If the “best value” selection places your order over this Maximum Order, you have an opportunity to obtain a better schedule contract price. Before placing your order, contact the aforementioned contractor for a better price. The contractor may (1) offer a new price for this requirement (2) offer the lowest price available under this contract or (3) decline the order. A delivery order that exceeds the maximum order may be placed under the Schedule contract in accordance with FAR 8.404.

This price book is the property of C & E Services, Inc. t/a Chemical & Engineering Specialty and is subject to return upon request. All sales are subject to Chemical & Engineering

Specialty’s standard terms and conditions of sale. All sales are priced F.O.B. Destination. The prices as quoted herein include our standard engineering and technical services.

RETURN GOODS POLICY: A 15% handling plus freight in/out charge will be applied to all goods returned for credit during the first nine months where the return is due to “Customer

Error.” No materials should be returned after nine months unless authorized

REPACKAGE POLICY: Any repackaging requested by the customer will be assessed a fee of one dollar ($1.00) per pound.

ENGINEERING SERVICES

Providing quality technical service is an integral part of C&E Services, Inc.’s philosophy of water management. The specific products and programs recommended are only part of the total water treatment program developed for your plant. A vital part of our program is a comprehensive standard service program which is provided at no extra cost with the use of the products we have recommended.

The C&E Services, Inc. representative who will service your plant is thoroughly trained in all phases of water treatment. He has received more than 100 hours of formal instruction, which is supplemented yearly by seminars so that his skills remain sharp and his knowledge current.

In addition, he is constantly exposed to technology updates via technical information and courses. This ensures that you are provided with treatment programs and applications that are the newest and best in the field.

Your local C&E Services, Inc. representative is assisted by regional technical consultants, district managers, a home office technical staff, product or industry specialists, and our R&D laboratory. When necessary, visits to your plant will be made by members of this technical support team to assist the C&E Services, Inc. representative in providing the most thorough and effective water treatment service and programs possible, and to assist in solving unusual water treatment problems.

C&E Services, Inc. includes training, intensified services during start-up, regular services on a periodic basis, technical and laboratory support, and special services to deal with unusual problems or situations.

WARRANTY

All products furnished hereunder are warranted to be within our quality standards for such material. Our liability in any event is limited, however, to your net purchase price of such material, or at our option, to replace such materials upon its return to us, unless we are notified thereof in writing within forty-five (45) days after arrival of such material at destination, and unless we are permitted to examine it before use or processing.

We reserve the right to reformulate our products at any time, so long as the product is in compliance with our published specification for said product. Any recommendations made by us for use of a material are based upon tests believed to be reliable, but use of the product in any specific application remains the complete responsibility of the Buyer, and, except as expressly stated above, Seller makes no warranty of merchantability with respect to goods made pursuant to Buyer’s specifications. Furthermore, there is no warranty that any material furnished is merchantable, nor that the material is fit for any particular purpose, nor is there any other warranty expressed or implied, except such as is expressly provided hereunder.

Seller shall not be subjected to liability for any damages resulting from the handling, use, or further process of said material, whether alone or in combination with other chemicals.
