Memo for Record - Justification & Approval Subject: N0003916MP00441
The following paragraphs, in accordance with Federal Acquisition Regulation Part 13.106(b)(1), are provided to support sole source limited source justification for proposed orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold. The contracting officer may solicit from only one source if the contracting officer determines that the circumstances of the contract action deem only once source reasonably available, e.g. urgency, licensing agreements, brand name, or industrial mobilization.
Navy Enterprise Business Solutions (NEBS) requires the renewal of brand-name Worksoft Certify Software Support. The estimated period of performance is date of award through one year, with an estimated start date of June 20, 2016. The total estimated contract cost is $109,549. Fiscal year 2016 funds were provided under Military Interdepartmental Purchase Request (MIPR) N0003916MP00441. The North American Industrial Classification Code is 541519 with a size standard of $27.5 million. This requirement is follow-on to contract number HC1028-15-P-0167, which expires June 19, 2016.
NEBS requires annual software support renewal of the Worksoft Certify test suite – an already acquired and implemented automated software test tool, in support of the Navy Environmental Restoration Program (NERP). NEBS acquired Worksoft software in 2011 (procuring 9 licenses) to satisfy a need for customized automated test scripts.
Worksoft is a product that integrates with SAP Solution Manager to facilitate automation of test scripts. NEBS acquired 7 additional licenses for the NERP Unit Test and Quality Assurance Landscapes in 2012. The annual renewal of the Worksoft Certify software support provides major product and technology releases and critical security patch updates required to keep NERP System accredited and operational.
The Worksoft suite of products addresses the following: 1) automating the development of the test script by "reading" the functionality and process strings directly from the system itself; 2) generating automated tests automatically; 3) populating data to execute the tests from the system automatically; 4) "flagging" test scripts that are impacted by each subsequent change to the system; and 5) updating the test scripts automatically as the system changes.
If NEBS were unable to purchase software support for the Worksoft Suite, NEBS would need to discontinue use of this automated testing tool in support of Navy ERP System Software Code Sustainment efforts. Cost savings currently experienced would end due to the increased expense of the labor-intensive alternative.
Market research for this selection was performed from March 2016 by Danielle Jones and Navy ERP QA personnel. Market Research confirmed no other product currently on the market offers the capabilities of Worksoft for managing, developing, and executing SAP tests. Several different test software packages would have to be purchased as replacements in order to match the capabilities Worksoft provides. Wallace Consulting, a small business is the only authorized reseller This is a brand name acquisition for software license support. As the software publisher, only Worksoft has access to the software source code that is being supported. Product upgrades, maintenance releases, patches, and troubleshooting support require access to the software source code. Without access to the software source code, no other firm can provide the required support. Since this requirement is for the support of existing Worksoft Certify software, Worksoft and its authorized reseller(s) are the only possible sources. No small business was found to provide at least 50 percent of the cost of the contract to be performed by a small business with regards to the required software support.
The software support is being 100% provided by the Original Equipment Manufacturer, Wallace Consulting a small business. As such, any reseller would be considered an ostensible subcontractor to the small business OEM. Therefore it is recommended that this requirement be posted to FedBizOpps for large and small businesses to compete. Therefore, this requirement will be posted to FedBizOpps for both small and large businesses.
Based on documentation provided a determination is made that this justification is accurate and complete to the best of my knowledge and belief.
