CPM Scheduling (Development, Review, and Analysis)
No one knows Critical Path Method scheduling like we do.
For decades, TRAUNER has advocated the use of CPM schedules, teaching contractors, owners, and A/E firms how to develop and use these schedules effectively. Our firm has written dozens of CPM scheduling specifications for public agencies and private owners across the country.
TRAUNER even drafted the model CPM scheduling specification for Oracle’s Primavera P6 software.
TRAUNER also reviews and analyzes CPM schedules for owners, construction managers, and contractors on many large and complex projects constructed throughout the country. We also help contractors prepare accurate CPM schedules for their projects. Because TRAUNER also provides delay analysis services as part of our claims analysis work, we understand the significance and consequences of CPM scheduling better than most.
Our knowledge of CPM scheduling and project controls brings great value to our clients. GMP Contract Audits
• What’s covered by the guaranteed maximum price, and what’s not?
• Do these costs fall within the scope of that
“exception” or “clarification”?
• What is the “baseline scope” against which changes are measured?
• Are those costs properly charged to general conditions, or should they be part of the reimbursable cost of the work?
• What savings flow into the contingency, and what costs are properly reimbursed out the contingency?
• If the CM/GC self-performed work on a lump sum basis, were self-performance costs properly segregated from general conditions costs?
• Were staff costs to be paid on a cost-reimbursable basis or at agreed-upon rates?

During our critiques, we evaluated the submissions provided by the contractor and subcontractor to support the delay-related and inefficiency damages they were claiming.
Many of the issues that were evaluated on this project involved work performed previously under separate contracts, changes to accommodate new medical equipment, and alleged delays and government interference.
The primary challenges involved understanding how work performed under separate contracts may have affected the work of the contractor and subcontractors. It was difficult to reconcile the time extensions and associated costs previously executed in change orders, as a result of inaccurate analysis results. Lastly, it was difficult to implement a delay analysis procedure, consistent with
New VA Medical Center, Orlando, FL the VA guidelines, due to the negotiation of the changes that occurred during the project.
We toured the site and worked closely with the VA’s project site and Central Office staff to coordinate our analysis efforts. We also met with and discussed the analysis prepared by the VA with regard to delays on the project. We reviewed the schedule information provided by the contractor as part of the claim submissions. We also offered significant criticisms of the method used by the contractor when evaluating its delays.
In preparation for trial for Claim Nos.
1, 2, and 3, TRAUNER reviewed the analysis performed by the VA team.
We completed our own, independent analysis of delay and submitted an expert report prior to trial. The expert report provided for an evaluation of the project delays and additional costs requested by the contractor and its subcontractors.
We also assisted the VA with the negotiation of Claim Nos. 1 through 5.
The dispute was resolved without the need for expensive and prolonged litigation. The VA provided positive feedback on TRAUNER’s work in its Contractor Performance Assessment Report. When providing its assessment, the VA stated that TRAUNER “Demonstrated expertise in the field of claims resolution with respect to delays, inefficiencies, acceleration, etc. Knowledgeable and highly-responsive to customer needs.” In addition, the VA stated, “Given what I know today about the contractor’s ability to perform in accordance with this contract or order’s most significant requirements, I would recommend them for similar requirements in the future.”
The case was settled successfully through negotiation.
TRAUNER was the claims consultant responsible for the evaluation of the $130M in claims that were submitted by the contractors and subcontractors on the Bid Package #4 portion of the multi-phase, $675M, New VA Medical Center and campus in Orlando, FL.
We completed a critique of the contractor’s and subcontractors’ five claim submissions for completeness and compliance with the contract. We then prepared written reports, critiquing the claim submissions for time extensions, delay damages, inefficiencies, and acceleration.
We prepared draft letters to serve as a basis for the Contracting Officer’s Final Decision with regard to Claim Nos. 1 through 5. We also met with the VA on many occasions to discuss the results of our reviews and analyses and strategize with regard to the VA’s approach to resolving the dispute.

The final TRAUNER report contained an analysis of the contractor’s damages. Each line item of the $7M claim was reviewed and critiqued. We also incorporated the results of the VA’s audit of the claim. The final report served as the basis for the VA Office of General Counsel’s mediation statement.
TRAUNER worked closely with the Contracting Officer and the VA Office of General Counsel to develop a negotiation strategy for ADR. We completed a mediation presentation that served as the backbone of the VA’s position. We provided an oral presentation of our report during ADR, questioned the opposing expert’s incorrect analysis, and helped to calculate an appropriate settlement number. The case was not settled during the initial ADR. We attended a second ADR and provided support to the VA during these negotiations.
TRAUNER produced our:
• Preliminary report focused on analysis of delays/responsibility
• Final report, including cost analysis of each line item in the contractor’s claim
• Mediation presentation during
ADR
• Automated spreadsheet that allowed for quick calculation of settlement positions during ADR
We were also heavily involved in the final settlement negotiations between the contractor and VA.
Because of our understanding of the VA Contract and the contractor’s claim, the ADR judge was able to help opposing counsel understand the limitations of their clients’ potential recovery.
This understanding, combined with the accuracy of TRAUNER’s delay and cost analysis, allowed the VA to settle the case successfully without a costly trial. The contractor accepted a 55% reduction in its claim amount.
After settlement, the Branch Chief for the VAMHCS Construction Team provided a letter of recommendation.
The letter included the following:
“I want to give you my sincerest thanks for a job well done on GSA Task Order VA245-16- F0015. ...(Y)ou did an amazing job assisting the VA with settling a very difficult and challenging claim…
Your firm’s in-depth analysis of project scheduling, your firm’s extensive knowledge of VAAR clauses language and your presentations during the 4-day Alternate Disputes Resolution (ADR) mediation proceedings really helped to save the day.
In all aspects of the procurement, Trauner provided outstanding service in a first class professional manner. I definitely would recommend Trauner for future opportunities.”
The dispute was resolved without the need for expensive and prolonged litigation.
The 4C Patient Ward Renovation and Expansion Project involved the renovation of approximately 22,000 square foot of interior space and the construction of 1500 square feet of new space at the VA’s medical facility in Washington, DC. The Contract Completion date for the project was 365 calendar days from NTP.
During the project, the contractor submitted 134 change orders. A total of 16 modifications were executed.
Ultimately, the project finished 1,057 calendar days late and the contractor filed a $7M+ claim.
TRAUNER was engaged by the VA with an expert report deadline of +/- 45 days. In the initial stages of the project, we traveled to the VA office in Perryville, MD, to review and collect relevant documents.
Next, we submitted a preliminary draft of the expert report. This report focused on the analysis of delays and responsibility. The report analyzed each of the 13 major issues alleged by the contractor in its claim. We determined how much total delay the VA was responsible for, as well as the type of delay. The distinction between suspension and change order delay was important for this Project as each type is compensated differently under the VA’s Contract.

NPS Jefferson National Expansion Memorial, St. Louis, MO transportation alternatives, and connect people to nature. GRG funding for construction and long‐term O&M was identified in a local sales‐tax increase that passed in 2013. They have committed nearly $80 million to improvements on the arch grounds.
In addition to funding for construction, CAR is managing the design of the project and is donating the design to the NPS. Construction of the project elements will be contracted for and managed by the Denver Service Center. There are seven major components of construction that will be occurring on NPS property.
The NPS has engaged TRAUNER to assist them in providing real-time claim management services. Our first task was to evaluate the project risks, issues, and vulnerabilities on five of the seven projects.
Our second task is to provide on-call claims management services to the NPS to six of the seven projects.
TRAUNER’s tasks have included:
• Initial Review of Documents and Separate Reports regarding Project Risks and Vulnerabilities on the Six Major JEFF Projects
• On-Site Meetings with NPS Project Management and City- Arch-River representatives
• Review of CPM Schedule Updates and Time Extension Requests regarding weather issues on the South and North Arch Grounds Projects
• Review of Time Extension Requests on the $96M Visitor Center Project (Two Requests to Date)
• Review of Extended General Condition Claims on the Visitor Center Project
• Forensic Analysis of CPM Schedules on the Visitor Center Project - analyzed overall Project Completion as well as interim milestones such as the completion of the Renovation Scope
• Reviewed CPM Schedule Updates for the Visitor Center Project
The Jefferson National Expansion Memorial (JEFF) is a CityArchRiver 2015 partnership project that was created to renovate the Gateway Arch Grounds, renovate and update facilities and visitor services, and strengthen ties to the St. Louis Community. Funding for the project is being donated to the National Park Services (NPS) from the park’s partners in the project and is a combination of private donations and local sales tax revenue.
The NPS has entered into fundraising and design agreements with the CityArchRiver Foundation (CAR).
Their goal is to raise $250M of privately donated money to fund projects on park lands as well as other projects immediately adjacent to the park grounds.
The second major partner in the project is Great Rivers Greenway District (GRG). GRG is a regional park agency with special taxing authority that has a mission to connect communities, provide

The project achieved LEED Platinum Certification with sustainable design and construction including a living roof, natural ventilation, energy-efficient lighting, and natural local climate vegetation.
The prime contractor submitted a certified claim of $10,567,606 for alleged cost overruns in contingency and allowance accounts.
It also included a claim from the electrical subcontractor that included allegations of delay and acceleration, trade stacking, out-of sequence work, and added work.
TRAUNER provided forensic accounting services in which we evaluated the alleged overruns in the Construction Contingency Allowance and the alleged overruns in the Unallocated Direct Costs. We also performed a Guaranteed Maximum Price (GMP) audit on two portions of the overall claim.
TRAUNER presented its findings orally via a web conference and also prepared a report summarizing those findings.
These efforts helped the GSA come to an equitable settlement with the contractor.
50 United Nations Plaza is a cornerstone of the San Francisco Civic Center and is listed on the National Register of Historic Places.
It is the home of the General Services Administration's (GSA) regional headquarters offices for the Pacific Rim Region.
The 50 United Nations Plaza Project was a $100M renovation, seismic retrofit, and interior reconfiguration of a 5-story, historic, federal building.
The construction project included retrofitting the existing office layout to include opening up corridors, adding collaboration space, and utilizing natural lighting.

We performed CPM schedule analyses, including an analysis of both the critical project delays and delays to the critical path of the respective subcontract work, as well as an analysis of responsibility for those delays. We also analyzed alleged inefficiencies allegedly associated with specific technical design issues.
Our expert report was based on a review of the available project documentation including, but not limited to, the project plans and specifications, bid documents, project schedules, change orders, RFI’s, field change requests, engineering change notices, submittals, deposition transcripts, and exhibits.
Ultimately, a settlement favorable to our client was negotiated.
TRAUNER evaluated two claims, an $11.5M claim submitted by the electrical subcontractor and an $8.5M claim submitted by the mechanical subcontractor on the $180M design-build construction of a Radiological
Lackland Air Force Base, San Antonio, TX foundation piers for the new construction of a four-story, 272,000 square foot building to house 1,200 Air Force recruits in a basic military training environment.
The contractor’s claim alleged that a defective pier design and related constructive changes to the project scope entitled it to a 60-day, compensable time extension and additional compensation in the amount of $4,769,979.
We prepared an expert report and presented expert testimony at trial.
In a follow-on claim on this project, the Contractor alleged that a defective masonry design and related constructive changes entitled it to a 10-month compensable time extension as well as additional compensation in the amount of $8,795,700.
This second claim was resolved in mediation after the first was litigated.

Army Corps of Engineers to perform an independent review and objective analysis to determine the merits of a claim related to the construction of
