C. STATEMENT OF WORK
C.1 PURPOSE AND SCOPE
The purpose of this Statement of Work (SOW) is to obtain the services of a Contractor to provide
Wireless Home Phone Services. The scope of this procurement is both services and equipment – to include both unlimited domestic and domestic long distance service.
The period of performance is:
Base period of 12 months, from 03/01/2015 to 02/28/2016 for preliminary planning and design, initial implementation planning, and first incremental deployment
Four (4) option periods, each being a period of 12 months, collectively starting on 03/01/2016 and ending on 02/29/2020 for ongoing implementation planning and subsequent incremental deployments.
C.2 BACKGROUND
Mission and Organization
As described on its public web site (www.gao.gov), the U.S. Government Accountability Office
(GAO) supports
―the Congress in meeting its constitutional responsibilities and to help improve the performance and ensure the accountability of the federal government for the benefit of the
American people. We provide Congress with timely information that is objective, fact-based, nonpartisan, non-ideological, fair, and balanced. Our Core Values of accountability, integrity, and reliability are reflected in all of the work we do. We operate under strict professional standards of review and referencing; all facts and analyses in our work are thoroughly checked for accuracy.‖
Our Work is done at the request of congressional committees or subcommittees or is mandated by public laws or committee reports. We also undertake research under the authority of the
Comptroller General. We support congressional oversight by auditing agency operations to determine whether federal funds are being spent efficiently and effectively;
investigating allegations of illegal and improper activities;
reporting on how well government programs and policies are meeting their objectives;
performing policy analyses and outlining options for congressional consideration; and issuing legal decisions and opinions, such as bid protest rulings and reports on agency rules.
We advise Congress and the heads of executive agencies about ways to make government more efficient, effective, ethical, equitable and responsive. Our work leads to laws and acts that improve government operations, saving the government and taxpayers billions of dollars.
The product that GAO produces and the medium in which GAO works is information. GAO collects information from federal agencies and other sources and publishes reports in paper, electronic or testimony form. This information is sensitive and requires careful protection because of its source, because of privacy requirements and to protect the integrity of its work in progress before formal publishing. (The handling of classified information is not a factor in this request for information.) GAO has a large archive of past reports and data and adheres to strict federal records management standards.
Because of its mission, GAO strives to follow best practices. Therefore, GAO adheres to government mandates and standards, including those for information systems, management and security.
To accomplish its mission, GAO is organized with its headquarters in Washington, DC and eleven field offices located in cities across the continental United States. GAO, by the nature of its audit work, also has staff located at various audit sites in the Washington metro area, elsewhere in the
US, and around the world. There are approximately 2,500 staff located in Washington and 700 in field locations. GAO staff travel frequently around the US and the globe to accomplish agency work. Increasingly, GAO staff also participates in telework arrangements from their homes.
Internally, GAO is organized into Teams that conduct its audit functions. Members of these teams, which are highly collaborative, working closely together and communicating and sharing information regularly, may be distributed throughout headquarters, field offices or elsewhere.
In sum, GAO is an organization that revolves around information: collecting, analyzing and processing, publishing, communicating and storing it. GAO needs to make this information accessible to both its staff and its clients, more and more through modern electronic and mobile means. Protecting this information at all points is critical to its work. Because of its wide-ranging locations – and increasingly because of the mobile and collaborative nature of its work and staff – its information assets must be accessible, usable and secure anywhere anytime.

The Contracting Officer's Representative (COR), in consultation with the Project Manager, will determine the position sensitivity for all personnel assigned to the contract, and will identify such to SEM. GAO’s Director of Security and Emergency Management will determine the type of investigation for each Order employee based upon the sensitivity level identified for his or her position. The following criteria will be used for determining position sensitivity.

2) A Moderate Risk Public Trust Position is a position whose occupant
a) is an analyst, analyst-related specialist, or attorney;
b) is directly involved in the production of GAO products or external audiences;
c) has duties involving financial management, contracting, or other procurement related activities, or human capital or related activates (e.g., of the Office of Opportunity and Inclusiveness);

3) A Low Risk Public Trust Position is a position that is not designated as either a high risk or moderate risk public trust position.
NOTE: All Order employees are processed for a minimum of a Low Risk Public Trust
Position due to their access to the GAO Building.
2. The COR will notify SEM of changes in personnel duties as it affects a Order employee's designated position sensitivity requiring an increased investigation.
3. Annually, SEM will provide a listing of all Order staff to the COR for validation.
BACKGROUND INVESTIGATION REQUIREMENTS

2. It is the responsibility of the contractor to ensure that employees whose positions require access to national security information possess a security clearance of the appropriate level prior to being assigned to work on the contract.
3. GAO will process the appropriate background investigation for each employee assigned to public trust positions under the contract.
NOTE: Background investigations cannot be processed on individuals who do not possess a valid social security number (SSN). It is required that valid SSNs be provided to SEM for each employee assigned to the contract.
ACCESS TO GAO FACILITIES
1. SEM exercises full and complete authority and control over granting, denying, withholding, and terminating access of Order employees to GAO facilities.
2. All Order employees requiring access for 6 months or longer must undergo a favorable background investigation and be badged for building entry.
3. Order employees requiring access for less than 6 months must undergo a favorable interim background investigation and be placed on the GAO Contractor Access List for unescorted entry into the facility.
4. Order employees requiring one-time or short-term access must be signed in and out at the G
Street pedestrian entrance, escorted, and under the continuous control of a permanently badged employee. Escorts will be fully briefed on their escort responsibilities and may only escort up to 5 personnel at a time.
5. Background investigations conducted on Order employees will be consistent with the statement of work/contract.
6. Temporary escorted employees must be kept to the minimum required for operational needs.
7. Until approved by SEM for unescorted access, all Order employees must be escorted by a fully briefed, designated permanently badged employee. All escorted individuals must be within direct sight of their escorts at all times.
8. All requests for Order employee access to GAO facilities must be submitted to SEM by the
COR.
9. Determining eligibility for access to GAO facilities requires a National Agency Check with
Written Inquiries (NACI), at a minimum. SEM will perform a NACI for those Order employees without a currently valid investigation. Order employees with a previous or existing investigation should be identified by the COR to SEM during in-processing.
a. SEM will provide to each employee the necessary personnel security background forms and instructions for completion of the forms.
b. All investigative forms must be completed and submitted to SEM within 14 working days from the date the forms are provided by SEM.
10. Order employees may be granted interim unescorted access based upon the results of a favorable national criminal history check, fingerprint check, the favorable review of the employee’s completed personnel security questionnaire, and the initiation of the NACI investigation.
a. Failure to submit the completed investigative forms will result in the delay and/or denial of unescorted access.
b. Unfavorable information revealed during the review process may result in the delay and/or denial of unescorted access.
11. A final determination regarding an Order employee’s access is made based on the completed
NACI.
a. If the NACI returns with favorable information, the employee may be granted unescorted access for the term of the Order or the employee’s termination from the contract, whichever comes first.
b. If the NACI returns with derogatory information that cannot be mitigated through the adjudicative process, the Order employee’s access may be terminated.
12. Based on the Order employee’s required access needs, approval for unescorted access may be granted with the issuance of a permanent building access badge (> 6 months), an interim access badge (< 6 months), or inclusion of the Order employee’s name on the GAO Contractor
Access List.
13. If access is imperative to GAO operations, for a Order employee who does not meet the minimum investigative requirements of a completed NACI, the COR may sponsor a Order employee for temporary access for a single visit of up to 48 hours to GAO facilities, as follows.
a. Access is under escort by either the contract’s COR or the project manager, if the latter has been issued a permanent GAO building access badge.
b. Only for purposes in direct support of the contract.
c. As approved for official purposes by the COR.
d. As requested by the COR through SEM at least 24 hours, or one full work day, in advance.
e. For a single visit of longer than 48 hours, but not to exceed 7 days, the Order employee must pass a favorable National Crime Information Center (NCIC) check, in addition to meeting the criteria in paragraphs a. through d. above.
f. Exceptions to policy for temporary access must be submitted in writing to GAO¿s
Director of Security and Emergency Management.
NOTE: Upon arrival at the building the Order employee must present a valid photo ID and will be issued a temporary escort required contractor badge.
14. Once a decision is reached, whether favorable or unfavorable, SEM will provide written notification to the contractor, through the COR. The COR must notify the contractor immediately if
SEM determines that an Order employee is unsuitable for his/her duties under the Order and, therefore, will not be permitted access to GAO facilities.
15. If approved to receive a GAO building access badge, a Order employee must appear in person at the SEM ID Media office in the GAO Headquarters Building, or at a designated office in other
GAO facilities (e.g., GAO field offices), and show two forms of identification in original form, with at least one being a valid state or federal government-issued picture identification.
INITIATING THE BACKGROUND INVESTIGATION
1. To initiate the background investigation, the COR will, for each employee assigned to the
Order who requires access to GAO facilities, submit to SEM:
a. a completed GAO Form 540A, Request for Approval of Unescorted Access for non-
GAO Employees; and
b. a GAO Form 618A, Request for NCIC Check for non-GAO Employees, completed by the Order employee.
2. Upon receipt of the completed Form 540A and Form 618A from the COR, SEM will provide to the Order employee, through the COR, instructions for:
Completing a personnel security questionnaire via the Office of Personnel Management’s electronic-Questionnaires for Investigations Processing (e-QIP) system:
1) a Standard Form (SF) 85, Questionnaire for Non-Sensitive Positions for building access and Low Risk positions of trust;

3. The contractor is responsible for ensuring that each Order employee returns the completed documents, through the COR, to SEM within 14 days from the date provided by SEM, and that all information submitted is complete, accurate, and legible.
4. Upon receipt of all completed forms, SEM will forward the forms to OPM with a request for the conduct of the appropriate background investigation.
NOTE: The COR is responsible for ensuring that the current version of each required form is provided to the contractor for completion and submission to SEM (current forms are available on the GAO Website).

The Period of Performance of this Order shall be from the effective date of award for twelve (12) consecutive months, with four (4) Option Years of twelve (12) consecutive months each.
GAO 52.234-70 DISPUTES – LEGISLATIVE BRANCH AGENCY (APR 2008)
(a) Except as otherwise provided in this contract, any dispute concerning a question of fact arising under this Order which is not disposed of by agreement shall be decided by the Contracting
Officer, who shall render his/her decision in writing and mail or otherwise furnish a copy thereof to the Contractor. The decision of the Contracting Officer shall be final and conclusive unless, within thirty (30) days from the date of receipt of such copy, the Contractor mails or otherwise furnishes to the Contracting Officer a written appeal addressed to the Comptroller General. The decision of the Comptroller General or his/her duly authorized representative for the determination of such appeals shall be final and conclusive unless determined by a court of competent jurisdiction to have been fraudulent, or capricious, or arbitrary, or so grossly erroneous as necessarily to imply bad faith, or not supported by substantial evidence. In connection with any appeal proceeding under this clause, the Contractor shall be afforded an opportunity to be heard and to offer evidence in support of its appeal. Pending final decision of a dispute hereunder, the Contractor shall proceed diligently with the performance of the Order and in accordance with the Contracting
Officer's decision.
(b) This "Disputes" clause does not preclude consideration of law questions in connection with decisions provided for in paragraph (a) above: Provided, that nothing in this Order shall be construed as making final the decision of any administrative official, representative, or board on a question of law.
GAO 52.235-73 CONFIDENTIALITY OF GAO DATA (APR 1984)
Because of the sensitivity and confidentiality of much of the data handled by GAO, the contractor shall maintain confidentiality of all documents, data and other information supplied to it by the
GAO, in accordance with all applicable Federal guidelines and regulations. Confidentiality is essential to satisfactory Order performance. Also, specific tasks under this Order may involve processing records or portions of records which GAO treats as confidential, and contain information subject to the GAO Privacy Procedures for Personnel Records, 4 C.F.R. Part 83.
The contractor assumes full responsibility for and guarantees the security of all documents, data, and other information supplied by GAO.
No action taken by, or on behalf of, the contractor, or which the contractor could prevent, will be permitted if the effect is or could be reasonably foreseen to undermine GAO's ability to maintain the security of records created by GAO or which may be subject to the GAO Privacy Procedures.
The contractor will prevent any person other than the contractor's team members (or other persons for whom access is necessary for the completion of the contract) from seeing or having access to information in the possession or under the control of the contractor.
The contractor will prevent any person from disclosing the contents or description of documents or information to any person not authorized under this Order or by the GAO to have access to such documents or information.
The contractor will prevent removal of any documents or information from the contractor's premises without authorization by appropriate GAO officials.
The contractor shall submit to the GAO Contracting Officer, one executed copy of a Non-
Disclosure Agreement, Attachment Blank, (See Section J, List of Attachments), for each employee assigned to work with GAO confidential material within five (5) working days after notification of award. The Contractor agrees to include similar requirements in any subcontracts which it may enter into regarding or supporting work under this Order and furnish the Contracting Officer one copy of each subcontractor employee's non-disclosure agreement within five (5) working days after its execution. Each GAO Non-Disclosure Agreement must be signed by an authorized
Contractor Administrator.
The contractor will report to the GAO Order Officer any breach of confidence by any person as soon as the breach is known.
The contractor shall assure that all persons handling GAO confidential or sensitive materials has signed the GAO Non-Disclosure Agreement, Attachment Blank, and an authorized Contractor
Administrator must sign each GAO Non-Disclosure Agreement submitted by each employee assigned to this contract.
The contractor agrees that no contractor or subcontractor employee will be given access to GAO documents or other records unless that employee shall have first executed a Non-Disclosure
Agreement.
A Non-Disclosure Agreement, whether submitted prior to or after the award of this contract, shall be binding with regard to information obtained at any time throughout the period of performance of this contract. All Non-Disclosure Agreements are binding indefinitely unless released by a duly authorized official of the GAO. A contractor or subcontractor employee whose employment is continuous need not execute a new Agreement if his assignment to work related to this Order terminates but later resumes.
Any deviation from provisions of this clause which is attributable to the contractor or to persons allowed on the contractor's premises constitutes a material breach of confidentiality and may be sufficient ground for default. Further, the contractor agrees to save the Government harmless in the amount of any judgment against the United States resulting from such a breach. At the
Comptroller General's option, the contractor shall assign all of his rights of action against any person to the United States. Disclosure in violation of the Privacy Procedures also may involve the imposition of criminal penalties.
To the extent this Order provides for the operation, on behalf of the GAO, of the system of records to accomplish an agency function, it shall be subject to the requirements of any GAO Order or regulations pertaining to privacy procedures.
