15. Warranty Provision

Science Horizons warrants that the Products delivered shall substantially conform to its Quality Control Tests, as they exist at the date of delivery, for a period of one year from the date of delivery for new products and ninety

(90) days from the date of delivery for upgrades or repairs. Quality Control Tests will be performed in a generic configuration using Science Horizons’ Test Bed at the Melbourne, Florida office. Science Horizons does not warrant that the Products delivered will work in any AQUINAS System previously delivered that is not currently under warranty or maintenance with Science Horizons. Science Horizons’ sole obligation under this warranty shall be limited to using its best efforts to correct such defects in the Products as soon as practicable after the end-user has notified Science Horizons of such defects. Science Horizons does not warrant that the operation of the Products shall be uninterrupted or error free. Science Horizons’ obligation to provide service under this Warranty Agreement is contingent upon proper use of the Product. Science Horizons shall be under no obligation to provide services under this Warranty Agreement should such service be required, in Science Horizons’ opinion, because of: (i) failure of the Product caused by improper use, accident, or neglect; (ii) damage caused during transportation to the Customer, including damage caused by Customer’s use of other than Science Horizons’ shipping containers; (iii) alterations, modifications, or attempts to repair Product made without Science Horizons’ approval;

(iv) causes external to Product including but not limited to failure or fluctuation of electrical power, inadequate cooling, or natural disasters; (v) attachment either to equipment not supplied by Science Horizons, or equipment not verified by prior operation as being acceptable, or equipment not verified by analysis by Science Horizons as being acceptable; (vi) Software not maintained at Science Horizons’ specified release level.

Government purchase cards are accepted at or below the micro-purchase threshold. Government purchase card purchases above the micro-purchase threshold will be on a case- by-case, contractor-approved basis only. Please contact the contractor for approval.

18. Terms and Conditions of Rental, Maintenance, and Repair

One (1) Year of System Maintenance – 20% of the current list price of each Module in the system subject to the following terms and conditions:

Maintenance shall not enter into force until System Components are in good working order and are either at current revision levels or SHI approved revision levels.

Commercial fixed price contract. Payment In Advance.

Renewable yearly.

Free hardware/firmware and software upgrades that provide minor enhancements to existing features of all system modules. Upgrade does not include upgrade of system products to new products.

20% discount on the purchase of Major Releases that add new major features and/or major enhancements to existing features for the AQUINAS System under hardware and software maintenance.

Free phone and remote login support for troubleshooting.

Hardware repair will be on a return for exchange for a refurbished unit basis.

(Exceptions: lightning/power surge damage, shipping damage, force majeure damage, improper use of SHI products, modification or alteration of SHI products by the customer, connection to non-approved SHI equip-ment, etc.)

All replacement modules will be shipped from SHI within the U.S. no later than 24 hours after the decision is made by SHI and customer that the module needs repair. If the module in need of repair is not returned to SHI within 60 days, the customer will be billed for the module at SHI’s current list price.

End User deals directly with SHI on all AQUINAS System performance issues.

Repairs on products no longer under warranty/maintenance will be on a return for exchange for a refurbished unit basis only. The cost for this exchange service will be Current List Price of the product less 10%. Please note that Science Horizons will not accept units for exchange that are more than three

(3) years old or products that are obsolete.

Science Horizons’ data acquisition products are the AQUINAS® System and the Portable AQUINAS® System (PAS). The AQUINAS® System has been installed worldwide, from Wake Island to New Zealand, and from Antarctica to Scandinavia.

THE AQUINAS® SYSTEM

The AQUINAS® System receives data from seismic, hydroacoustic, and infrasound sensors and converts the analog data to digital data.

It then sends that data in real time to local, national, and international data centers. The essential components of the AQUINAS® System are:

Downhole Field Station (DH-1, DH-3) The digitizer produces 24 bits of digital data from up to three channels of analog data. It resides with the sensor, usually part of an AQUINAS® array, in a 4” borehole.

Each digitizer requires a GPS receiver and a modem, which sends the data to the Communications Interface Module (CIM III).

Authenticator (AIMA-PC)

The Authenticator sends a signature to the digitizer that guarantees to the end user that the data received is authentic.

Communications Interface Module (CIM III) The Communications Interface Module collects the data from the array of digitizers and sends the data to the Station Processor.

Station Processor (SP) The Station Processor is a single, self-contained, data acquisition, processing, and forwarding work-station designed for both remote and local operation of the array of digitizers. The Station Processor receives the data from the Communications Interface Module and provides reliable forwarding of that data from the array to a national data center, international data center, or other host, as required.

Portable AQUINAS® System (PAS) Science Horizons has developed an innovative solution to address requirements for a small and transportable data acquisition system that can be installed rapidly in the field by a single person.

Designed to detect anomalous seismic events, the PAS is composed of three modules, the TL (the sensor, the collection system, and the power supply that is deployed in the field), the CL (the communications link), and the SPL (the data acquisition, processing, and forwarding workstation).

The CL is a portable array controller designed for small, remote, seismic sites. Integrated into a weatherproof case, the CL does not require any additional protection from the elements. The CL collects the seismic data from an array of TL units and sends the collected information via TCP/IP to the SPL.

Utilizing a modified digitizer card, a creative single-channel or three-channel seismometer configuration, a long-life battery pack, and a reliable RF communications backbone, the PAS provides the same accuracy and data availability as a larger, more expensive seismic array.

Easily transported into the field, the PAS can be installed and configured within a matter of minutes. It can be used for monitoring naturally occurring seismic events, for clandestine monitoring of man-made seismic activity, and for exploration purposes.

SeismicRadar® Workstation (SR WKSTN and SR WKSTN-D)

The SeismicRadar® Workstation is a revolutionary data visualization tool that computes the direction, velocity, signal-to-noise ratio, and arrival time of a seismic event as it crosses an array of Downhole Field Stations (DH-1, DH-3) or TLs. Features of the SR WKSTN include:

- Processes data in real-time

- Displays data as a color three dimensional beamgrid (similar to color weather radar)

- Notifies the user when seismic activity is detected according to user-defined criteria (azimuth, velocity, frequency, and power)

- Includes Laptop (SR WKSTN) or Desktop (SR WKSTN-D) Workstation

The SeismicRadar® Workstation is an excellent addition to both the AQUINAS® System and the PAS.
