(h) The HAIBP program was established to replace cmTent capabilities provided by the legacy Helium 3 (3He) backpack detection systems. The cunently deployed Human Portable Radiation Detection System (HPRDS) Backpack Systems rely upon 3He technology to detect neutron radiation. Due to national 3He sho1tages CWMD is exploring alternative technologies to replace the legacy systems.

3. Description of Supplies/Services.

The requirement is to procure additional F900 FinderWear HAIBP systems. The HAIBP provides a non-Helium-3 solution and expands the capability of the wearable wide-area search system by including radionuclide identification and data transfer. Combining these capabilities into a single solution sho1tens the amount of time required for alaim adjudication and potentially reduces the number of detection systems required in the field. HAIBP is the next-generation technology that will perfo1m the mission of the detection backpacks and provide identification capability to replace the legacy backpacks for the Transpo1tation Security Administration (TSA) and the Mobile Detection Deployment Program (MDDP).

Target's F900 FinderWear HAIBP is the only system that can meet the specific needs of

CWMD.

4. Identification of Statutory Authority Permitting Other Than Full and Open

Competition.

The statuto1y authority pe1mitting other than full and open competition is 41 U.S.C.3304(a)(l) implemented by the FAR Subpait 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."

5. Identification of Exception to the Buy American Statute

6. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

An announcement was made in FedBizOpps in August 2017 for this competition.

8. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.

The contracting officer determines that the anticipated prices will be fair and reasonable based on the techniques in FAR 15.403-1(c)(1). The contract prices were obtained competitively and determined to be fair and reasonable based upon adequate price competition. Due to the increased total quantity, the Government is receiving a discount of approximately 6% on the unit pricing for 173 systems. Procuring these systems under this contract will result in the overall lowest cost alternative.

9. Description of Market Research.

(a) A market research study was performed by Oak Ridge National Laboratory (ORNL). The goal of the market survey was to produce a list of commercially available backpack systems that use neutron radiation detectors based on alternative methods to the Helium-3 detection technology. 16 manufacturers were identified by ORNL. An RFI was posted in August 2017 with the HAIBP draft requirements. Eight (8) manufacturers responded to the RFI. An Industry Day was held in September 2017 to provide the contractors an opportunity to ask questions and provide feedback prior to the release of a solicitation. 12 manufacturers attended the industry day. Market research was not used to determine price reasonableness. Price reasonableness was determined through price competition.

(b) The market research showed there were manufacturers potentially capable of satisfying

HAIBP program requirements with commercial systems in the market. However, even though the identified manufacturers’ technologies showed great potential, none of the solutions currently available on the market were fully capable of meeting the program key performance parameters (KPPs) without some additional modifications. The RFI responses indicated that a variety of different technological approaches were being proposed by the manufactures, thus greatly increasing the probability of achieving success with HAIBP compliant systems. The market research led CWMD to pursue a modified commercial item to meet the HAIBP needs. Since the HAIBP contracts were awarded in August 2018, ongoing market research conducted by CWMD at The Medical CBRN Defense Consortium and the Countering Weapons of Mass Destruction Consortium, confirms that no additional backpacks are available on the market that will meet the government requirements.

10. Any Other Facts Supporting the Use of Other Than Full and Open Competition.

The subject contract includes an option for the purchase of up to 48 additional units under FAR 52.217-6 Option for Increased Quantity. However, the option was not evaluated at the
