JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)

Justification for OTFAOC Number: N/A

Upon the basis of the following justification, I, as the Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of FAR Subpart 6.302-(1) as the authority for the sole source action, 10 U.S.C.

2304(c)(1) as the statutory authority.

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

2. NATURE/DESCRIPTION OF ACTION(S): This is a follow-on contract to provide Comcast cable services at the DISA Headquarters Facility, Ft Meade, MD. This will be a firm fixed price contract using FY16 O&M funding.

3. DESCRIPTION OF SUPPLIES/SERVICES: DISA/IML23 has a requirement to provide Cable Television (TV) service and support (500 units) at DISA Headquarters, Ft Meade, MD.

The period of performance is October 01, 2015 through September 30, 2016 with 4 one-year options.

The total estimated lifecycle of $416,505.00.

Base Period- $83,301.00 Option Periods 1-4($333,204.00)

4. IDENTIFICATION OF STATUTORY AUTHORITY:

(a) Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c)(1). (FAR 6.302-1/DFARS 206.302-1)

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: Comcast is the only vendor who can use the existing cable equipment communications devices that are currently installed in the building for land line cable service.

(a) Description of events. Two other small businesses were contacted but were not able to perform the work do to the fact they would have to put antennas on the roof of DISA which is not allowed because installing antennas on the roof would require altering the structure of the building which would result in a construction contract. In addition, installing an antenna on the roof would interfere with the signaling of other federal agencies in the area.

(b) Justification.

(1) Minimum Government requirements. When the DISA Headquarters building was constructed in 2011, Comcast was able to install the necessary equipment for DISA to receive cable TV service in a manner that was compatible with DISA’s building requirements. The roof was not designed to support other provider’s antennas. In order to support other providers equipment on the roof of the building, the structure would have to be modified, which would require a contracting change order, which would be very costly and timely. Comcast can continue to provide the Cable TV service without the installation of any additional equipment/antennas.

(2) Proposed sole source contractor. Comcast of Maryland, LLC can continue to provide the requested cable TV service and channels without the installation of any additional equipment/antennas. Comcast has been the provider of this service for the last 5 years, at DISA Headquarters under contract HC1047-11-P-4047. If any other cable providers were considered, the Government would be paying for the cost of a construction change order to alter the roof of the building in order to accommodate the new antennas.

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES: IAW FAR 5.201 a pre-solicitation notice regarding this sole source requirement will be posted to FedBizOpps. Upon the closure of the synopsis, there were no responses received.

7. DETERMINATION OF FAIR AND REASONABLE COST: The contracting officer will use price analysis to determine whether the price is fair and reasonable.

8. MARKET RESEARCH: Upon the DISA Headquarters building construction in 2011, DISA technical representatives conducted market research by contacting server local cable TV vendors (Comcast, DISH, and Direct TV) to determine which companies could install cable and support equipment in/on the building in a manner in which would not cause any alterations to the

Page 3 of 3 Pages facilities. It was determined that Comcast of Maryland was the only vendor that could install the cable and/or support equipment without altering the structure of the building or placing equipment on the roof of the facilities.

9. ANY OTHER SUPPORTING FACTS: N/A

10. LISTING OF INTERESTED SOURCES: As stated in Para. 6 above, a synopsis will be published prior to issuance of solicitation or contract award.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

(a) Procurement History. This is a follow on contract to HC1047-11-P-4047 that was awarded by DISA/NCR in 2011. This was awarded sole source to Comcast, a large business.

(b) The Mission Partner conducted market research and confirmed that no other cable service companies can provide the service without installing an antenna on the roof which is restricted by DISA due to the interference it could cause to other Federal Agencies in the surrounding areas.

12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP): A written Acquisition Plan (AP) is not required.
