JUSTIFICATION FOR OTHER THAN FULL AND
OPEN COMPETITION (OTFAOC)

Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the statutory authority of 10 U.S.C.§ 2304 (c)(1) and the regulatory authority of FAR Part 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

2. NATURE/DESCRIPTION OF ACTION(S):
(a) The nature of this action is to renew brand name, commercial off-the-shelf (COTS), SiSense software licenses and support for business intelligence support for the Global Electromagnetic Spectrum Information System (GEMSIS) Program of Record. The objective of this contracting effort is to provide continual software support while ensuring DISA customers receive uninterrupted, continuous access to their applications and data.
The requirement will renew the support presently provided under the current contract HC1028-16-P-0132, which expires on June 14, 2017. This procurement will be awarded as a firm fixed priced (FFP) delivery order. This requirement will be solicited utilizing open market procedures to all authorized small business reseller of Si Sense Inc., the original equipment manufacturer (OEM).

4. IDENTIFICATION OF STATUTORY AUTHORITY:
Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c)(1), (FAR 6.302-1/DFARS 206.302-1). The items/services are peculiar to one manufacturer’s brand name. Only the OEM or their authorized resellers can satisfy the requirement. No other contractors or distributor can legally obtain access to the software or make duplicate copies, since it is protected by copyright and/or patent laws.
5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:
(a) Description of events.
JSDR is a project that is part of the Global Electromagnetic Spectrum Information System (GEMSIS) Acquisition Category (ACAT) III program of record. The JSDR is architected to be an integration of COTS components and custom code. SiSense was selected to satisfy JSDR business intelligence functional requirements based on capability, suitability, cost and ease of integration with the other components. SiSense has been integrated into JSDR v2.1, and JSDR v3.0. JSDR v2.1 is going live on SIPRNET June 1, 2017, replacing the JSDR v2.0 that is currently operational.
(b) Justification.
(1) Minimum Government requirements. To procure renewal of the SiSense Software license support currently integrated in the JSDR infrastructure at DISA. JSDR v2.1 is fielding Milcloud, and SiSense provides the business intelligence functionality, a significant portion of the JSDR user query capability. JSDR v2.1 replaces the currently operational JSDR v2.0 capability.
(2) Proposed sole source contractor. The required software support is particular to one manufacturer and uses proprietary software code, and only the SiSense brand name software will satisfy the requirement. No other vendor or distributor can legally obtain access to the software nor can they make duplicate copies, since it is protected by copyright and patent laws. Only the OEM provides the maintenance support.
(3) Discussion regarding cause of the sole source situation. To use another product at this development state would be cost prohibitive in manpower, software development, training/knowledge management, and overall impact to current and ongoing software development and platform integration. In order to ensure continuity of operations, integrity, and sustain security of the current JSDR infrastructure, it is necessary to renew the maintenance to allow for Government users to continue performing queries and analytics of the electromagnetic spectrum data.
(4) Demonstration of unique source. The proposed acquisition is for continued brand name maintenance and support services in order to maintain the existing JSDR business intelligence functionality. Other products would require more complex, time consuming, and more expensive integration. SiSense is the only brand of software that
Page 4 of 7 Pages can interoperate into the current JSDR infrastructure, and only SiSense is authorized to provide the support required for the SiSense licenses.
(5) Procurement discussion. Requiring a new software product would force a new design, integration, testing and fielding effort. This would negate significant investment in developing the JSDR, working with the DoD spectrum operations community (MILDEPs, CCMDs) for training and usage of JSDR analytics, and would result in loss of required functionality. Therefore, no other procurement option is readily available that can be integrated into the current JSDR infrastructure. Prior to selection of SiSense, an Analysis of Alternatives was conducted which considered other like products in use at DISA, in use within the DoD, and in use commercially.
Cost, required functionality, flexibility, ability to operate well with the other architectural components were all trade-off factors. Another Analysis of Alternatives is expected to occur within 5 years to assess other products that could be incorporated within the architecture given and within the constraints of sustainment funding.
Additionally, competition will be a deciding factor in future JSDR follow-on efforts.
(6) Impact. If the SiSense software license maintenance and support is not continued, the GEMSIS program will not be able to operate the SiSense component of the JSDR.
This component provides the ability to view spectrum data on a map, and to perform various analytics to support strategic spectrum analysis of DoD spectrum equities. To integrate another BI product would require an entirely new analysis of alternatives, a new design and development phase, and repeat testing, IA, and integration phases, majorly impacting the GEMSIS Block III schedule and budget
6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES:
A synopsis of this action will be published on the FBO website, as required by the FAR in accordance with Subpart 5.2. A redacted J&A will be posted with the solicitation when posted to
FBO.
7. DETERMINATION OF FAIR AND REASONABLE COST
The Contracting Officer will make a determination that the anticipated cost to the Government is fair and reasonable based on comparison of commercial list pricing, previous history, comparison of the negotiated prices, and a comparison of the Independent Government Cost Estimate. A determination will be made that the contract represents the best value to the Government and results in the lowest overall cost alternative. DITCO has concluded that placing an order through FBO represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs.
8. MARKET RESEARCH:
Based on current market research, dated March 2017, it has been determined that only the aforementioned brand-name product and/or product support, SiSense, can fully support the Governments need. SiSense was selected as a result of an Analysis of Alternatives for candidate

Business Intelligence capabilities. Other COTS capabilities evaluated were: Tableau, IBM Content Analytics, Sharepoint, Pentaho BI, and QlikView. An analysis was performed on weighted factors including cost, user interface, extensibility, information assurance, and compatibility with the JSDR architecture. Sisense was selected based on this analysis. This requirement is for proprietary products and/or product support and no competitor functional replacement products exist in the market at this time to meet the Government's need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. similar products and/or product support become available in the marketplace that provides the same functionality, the OEM releases ownership rights of product, or it is economically feasible to procure a new system. At this time, the required SiSense Business Intelligence and Analytics software license and support is not available through DoD ESI BPA or GSA schedule. The market research identified potential small business open market sources including Analyticx, LLC, Expression Networks, LLC, and Datagain, Inc. offer SiSense software and support. Open market procurement with 100 percent small business set-aside is recommended for this lowest priced technically acceptable requirement.

10. LISTING OF INTERESTED SOURCES:
A synopsis of this action will be published on the FBO website as required per the FAR 5.201.
The synopsis will identify the Government’s minimum mandatory requirements. All appropriate responses to the FBO announcement will be considered by DISA prior to proceeding with an award.
11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

(b) The JSDRv2 is expected to remain in operation until 2027. It has been architected to be able to easily incorporate new technology as capabilities evolve. The GEMSIS program continuously monitors technology developments and works with DISA to leverage advances utilized within other programs and enterprise offerings. Architectural changes that can yield cost savings or performance improvements will be evaluated as part of the ongoing JSDRv2 sustainment activities. Full and open competition is expected in approximately 5 years and competition will be included in the follow-on acquisition strategy.

(c) Actions to remove barriers. At this time, only SiSense software licenses and support would be able to function with the JSDR as architected. The SiSense software licenses and support must be procured through SiSense or their authorized reseller. If SiSense elects to surrender their legal ownership, copyright, and/or intellectual property software right and move toward a complete open-source solution, then DISA will seek open competition. Regardless, the government will continue to search the marketplace and alternative software solutions will continually be researched to determine if they will function with currently used products. If the government determines that SiSense software licenses and support are no longer required or other software meets the government’s needs, then the government will seek full and open competition for the required functionality. If similar requirements arise, every effort will be made to compete it to the maximum extent practicable.
12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP):
In accordance with the exceptions under DISA Acquisition Regulation Supplement 7.103(S- 91)(2)(ii), an AP is not required.
