JUSTIFICATION AND APPROVAL
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
TASK ORDER GSQ0014AJC0004
The General Services Administration (GSA) makes this Justification and Approval (J&A) for Other Than Full and Open Competition orders pursuant to Federal Acquisition Regulation (FAR) 6.302.
1) Identification of Agency and Contracting Activity:

2) Nature and/or Description of Action Being Approved:
FEDSIM intends to increase the ceiling of the current Blue Force Tracker-1 (BFT-1) task order (GS00Q14AJC0004) to Comtech Mobile Datacom Corp. (CMDC), 20430 Century Blvd, Germantown, MD 20874, under FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The proposed ceiling increase is in the amount of $345,168, which will raise the total task order from $38,161,049 to $38,506,217. The reason for the increase is to complete Information System accreditation tasks that were not completed during the base year due to Government-caused delays.
3) A Description of Supplies/Services Required to Meet Agency’s Need:
The task order directs the contractor to support the Government’s efforts to maintain system certification and accreditation. Part of the requirement to maintain accreditation for the Movement Tracking System (MTS) is to integrate and implement a Host-based Security System (HBSS). HBSS is a commercial-off-the-shelf (COTS)-based application which provides the capability to monitor, detect, and counter known cyber threats to DOD systems. Because MTS is a proprietary system owned by CMDC, only CMDC is authorized to perform the integration and implementation of HBSS. This was planned to be completed during the base year of the contract, however Government delays in providing software licenses, coupled with scheduling constraints of the Army
Version 05/09/14 Page 2 certification and accreditation team, the system required system audits have been delayed until March 30, 2015. Because the audits will not begin until March 30, 2015, the remainder of the work needed to complete the certification and accreditation will be performed during Option Period One.
CMDC’s pre-award proposal was based on the assumption that HBSS would be implemented in the MTS and BFT-1 systems concurrently, thus allowing greater efficiencies than implementing HBSS in each system separately. Because of hardware requirements to implement HBSS in BFT-1, CMDC performed as much simultaneous work on both systems as possible until the lack of hardware prevented any further work on the BFT-1 system, and then continued on with the MTS system. Because of the division of the systems, CMDC realized a higher labor cost to integrate and implement HBSS in the MTS system, than was proposed, based on the assumption the systems would be implemented simultaneously.
CMDC’s pre-award proposal also reflected costs for this effort in the base year only:
HBSS work was not priced for the out-years of the contract. Therefore, in order for this work to be funded, a ceiling increase is required.
4) Identification of the Statutory Authority Permitting Other Than Full and Open Competition:
This modification will be awarded pursuant to the authority of 41 United States Code (U.S.C.) 3304 as implemented by FAR 6.302 -1, Only One Responsible Source and no Other Supplies or Services will satisfy Agency Requirements.
5) Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited
CMDC owns the software and infrastructure for operation of MTS. Although HBSS is a COTS based application, because it is a component of the overall proprietary infrastructure of MTS, the contractor is the only source capable of completing the tasks for certification, accreditation, and subsequent deployment of the HBSS sub-system.
6) Description of Efforts Made to Ensure that Offers are Solicited From as Many Potential Sources as Practicable
Per FAR 5.201, a synopsis is required when the action is conducted under FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.
As part of the initial award, a notice of intent synopsis was published on FEDBIZOPS in December, 2013. There were no comments from industry expressing an interest in the acquisition.

7) A Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable
The estimated value of this ceiling increase is $345,168. This estimate is based on historical costs under the current task order used to meet US Army requirements.
FEDSIM will compare the labor rates, hours, and costs for this ceiling increase with the Government Cost Estimate for these services. Such comparison will ensure that the prices awarded will be fair and reasonable.
8) A Description of the Market Research Conducted and the Results or a Statement of the Reason Market Research was not Conducted
Prior to the award of this Task Order, FEDSIM issued a Notice of Intent to Issue a Sole Source Contract on FedBizOps for seven days. There were no responses received in response to this announcement.
Historical market research has determined that CMDC is the only source that can satisfy the Government’s requirements.
9) Any Other Facts Supporting the Use of Other Than Full and Open Competition
HBSS is a critical subsystem of CMDC’s proprietary MTS system. The integration of the HBSS subsystem requires interfacing with the MTS system. Because of the proprietary nature, CMDC is the only contractor authorized to perform work on MTS.
10) A Listing of the Sources, if any, That Expressed, In Writing, An Interest in the Acquisition
There are no other facts, other than what has been stated above, that support this justification.
11) A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required
At the conclusion of this task order, the US Army will significantly reduce the amount of services for which CMDC is uniquely qualified. It is anticipated that the MTS proprietary infrastructure will be migrated into Army-owned infrastructure, eliminating the specialized services of CMDC.
