Justification – Limited Sources Rationale Subject: TIGER Software Subscription – DJTMZ5D542
In accordance with Federal Acquisition Regulation Part 13.106-1(b)(1)(i), the contracting officer may solicit from only one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available, e.g. urgency, licensing agreements, brand name, or industrial mobilization.
The Defense Information Systems Agency (DISA), Department of Defense (DoD), Joint Interoperability Test Command (JITC) requires the procurement of brand-name, commercial off-the-shelf, sole source, Northrop Grumman Tactical Data Link Integration Exerciser (TIGER) software license subscription, which includes support. The period of performance is a one-year period, which will follow the date of award, and there is an option year (OY) period. The base period is estimated to be September 6, 2015 through September 5, 2016, and the OY period is estimated to be September 6, 2016 through September 5, 2017. The estimated contract, OY and life-cycle costs are $49,169.00, $35,503.00, and $84,672.00, respectively. Fiscal Year 2015 Research Development Test & Evaluation funds have been provided for the procurement under Military Interdepartmental Purchase Request Number DJTMZ5D542. The applicable North American Industrial Classification System Code is 541519– Other Computer Related Services, with a size standard of $27,500,000. The requirement items are outlined below.
Period: Part Number/Software Description Quantity
Base Year: 172-DSL-DL / New TIGER Desktop Software License Subscription 1 OY: 172-DSS-DL / TIGER Desktop Software Subscription Renewal 1
The TIGER Test Tool will be used primarily to conduct Tactical Data Link Testing Joint Interoperability Testing and Coalition Interoperability Testing, used in support of reimbursable Standard’s Conformance Testing of Tactical Data Link government platforms for DoD customers, and used in conjunction with North Atlantic Treaty Organization (NATO) testing.
The TIGER Test Tool software is mission critical to support the reimbursable task for Battlefield Operations Support System (BOSS) Standards Conformance Testing. The BOSS, which was originally developed as a test tool for Tactical Data Link (TDL) testing, has been incorporated into operational units as a Command and Control platform performing real world operations, and as such the TIGER is critical to support the testing needs of the DoD and the BOSS. At this time, the government has determined that no alternative software product will meet agency needs.
Failure to procure the brand-name TIGER software support would jeopardize the software infrastructure and mission of the DISA, DoD, JITC managed Tactical Data Link in the coalition and NATO environments.
The products are not available through DoD Enterprise Software Initiative Blanket Purchase Agreement or ESI BPA and are only available through an open market order. The proprietary TIGER Test Tool software, used by government and commercial customers, is solely manufactured and sold by Northrop Grumman Corporation, a large business. Therefore a firm-fixed-priced open market purchase order is anticipated, and the recommendation is to advertise the requirement on FedBizOpps. The request for quote will also be emailed directly to the Northrop Grumman.
Based on the justification provided, a determination has been made that this justification is accurate and complete to the best of my knowledge and belief.
