Justification and Approval (J&A) For

Other Than Full and Open Competition Under SAT FAR 13.106-1(b)(1) Only One Responsible Source

1. Contracting Activity: 142nd Mission Support Contracting, Portland Air National Guard Base, 6801 NE Cornfoot Rd, Portland, OR 97218.

2. Nature and/or Description of the action:

2.1 Requirement: Grappler Police Bumper Vehicle Borne-Immobilization Device

2.2 Contract Type: Firm Fixed Price

2.3 Manufacture: Stock Enterprises LLC

2.4 Estimated Cost:

2.5 End User: 142 Security Forces Squadron

3. Description of the Supplies or services required to meet the Agency’s needs (including the estimated value):

The purpose of this acquisition is for the acquisition of the Grappler Police Bumper Vehicle Borne-Immobilization Device

The supplies required consist of 6 Grappler arresting bumper for F150 2015-2019. Each unit includes 2 arresting nets. Delivery, installation and training included, 20 additional arresting nets, 3 year warranty on components.

Training for 4 users per bumper (24 total) included at the time of installation. Purchasing agency to provide training facility and target vehicle(s)

4. Authority Cited: FAR 13.106-1(b)(1)

5. Reasons for Authority Cited: Stock Enterprises currently offers the only Air Force approved Vehicle Borne- Immobilization Device authorized per the HQ USAF/JA.

6. Efforts to Obtain Competition: Initially, a search of GSA Advantage was conducted with no comparable results.

Historical contractual information from other agencies was examined. Moreover, a legal review of the Grappler Police Bumper Vehicle Borne-Immobilization Device was conducted by HQ USAF/JA and concluded that the GPB complies with applicable domestic and international law, including the LOW. This review does not apply to all similar weapons systems, as others may vary and may have different capabilities that must be individually examined. Further, this review only applies to the GPB in its current configuration and based on its stated specifications.

7. Determination of fair and reasonable pricing: Stock Enterprises LLC provided a quote provided to another agency for similar items where a price fair and reasonable determination can definitively be made for this requirement.

8. Market Research: Vehicle Borne-Immobilization Devices is a niche market where manufacturers are held to the highest of standards when it comes to quality and serviceability. The only vendor currently authorized to provide Vehicle Borne-Immobilization Device for the Security Forces Community is Stock Enterprises LLC. No other vendors are authorized to sell the USAF and ANG affiliated components.

Historical contractual history revealed similar requirements awarded to Stock Enterprises LLC. Based on Stock Enterprises LLC clearly established market dominance of the Vehicle Borne-Immobilization Device market segment, recommend direct award to Stock Enterprises LLC as no other “or equal” products will suffice for the 142 SFS mission objectives. Total small business set aside in accordance with FAR 19.502-2.

Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: For future acquisition/opportunities the 142 Security Forces Squadron (SFS) personnel will continue to research the industry to try to determine other cost-effective alternatives and / or sources that meet or contribute to the unique mission requirements of the 142 SFS.
