Limited Sources Rationale – Justification and Approval Subject: N0003916MP00430
In accordance with (IAW) FAR Part 13.106(b)(1), the contracting officer may solicit from only one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, licensing agreements, brand name or industrial mobilization).
Brand-name, proprietary, WorkSoft Certify renewal software is required for Enterprise Business Solutions (EBS) and Enterprise Resource Planning (ERP), Patuxent River, MD. The estimated period of performance (POP) is June 20, 2017 through June 19, 2018. The procurement will renew software support associated with HC102816P0110, which expires after June 19, 2019. The total estimated contract cost is $109,649.00. Fiscal year 2017 Operations and Maintenance, Navy or OMN funds of Military Interdepartmental Purchase Request number N0003916MP00430 are applicable to this procurement. The North American Industry Classification System or NAICS code is 541519 with $27.5 million sales size standard.
The annual software support provides major product and technology releases and critical security patch updates for the software licenses that were purchased in 2011 (9 Certify for SAP, Certify Live Learn and SAP Content, Certify-Quality Center Integration) and in 2012 (7 Certify for SAP, Certify Impact Tier 2, Certify Data -Upgrade to Tier 2, Certify Business Process Procedures, and Certify Silverlight, VB and .NET interface Extension), with support renewed annually. The annual renewal of the WorkSoft Certify software support is required to keep the Navy ERP System accredited and operational.
The WorkSoft Certify test suite, is an implemented automated software test tool of the Navy EBS and ERP, and includes the 9 licenses procured in 2011 and 7 additional licenses procured in 2012 to provide the needed customized automated test scripts. The WorkSoft products integrate with SAP Solution Manager to facilitate automation of test scripts. The software is used by the Navy ERP Unit Test and Quality Assurance Landscapes. The WorkSoft suite of products addresses the following: 1) automating the development of the test script by "reading" the functionality and process strings directly from the system itself; 2) generating tests automatically; 3) populating data to execute the tests from the system automatically; 4) "flagging" test scripts that are impacted by each subsequent change to the system; and 5) updating test scripts automatically with system changes.
This requirement is for the maintenance of existing WorkSoft Certify software. Providing the needed upgrades, maintenance releases, patches, and troubleshooting support requires access to the software source code, which is proprietary to the small-business software publisher, WorkSoft, Inc. The software renewal support is only available from WorkSoft and their authorized reseller(s). If NEBS were unable to purchase the renewal software support for the WorkSoft Suite, NEBS would need to discontinue use of this automated testing tool in support of Navy ERP System Software Code Sustainment efforts. Cost savings currently experienced would be replaced with the expense of the labor-intensive alternatives.
Government market research for this requirement was performed in March 2017 and May 2017.
The Government determined that no other product currently on the market offers the needed capabilities for managing, developing, and executing SAP tests. Several different test software packages would have to be purchased as replacements in order to match the capabilities WorkSoft provides. The required software support is not available through a Department of Defense Enterprise Software Initiative Blanket Purchase Agreement, National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement, or General Services Administration order. The requirement items are only available through an open-market order. A small-business set aside is applicable to this procurement. Two or more small businesses have been identified as potential sources. These potential sources include the proprietary software owner and their authorized reseller, K2 Technology Inc., doing business as Wallace Consulting. These entities are small businesses. The recommendation is to procure the software support through an open-market procurement with 100% small business set-aside.
Based on documentation provided and to the best of my knowledge and belief, a determination is made that this justification is accurate and complete.
