MACROBUTTON EXECUTIVE SUMMARY NOTICE
Request For Proposal (RFP)
No. GAO-08-N-0015, Security Services
The purpose of this executive summary notice is to highlight the key features of this RFP and the complexities which the Government considers important.
1. Offerors must submit ALL questions concerning this solicitation in writing to Adrienne C. Walker, Contract Specialist at walkerac@gao.gov. GAO must receive all questions no later than July 25, 2008 (see Clause L.9). An amendment to the RFP will be issued to all offerors on the solicitation mailing list, providing all questions received and the corresponding answers.
2. In addition to completing the pricing documents in Section J, Attachment E, offerors are also required to complete the pricing schedules in Clauses B.1, B.2, B.3, B.4 and names of key personnel in Clause H.6.
3. Your attention is directed to Section M, Clause M.1, Evaluation Factors for Award. At a minimum, all offerors must have performed at least two security services contracts, of similar size and scope within the past ten years.
4. Page 40 of the solicitation provides a list of the Section J attachments. Attachments C (Wage Determinations) & D (GAO Order 0645.1) are attached as PDF files.
5. Each offeror must submit an original plus five (5) copies of its technical and cost proposal and provide it on CD, as a separate part of the total proposal package. Omit all cost or pricing details from the technical proposal (see Clause L.6). The cost proposal must be SEPARATELY BOUND. Offerors are cautioned to completely execute SF33 (Section A) and all representations, certifications, and other statements of offerors (Section K).
6. Security at the GAO Headquarters has increased significantly and offerors can no longer deliver proposals in person.
GAO only accepts hand-carried bids/proposals deliveries from Federal Express (Fedex). Please refer to Section L, Clauses L.10 and L.11. Offerors are encouraged to review FAR provision 52.215-1(c), “Submission, Modification, Revision, and Withdrawal of Proposals (JAN 2004)”. The rules regarding late proposals and GAO’s proposal submission procedures will be strictly enforced.

(TEMPORARY ADDITIONAL SERVICES)
The following fixed rates, inclusive of all indirect costs and profit, shall apply for the duration of the contract for Temporary Additional Services (TAS) orders. TAS are any additional services to be performed after normal duty hours by technicians, administrative staff ( including ID Media/Parking Administrator and receptionists) as well as any additional security force services required with less than a (4) hour notice. These fixed hourly rates shall be used in task orders issued by the Contracting Officer's Technical Representative (COTR) and Technical Monitors. The hours listed below are estimates and are not guaranteed (no minimum or maximum).

The United States Government Accountability Office (GAO) requires a professionally qualified and highly trained armed security force to provide a safe and secure work place for building occupants. The contractor is to perform security force management and staffing; security equipment installation and maintenance; administer the access control system and monitor closed-circuit television and alarm activities, detect and deter safety/security hazards, unauthorized, illegal, or potentially life-threatening activities; perform receptionist services, parking administration, and other administrative security services as requested by the Contracting Officer's Technical Representative (COTR).
The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications included in Section J, Attachment A, which is incorporated by reference as part of this agreement.

F.3 PERIOD OF PERFORMANCE

This contract requires a transition period of 12 working days prior to the contract start date. The transition period shall be from March 16, 2009 through March 31, 2009.

TRANSITION REQUIREMENTS
This contract will require a 12 working days transition period prior to the contract start date. After award and prior to the contract start date, the contractor will be required to submit an original and one copy of each of the following:
1) The contractor shall provide the COTR documentation of the certificates of training, licenses, permits, and bonding for all contract employees 15 days prior to the contract start date and shall provide the required documentation for each newly-hired employee not later than 15 calendar days prior to the employee's start-work date. The contractor shall insure that all certificates of training, licenses, permits and bonds are kept current and valid.
2) At least 15 days prior to the contract start date, the contractor shall submit to the COTR a preventive maintenance schedule for the equipment and systems covered by this contract. At a minimum, the schedule shall identify the equipment by manufacturer/serial number, etc., its location and the schedule for its annual maintenance, including a proposed inspection and testing schedule for the fire alarm and sprinkler systems.
4) Not later than 15 days prior to the contract start date, the contractor shall provide the COTR with a telephone number (or numbers) which the government may use at any time to contact either the contractor, the project manager, and/or supervisors. After normal working hours, when requested, the project manager or one of the assigned supervisors shall be available at the site within one hour of the receipt of such a request. The contractor shall immediately notify the COTR of any changes in these telephone numbers.
5) The contractor shall arrange for firearms testing/certification for all employees who will be armed in the line of duty under this contract 15 days prior to the contract start work date. Replacement employees must be qualified with the firearm before the employee starts work on this contract.
6) Fifteen (15) days prior to contract start, the contractor shall provide the names and documentation for all reserve personnel or a stand-by roster/plan to cover all open posts due to vacations, call-offs, etc. to the COTR for approval.
7) A set of resumes shall be provided to both the CO and COTR for the proposed project manager, all supervisors and for any proposed position requiring technical training, formal education, licenses or certifications as identified in its proposal at least 15 calendar days before the employee starts work. The COTR shall determine the acceptability of all proposed employees.

HOURS OF OPERATION
a.
Official working hours of building occupants: 5:45 a.m. to 7:30 p.m., Monday through Friday.
The following holidays are recognized by the government:

CONTINUITY OF OPERATIONS
The contractor fully recognizes that the services covered by this contract are vital to the government's mission; that continuity of the services must be maintained at the utmost efficiency without interruption; and continuity of all services is a primary obligation of the contractor. The contractor must prepare contingency plans for use during a strike of its employees. These plans should be submitted to GAO no later than 15 days prior to the contract start date.
The contractor shall be required to maintain building security during all emergency situations such as fires, accident and rescue operations, strikes, civil disturbances, natural disasters and military contingency operations.
c.
Designated contractor personnel, including the top on-site supervisor, shall become thoroughly familiar with the government's “Occupant Emergency Plan, Emergency Preparedness Plan, and Disaster Recovery Plan” responsibilities. Participation in emergency plans shall be mandatory during the event of a building related emergency or natural disaster regardless of the time of occurrence. The contractor shall periodically review, update, and maintain the security sections of the emergency operations plan and corresponding security operations center (SOC) checklist to ensure that the facility is adequately secured and protected in an emergency situation. Such emergencies may include civil disturbances, but are not limited to: natural disasters, or accident and rescue operations. The contractor shall submit the emergency operating plan and damage control plan to the CO and COTR no later than 15 days prior to the contract start date.
d.
Prior to the expiration of this contract, after selection by GAO of a successor contractor, your firm as the current contractor and such successor contractor shall jointly prepare a mutually agreeable detailed plan for phase-in/phase-out operations. In addition, the contractor agrees to provide phase-in/phase-out services for a period of not more than 60 days. At the sole option of GAO, this phase-in/phase-out period may commence either 60 days prior to the expiration or immediately after expiration of the contract term or any extension thereof. Continuity for all services required under this contract shall be maintained during this period.

SERVICES, SUPPLIES, MATERIALS, AND EQUIPMENT FURNISHED BY THE CONTRACTOR
a.
General
1) Except for those items or services specifically stated to be government-furnished (see Section J, Attachment A, Statement of Work), the contractor shall furnish all supplies, materials, tools, repair or replacement parts, equipment and labor necessary to efficiently and satisfactorily perform work under this contract.
2) The contractor shall arrange for the installation, at its expense of private business phones for its use in making calls outside of the building.
3) All equipment furnished by the contractor and used to maintain GAO's security systems shall become the property of the government upon installation and shall remain government property upon the expiration or termination of the contract.
Subcontracts
1) The contractor shall provide the CO copies of any subcontracts entered into to provide any services required under this contract within five (5) working days after award of such subcontracts.
2) The contractor shall not enter into any subcontract for maintenance repairs or servicing any equipment without the prior written consent of the government. As a condition of obtaining such consent, the contractor shall supply the government with a copy of the proposed subcontract and shall state to the government the relationship, if any, between the contractor (or the person or persons in control of the contractor) and the proposed subcontractor.
3) All subcontracts shall be in the name of the contractor and subcontractor, and shall be assignable at the government's option, to the government, or the government's nominee.
Quality Control
The contractor shall establish and maintain a complete Quality Control Plan (QCP) to assure that all of the requirements of the contract are provided as specified. One copy each of the updated contractor's QCP shall be provided to the CO and COTR as changes occur. The plan shall include:
1) An inspection system covering all the services to be provided. It must specify the areas to be inspected on either a scheduled or unscheduled basis, how often inspections will be accomplished, and the title of the individual(s) who will perform the inspections.
The inspection system shall include a check list covering every area of the contractor's operation as well as every task to be performed.
2) The methods for identifying and preventing defects in the quality of service performed before the level of performance becomes unacceptable.
3) The contractor shall keep on-site records of all inspections conducted by the contractor and necessary corrective actions taken. This documentation shall be available for immediate review and inspection by the government at all times during normal working hours. Copies shall be made available upon request by the government.

(a) Definitions. "Contracting Officer," as used in this clause, does not include any representative of the Contracting Officer. "Contracting Officer's Technical Representative (COTR)," as used in this clause, means any person the Contracting Officer has so designated by written notice (a copy of which shall be provided to the Contractor) which shall refer to this subparagraph and shall be issued to the designated representative before the (COTR) exercises such authority.
(b) Notice. The primary purpose of this clause is to obtain prompt reporting of Government conduct that the Contractor considers to constitute a change to this contract. Except for changes identified as such in writing and signed by the Contracting Officer, the Contractor shall notify the Contracting Officer in writing promptly, within 15 calendar days from the date that the Contractor identifies any Government conduct (including actions, inactions, and written or oral communications) that the Contractor regards as a change to the contract terms and conditions. GAO will provide for the monthly access service charge and servicing. The contractor shall reimburse the Government for all unofficial long distance calls and for any damage or loss costs through deductions applied to the contractor's monthly invoice.

GAO will provide a GSA approved container for the storage of small arms and ammunition.

H.2 GAO 52.235-70 SCREENING BUSINESS INFORMATION FOR CLAIMS OF CONFIDENTIALITY (APR 1984)
(a) Whenever collecting information under this contract, the Contractor agrees to comply with the following requirements:
(1) If the Contractor collects information from public sources, such as books, reports, journals, periodicals, public records, or other sources that are available to the public without restriction, the Contractor shall submit a list of these sources to the appropriate Contracting Officer's Technical Representative at the time the information is initially submitted to the GAO Contracting Officer. The Contractor shall identify the information according to source.
(2) If the Contractor collects information from a State or local Government or from a Federal agency, the Contractor shall submit a list of these sources to the appropriate Contracting Officer's Technical Representative at the time the information is initially submitted to the GAO Contracting Officer. The Contractor shall identify the information according to source.
(3) If the Contractor collects information directly from a business or from a source that represents a business or businesses, such as a trade association:
(i) Before asking for the information, the Contractor shall identify itself, explain that it is performing contractual work for the GAO, identify the information that it is seeking to collect, explain what will be done with the information, and give the following notice:
(A) You may, if you desire, assert a business confidentiality claim covering part or all of the information. If you do assert a claim, the information will be disclosed by the GAO only to the extent, and by means of the procedures, set forth in 4 CFR Part 81, Public Availability of GAO Records.
(B) If no such claim is made at the time this information is received by the Contractor, it may be made available to the public by the Government Accountability Office without further notice to you.
(C) The Contractor shall, in accordance with FAR Part 9, execute a written agreement regarding the limitations of the use of this information and forward a copy of the agreement to the Contracting Officer.
(ii) Upon receiving the information, the Contractor shall make a written notation that the notice set out above was given to the source, by whom, in what form, and on what date.
(iii) At the time the Contractor initially submits the information to the appropriate Contracting Officer's Technical Representative, the Contractor shall submit a list of these sources, identify the information according to source, and indicate whether the source made any confidentiality claim and the nature and extent of the claim.
(b) The Contractor shall keep all information collected from nonpublic sources confidential in accordance with the clause in this contract entitled "Treatment of Confidential Business Information" as if it had been furnished to the Contractor by the GAO.
(c) The Contractor agrees to obtain the written consent of the Contracting Officer's Technical Representative, after a written determination by the appropriate Contracting Officer, prior to entering into any subcontract that will require the subcontractor to collect information. The Contractor agrees to include this clause, including this paragraph (c), and the clause entitled "Treatment of Confidential Business Information" in all subcontracts awarded pursuant to this contract that require the subcontractor collect information.
H.3
GAO 52.235-71 TREATMENT OF CONFIDENTIAL BUSINESS INFORMATION (APR 1984)
(a) The Contracting Officer may disclose confidential business information to the Contractor necessary to carry out the work required under this contract. The Contractor agrees to use the confidential information only under the following conditions:
(1) The Contractor and Contractor's Employees shall: (i) use the confidential information only for the purposes of carrying out the work required by the contract; (ii) not disclose the information to anyone other than Government Accountability Office employees; and (iii) return to the Contracting Officer all copies of the information, and any abstracts or excerpts there from, upon request by the Contracting Officer, whenever the information is no longer required by the Contractor for the performance of the work required by the contract, or upon completion of the contract.
(2) The Contractor shall obtain a written agreement to honor the above limitations from each of the Contractor's employees who will have access to the information before the employee is allowed access.
(3) The Contractor agrees that these contract conditions concerning the use and disclosure of confidential information are included for the benefit of, and shall be enforceable by, both Government Accountability Office and any affected business having a proprietary interest in the information.
(4) The Contractor shall not use any confidential information supplied by Government Accountability Office or obtained during performance hereunder to compete with any business to which the confidential information relates.
(b) The Contractor agrees to obtain the written consent of the Contracting Officer, prior to entering into any subcontract that will involve the disclosure of confidential business information by the Contractor to the subcontractor. The Contractor agrees to include this clause, including this paragraph (b), in all subcontracts awarded, pursuant to this contract, that require the furnishing of confidential business information to the subcontractor.
H.4
GAO 52.235-73 CONFIDENTIALITY OF GAO DATA (APR 1984)
Because of the sensitivity and confidentiality of much of the data handled by GAO, the contractor shall maintain confidentiality of all documents, data and other information supplied to it by the GAO, in accordance with all applicable Federal guidelines and regulations. Confidentiality is essential to satisfactory contract performance. Also, specific tasks under this contract may involve processing records or portions of records which GAO treats as confidential, and contain information subject to the GAO Privacy Procedures for Personnel Records, 4 C.F.R. Part 83.
The contractor assumes full responsibility for and guarantees the security of all documents, data, and other information supplied by GAO.
No action taken by, or on behalf of, the contractor, or which the contractor could prevent, will be permitted if the effect is or could be reasonably foreseen to undermine GAO's ability to maintain the security of records created by GAO or which may be subject to the GAO Privacy Procedures.
The contractor will prevent any person other than the contractor's team members (or other persons for whom access is necessary for the completion of the contract) from seeing or having access to information in the possession or under the control of the contractor.
The contractor will prevent any person from disclosing the contents or description of documents or information to any person not authorized under this contract or by the GAO to have access to such documents or information.
The contractor will prevent removal of any documents or information from the contractor's premises without authorization by appropriate GAO officials.
The contractor shall submit to the GAO Contracting Officer, one executed copy of a Non-Disclosure Agreement, Attachment BCS_246, (See Section J, List of Attachments), for each employee assigned to work with GAO confidential material within five (5) working days after notification of award. The Contractor agrees to include similar requirements in any subcontracts which it may enter into regarding or supporting work under this contract and furnish the Contracting Officer one copy of each subcontractor employee's non-disclosure agreement within five (5) working days after its execution. Each GAO Non-Disclosure Agreement must be signed by an authorized Contractor Administrator.
The contractor will report to the GAO Contract Officer any breach of confidence by any person as soon as the breach is known.
The contractor shall assure that all persons handling GAO confidential or sensitive materials has signed the GAO Non-Disclosure Agreement, Attachment BCS_246, and an authorized Contractor Administrator must sign each GAO Non-Disclosure Agreement submitted by each employee assigned to this contract.
The contractor agrees that no contractor or subcontractor employee will be given access to GAO documents or other records unless that employee shall have first executed a Non-Disclosure Agreement.
A Non-Disclosure Agreement, whether submitted prior to or after the award of this contract, shall be binding with regard to information obtained at any time throughout the period of performance of this contract. All Non-Disclosure Agreements are binding indefinitely unless released by a duly authorized official of the GAO. A contractor or subcontractor employee whose employment is continuous need not execute a new Agreement if his assignment to work related to this contract terminates but later resumes.
Any deviation from provisions of this clause which is attributable to the contractor or to persons allowed on the contractor's premises constitutes a material breach of confidentiality and may be sufficient ground for default. Further, the contractor agrees to save the Government harmless in the amount of any judgment against the United States resulting from such a breach. At the Comptroller General's option, the contractor shall assign all of his rights of action against any person to the United States. Disclosure in violation of the Privacy Procedures also may involve the imposition of criminal penalties.
To the extent this contract provides for the operation, on behalf of the GAO, of the system of records to accomplish an agency function, it shall be subject to the requirements of any GAO Order or regulations pertaining to privacy procedures.
H.5
GAO 52.237-71 TECHNICAL DIRECTION (APR 1984)
(a) The Contracting Officer's Technical Representative will provide technical direction on contract performance. Technical direction includes:
(1) Direction to the Contractor which assists him in accomplishing the Statement of Work.
(2) Comments on and approval of reports or other deliverables.
(b) Technical direction must be within the contract Statement of Work. The Contracting Officer's Technical Representative does not have the authority to issue technical direction which (1) institutes additional work outside the scope of the contract; (2) constitutes a change as defined in the "Changes" clause; (3) causes an increase or decrease in the estimated cost of the contract; (4) alters the period of performance; or (5) changes any of the other express terms or conditions of the contract.
(c) Technical direction will be issued in writing by the Contracting Officer's Technical Representative or confirmed by him/her in writing within five (5) calendar days after verbal issuance.
