Memo for Record Justification Subject: N4215817MP70059
The following paragraphs, in accordance with Federal Acquisition Regulation Part 13.106- 1(b)(1)(i), are provided to support brand-name, limited-source justification for proposed orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold.
Brand-name, proprietary, ChemLMS software maintenance renewal is required for the Norfolk Naval Shipyard (NNS), Puget Sound Naval Shipyard (PSNS), Pearl Harbor Naval Shipyard (PHNS), and Portsmouth Naval Shipyard (PNS), with coordination through Naval Sea Systems Command (NAVSEA) Management Systems Support Division or MSSD. The contract cost is estimated at $99,750.00. The period of performance is April 1, 2017 through March 31, 2017. The North American Industrial Classification Code is 541519 with a sales size standard of $27.5 million. ChemLMS support provided under purchase order HC102816P0118 will expire after March 31, 2017. Funds for this requirement will be provided through the following Military Interdepartmental Purchase Request funding documents: N4215817MP70059 (NNS), N4523A17MP00149 (PSNS), N3225317MP14055 (PHNS), and N3904017MP70099 (PNS).
The NAVSEA Program Management Office – Information Technology or PMO-IT has project management responsibility for the Laboratory Information Management System (LIMS), which uses customized Hewlett Packard (HP) ChemLMS processes, on an HP-9000 server, running UNIX, a multi-user, multitasking operating system (OS). Significant customization has been completed to allow a Windows NT Client-process, QC Client to operate with LIMS. As part of Depot Maintenance Systems, Navy Laboratories are required to modernize industrial laboratory management capabilities, with fully-certifiable and state and federal government standards-compliant state-of-the-art process-modeling. The ChemLMS software maintenance support must be procured to maintain integrity and functionality of the program. The shipyards have invested approximately $505,250.00 in software and maintenance support since fiscal year 2012.
LIMS is based on the commercial-off-the-shelf software package ChemLMS/QCClient. It was developed by HP Corporation, with sole rights granted for providing the ChemLMS LIMS and QC Client software support and maintenance provided to Persistent Systems Inc. Based on October 2016 through January 2017 government market research, there is no known alternative source able to provide the software maintenance of this requirement.
Failure to procure the required ChemLMS software support would result in a loss of the Infrastructure capabilities. The Navy Shipyards would not be able to obtain the critical updates, upgrades, fixes, and patches to ensure continuity of the ChemLMS software, and work stoppages would degrade the NAVSEA mission. The renewal software support is not available through Government-wide contract vehicles, including DoD Enterprise Software Initiative Blanket Purchase Agreement, General Services Administration, and NASA Solutions for Enterprise-Wide Procurement. The required ChemLMS software products are sold to the government through an open-market order with the large-business, sole-proprietary provider, Persistent Systems Inc. A small-business set-aside is not applicable to this sole-source procurement.
Based on documentation provided and to the best of my knowledge and belief, a determination is made that this justification is accurate and complete.
