certifiable and compliant to state and federal governing standards. In order to maintain integrity and functionality of the program, ChemLMS software support renewal is required.
The shipyards have invested approximately $605,250.00 in software and support since Fiscal Year 2012. LIMS is based on the commercial-off-the-shelf, ChemLMS/QCClient software, which was developed by HP. Persistent Systems, Inc.
has been granted rights as the sole provider for support associated with all ChemLMS LIMS and QC Client software, and is responsible for all version releases, patches and technical support. There is no known alternative source able to provide the software support.
5. Proposed Sole Source Contractor:
Persistent Systems, Inc. is the only authorized source for the requirement items.
6. Market Research:
Market research was conducted in January 2018. The research included discussions with industry and Government subject matter experts, which determined only the brand-name ChemLMS software support renewal will meet the Navy’s needs. Market research also reviewed existing Government-wide acquisition contracts. The required software support is not available through a Department of Defense Enterprise Software Initiative Blanket Purchase Agreement, General Services Administration Federal Supply Schedule, or National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement order. The requirement items are only available through an open-market order. A small-business set aside is not applicable to this procurement. Two or more small businesses are not able to provide the proprietary software products. The software is proprietary to and only available from the large business, Persistent Systems, Inc. There are no authorized resellers. The recommendation is to procure this as a sole source order to Persistent Systems, Inc.
Based on current market research, it has been determined that only the aforementioned brand name software support can fully meet the Government’s needs. This requirement is for proprietary software support and no competitor functional replacement products exist in the market at this time to meet the Government's need.
The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system.

7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above as the particular brand-name product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.
Based on the justification provided by NAVSEA MSSD, a determination has been made to issue a sole source solicitation for the above described requirement.
