C - Description/Specifications
EROS Center Statement of Work Security Upgrades
Scope:
Using the Statement of Work (SOW) and attachments as the basis of design, the Contractor shall provide all design and construction labor, materials, and equipment necessary for replacement and relocation of an existing security booth structure at the Mundt Federal Building in support of the “Security Upgrades” project, located at the EROS Science Center, 47914 252nd Street, Sioux Falls SD 57198.
Contractor shall perform all work in accordance with the specifications, drawings, and all applicable Federal, State, and local regulations. This SOW includes:

Section 1 – General Requirements
Definitions
COR – Contracting Officer’s Representative Government - US Federal Government, USGS/EROS Data Center
Statement of Work
Work under this contract shall be performed in accordance with the requirements of this Statement of Work, Attachment A - Project Specifications, and Attachment B - Project Drawings.
Design includes, but is not limited to, the following:
1. Review constructability of proposed main gate curb and roadway layout shown on Drawing C-11 of Attachment B.
2. Provide field survey to verify existing points and elevations and identify new points and elevations for construction of proposed revisions to existing curb and roadway. Survey and layout shall be prepared by Professional Land Surveyor registered in the State of South Dakota.
3. Provide construction drawings based upon results of Survey to the COR for review and approval prior to construction.
Construction includes, but is not limited to, the following:
1. Relocation of existing Security Booth to Service Road West Entrance and provide extension of required underground electrical and communication utility services to new location.
2. Removal of existing curb, gutter, foundation, etc. and construction of new curb, gutter, and foundation to support main entrance Security Booth.
3. Construction of a new South Security Booth for control of the main entrance to the EROS Center facility.

4. Provide three rolling security gates for inbound and outbound traffic at South Security Booth as well as one rolling security gate at the West Security Booth.
5. Provide security fencing as shown for South entrance and West entrance areas.
6. Provide electrical power, lighting, controls, data, and communications cable and equipment for new South Security Booth.
7. Provide heating and air conditioning equipment, ductwork and accessories for new Security Booth.
8. Provide additional sitework as indicated on Attachment B as well as matching existing landscaping in construction areas.
Remove and dispose of off-site all materials shown to be demolished.
Pre-Construction Meeting
After contract award, and prior to start of construction, Contractor shall participate in a pre-construction meeting scheduled with the Contracting Officer. The meeting participants will include Contractor Representatives and Government Representatives.
Submittals
The Contractor shall furnish all required submittals/documentation as outlined in this SOW and Attachments A and B.
The Contractor shall furnish a written construction schedule to the Contracting Officer’s Representative (COR) within two (2) weeks following the pre-construction meeting. Additionally, the Contractor shall submit an updated construction schedule with each request for payment. The schedule shall display events relevant to the work outlined in this requirement.
Times of Work
Normal duty hours are Monday through Friday, 7:30 am to 5:00 pm, excluding Federal Holidays.
Utility Outages
The Contractor shall notify COR whenever work requires shutdown of utilities. Request for utility outages shall be submitted to COR at least 48 hours in advance
Open Flame Work
Prior to any activity utilizing welding, cutting, burning, brazing, soldering, or other process using a torch or open flame, the Contractor shall submit a written request to the COR who will issue the Contractor a hot work permit.
Progress Inspections
During Contractor performance of the contract work, the COR will perform on-site progress inspections of the work.
Theses inspections will occur at any time during the course of the contract, at the discretion of the COR. Progress inspections will be performed by the COR to determine if the Contractor is making reasonable progress toward completing the work in order to meet the scheduled delivery date as set forth in the contract, and to ensure the Contractor is performing work in accordance with the technical requirements as outlined in Attachments A and B.

Inspections and Final Acceptance
See specific inspection and acceptance criteria in Attachments A and B. Final inspection and acceptance for the work shall be performed with the Contractor, on site by the COR upon completion of job performance. The Date of Final Acceptance will be determined by the Government after written notice from the Contractor to the COR that the work has been completed sufficiently to conduct a final inspection.
Parking
Contractor shall obtain temporary parking permits by requesting them from the COR.
Demolition and Removal
See Attachments A and B for demolition requirements pertaining to this project. The Contractor shall be responsible for the complete removal and disposal of all items requiring demolition from the EROS grounds unless the COR directs to have certain items remain on site.
Staging Areas
The Contractor shall coordinate with COR to determine where new equipment and materials can be staged before actual installation.
Measurements
Field verification of all measurements (including counting of items), is the responsibility of the Contractor.
Contractor is responsible for visiting the worksite to verify measurements and to ascertain the nature and location of the work to be performed and the general and local conditions which may affect the work or the cost thereof.
Failure to do so shall not relieve the Contractor of his/her responsibility for estimating properly the difficulty or cost of successfully performing the work. Drawings furnished may not be to scale.

D - Packaging and Marking
D.1 GS0501 PACKAGING AND MARKING - COMMERCIAL PRACTICE (JUL 2001)
(a) Preservation, packaging, and marking for all items delivered hereunder shall be in accordance with standard commercial practice and adequate to insure acceptance by common carrier and safe arrival at destination.
(b) All containers shall be plainly marked on or adjacent to the exterior shipping label to show the contract number, order number (if any), description of contents, and contractor's name.
D.2 PRODUCT DELIVERY - STORAGE-HANDLING
The Contractor shall arrange for deliveries of all materials to be delivered directly to the point of installation.
The Contractor shall be responsible for receiving deliveries on site at EROS, and shall reconcile bills of lading for deliveries of contractor-furnished materials for the contracted project. Government personnel will not be responsible for reconciling bills of lading for contractor-furnished materials delivered to the EROS for a Contractor.
The Contractor shall furnish a Contractor point-of-contact to vendors for receipt of material deliveries. The Contractor shall not provide the names of Government personnel to vendors as the point-of-contact for deliveries.
The Contractor shall be responsible for scheduling and tracking the deliveries of all contractor-furnished materials for the project.

E.7 FINAL INSPECTION AND ACCEPTANCE
Upon completion of the contracted work, the Contractor shall notify the COR. The COR will schedule an inspection of the work site, and will perform the inspection at the site to determine if all work performed by the Contractor meets the requirements of the Statement of Work, Specifications and Drawings. The Contractor shall be present at the site during final inspection by the COR. The Date of Acceptance of the work by the Government will be determined by the Government after the final inspection has been performed.
E.8 INSPECTION BY REGULATORY AUTHORITIES
(a) This project is subject to inspection by the following authorities:
USGS Contracting Officer's Representative (COR) or authorized designee
(b) During performance of the work stated herein, the COR or authorized designee will perform on-site progress inspections of the work. These inspections will occur at any time during the course of the contract, at the discretion of the COR or authorized designee. Progress inspections will be performed by the COR or authorized designee to determine if the Contractor is making reasonable progress toward completing the work in order to meet the scheduled delivery date as set forth in the contract, and to ensure that the Contractor is performing the work in accordance with the technical requirements.
(c) The Contractor shall notify the Contracting Officer when inspections take place. Written decision as to action to be taken as a result of inspections will be made in conjunction with the CO and COR.

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 150 days after notice to proceed. F.6 TIME OF WORK PERFORMANCE
The Contractor shall perform the work during normal business hours 7:30am - 4:00pm, Monday through Friday except for legal holidays and as pre-authorized by COR. Any work required outside the normal business hours requires a forty eight hour (48) written notice to the COR for approval in advance of working.
F.7 SCHEDULE OF CONSTRUCTION
Within five (5) business days from date of contract award, the Contractor shall submit to the COR a written Schedule of Construction for the project. The Schedule shall indicate the anticipated dates that the Contractor will be on site. When preparing the Schedule, the Contractor shall consider lead times for material procurement, and any other factor affecting start/end times of component construction. The Contractor shall notify the COR immediately if any anticipated on-site date is expected to change from the original schedule. The Contractor shall be responsible for determining the labor staffing levels needed to complete the project by the established delivery date.
F.8 PRE-CONSTRUCTION MEETING
After contract award, and prior to start of construction, the Contractor shall participate in a pre-construction meeting scheduled by the Contracting Officer's Representative (COR). The Contractor, at a minimum, shall have the project manager and field superintendent available on site for a pre-construction meeting, prior to the commencement of work for this contract. The COR or authorized designee and CO will conduct the pre-construction meeting to review the requirements and conditions of this contract. The meeting is normally scheduled by the COR within 5 days after contract award.
F.9 SUBMITTALS
The Contractor shall submit the "Product Submittals" required by Attachment A, Specifications, to the COR for approval within ten (10) calendar days after receipt of the notice to proceed.

G.2 GS1125 SCHEDULE OF PRICES (CONSTRUCTION) (JULY 2001)
In accordance with the clause FAR 52.232-05, Payments under Fixed-Price Construction Contracts, the contractor shall, within 10 days after receipt of notice of award, submit to the Contracting Officer for approval, a Schedule of Prices. This schedule shall consist of a detailed breakdown of the contract price, segregated under each of the significant construction categories. It shall state the quantities for each of the various types of work, the unit prices, and extended totals. Subcontractors who may be involved in more than one category of work must provide the same breakout data for each category. The submission of the required data shall not otherwise affect the contract terms.
G.3 PAYROLLS
The Contractor is required to submit copies of all payrolls to the Contracting Officer. The prime contractor is responsible for the submission of copies of payrolls by all subcontractors. This information may be submitted in any form. The optional form (WH-347) may be used, see Davis Bacon Act 52.222-8 (Section I).
G.4 DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements – Internet Payment Platform (IPP) (SEPTEMBER 2011)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.
Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the original contract award date.
Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the contracting officer.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

H - Special Contract Requirements
H.1 GS1305 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM
(CPARS)
(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.
(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm’s past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.
(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at http://www.cpars.csd.disa.mil/. The CPARS User Manual, registration for On Line Training for Contractor Representatives, and a practice application may be found at this site.
(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation and the report will be accessible at http://www.cpars.csd.disa.mil/. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official’s narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 – 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating “No comment” in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: “The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment.” Your response is due within 30 calendar days after receipt of the CPAR.
(f) The following guidelines apply concerning your use of the past performance evaluation:
(1) Protect the evaluation as “source selection information.” After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.
(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, preaward surveys, responsibility determinations, production readiness reviews, or other similar purposes.
(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via

(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.
H.2 GS1306 PERFORMANCE AND PAYMENT BONDS (MAY 2003)
The offeror to whom award is made shall deliver good and sufficient performance and payment bonds (Standard Forms 25 and 25A) to the Contacting Officer, at the addess shown in clause G1101, within 7 calendar days from date of contract award. Bonds must be furnished in the following amounts: Performance bond – 100% of the total contract amount, payment bonds – 100% of the total contract amount.
H.3 GS1326 INDEMNITY (JULY 2001)
The contractor herein is “an independent contractor” and shall obtain all necessary insurance to protect himself from liability arising out of this contract.
The contractor hereby agrees to indemnify and hold the Government harmless in connection with, any loss or liability from damage to or destruction of property or from injuries to or death of persons (including the agents and employees of both parties) if such damage, destruction, injury or death arises out of, or is caused by performance of work under this contract, unless such damage, destruction, injury or death is caused solely by the active negligence of the Government, its agents or employees. The contractor agrees to include this clause, appropriately modified, in all subcontracts to be performed under this contract.
H.4 GS1329 INTERPRETATION OF CONTRACT REQUIREMENTS (JULY 2001)
No interpretation of any provision of this contract, including applicable specifications, shall be binding on the Government unless furnished or agreed to in writing by the Contracting Officer.
H.5 GS1338 NOTICE TO THE GOVERNMENT OF DELAYS (JULY 2001)
In the event the contractor encounters difficulty in meeting performance requirements, or when it anticipates difficulty in complying with the contract delivery schedule or date, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely performance of this contract, the contractor shall immediately notify the contracting officer and the COR (if one has been designated), in writing, giving pertinent details. This data shall be informational only in character. Notice under this provision shall not be construed as a waiver by the Government of any delivery schedule or date or of any rights or remedies provided by law or under this contract.
H.6 GS1352 SUBCONTRACTING RESTRICTION (JULY 2001)
Except as specifically approved in writing, in advance, by the Contracting Officer, the contractor shall not subcontract any work to be performed hereunder. It is contemplated that approval will be given for subcontracting certain phases of the work when, in the opinion of the COR and the Contracting Officer, such subcontracting will not adversely affect the quality or delivery of the final product nor the difficulty or cost of inspection and testing.
Requests for approval to subcontract shall be submitted, in writing, to the Contracting Officer.

H.7 GS1354 LIST OF SUBCONTRACTORS (CONSTRUCTION) (JULY 2001)
For purposes of monitoring compliance with the insurance and payroll reporting requirements of this contract, the contractor shall furnish a listing of all subcontractors to the Contracting Officer within 10 calendars days after contract award.
H.8 GS1366 NONDISCRIMINATION NOTICE TO U.S. DEPARTMENT OF THE INTERIOR
CONTRACTORS, SUBCONTRACTORS, AND LESSORS
(JANUARY 2000)
Based upon law, Executive Order, or internal policy, the Department of the Interior prohibits discrimination in the workplace, including sexual harassment, based on race, color, national origin, sex, religion, disability, age, or sexual orientation. The Department urges its contractors, subcontractors, and lessors to develop and enforce comprehensive anti-discrimination policies for their places of work.
H.9 GS1415 ACCESS TO GOVERNMENT FACILITIES (JULY 2001)
During the life of the contract, the rights of ingress and egress to and from the Government facility for Contractor personnel shall be made available as required. During all operations on Government premises, Contractor personnel shall comply with the rules and regulations governing the conduct of personnel and the operation of the facility. The Government reserves the right to require Contractor personnel to display photographic identification card (such as driver’s license) and sign in upon ingress to and sign out upon egress from the Government facility.
H.10 GS1440 WAGE DETERMINATION APPLICABLE (JULY 2001)
In the performance of this contract, the contractor shall comply with the requirements of U.S. Department of Labor Wage Determination Number SD150034 dated 02/03/2015. The wage determination is incorporated herein by reference.
H.11 REQUIREMENTS FOR THE EXECUTION OF SURETY BONDS
Each surety company bond (performance and payment), which purports to have been executed by an agent or attorney-in-fact for the corporate surety, is required to have submitted with it a power of attorney to the signatory agent of attorney-in-fact and executed by the corporate surety upon a date reasonably proximate to the date of the bond. Such power of attorney shall in each instance be retained with the bond.
H.12 STORAGE OF MATERIALS AND TOOLS
The Contractor may store materials and tools on the job site proper in areas designated by COR. The Contractor is advised to secure materials, tools, gang boxes, etc. as effectively as possible during the period of work, using Contractor-supplied locking devices. The Government shall not be responsible for damaged, lost or stolen equipment, materials, tools, gang boxes, etc.
H.13 CONTRACTOR PERSONNEL CLEARANCE/ IDENTITY CREDENTIALS
(a) During all operations on Government premises, contractor personnel shall comply with the rules and regulations governing the conduct of personnel and the operation of the facility.
(b) USGS rules regarding physical security and personnel security apply to all personnel in USGS facilities. The rules are contained in the following directives, available at http://www.usgs.gov/usgs-manual/handbook/index.html:

(c) At least 2 weeks before starting work, the contractor will provide a listing and documentation to the COR/technical liaison identifying contractor and subcontractor employees requiring access to USGS facilities or http://www.usgs.gov/usgs-manual/handbook/index.html
G15PS00500 EROS Security Booth Project Page 18 of 51 systems for performance of work hereunder. The contractor and or subcontractors will comply with U.S. 8 CFR Part 274a. The contractor and or subcontractors will provide documentation to validate the employment status to the Contracting Officer’s Representative. In the event of additional contract or subcontract staff the same documentation as per U.S. 8 CFR 274a will be required prior to admittance of the personnel to the facility.
(d) The Government will be the final authority in determining access privileges. The Government’s exercise of its right to grant and revoke the access of particular individual(s) to its facilities, systems, or parts thereof shall not constitute a breach or change to the Contract, regardless of it impact on any individual’s ability to perform work under the Contract.
(e) When any of their personnel leaves the company’s employ, is reassigned to other work, or otherwise no longer requires access to USGS facilities or USGS computer systems, the contractor shall immediately advise the USGS COR so that those user accounts and credentials can be cancelled. The contractor will ensure that the ID badge and keys (if any) are retrieved and promptly returned to the COR, who will forward them to the issuing USGS security official. The COR must be notified in advance of any potentially unfriendly termination of an employee or subcontractor.
(f) The contractor will report any lost keys or badges to the COR within 24 hours. The COR will relay the information to the responsible building security officials. All badges and keys shall be returned to the COR at the completion of this contract.
(g) The requirements of this clause must be included in any subcontracts in which subcontract workers will need building or unsupervised system access as described in paragraph (b).
H.14 SECURITY
(a) General Security Requirements
(1) Clearances: The Contractor shall be required to comply with security regulations imposed by the occupying agency including any necessary clearances. After award, all Contractor employees will be required to furnish information for security clearances and comply with security regulations as imposed by the occupying agency.
(2) Notification: The Contractor shall notify the Contracting Officer, or his designated representative, not less than seven (7) days prior to first performing work at the site. Additional notifications shall be submitted not less than 72 hours prior to performing work at the site. Include the following:
(i) Names: Provide the names and government issued identification such as a state issued driver’s license of all individuals who are to work under this contract.
(ii) Time: The exact time and hours of work.
(iii) Areas: Specific areas of the building in which work is to be performed.
(3) Nonpublicity: It is a specific condition of this contract that the Contractor, or any Subcontractors performing work on this project shall not use or allow to be used any aspect of this project for publicity or advertising brochures.
(b) Agency Security Regulations
(1) All persons employed within the boundaries of the property or restricted-access areas therein, and all persons permitted to enter such property and areas shall comply with the security regulations that have been established for this contract.
(2) The Contractor agrees on behalf of himself and all subcontractors that the security regulations contained herein will be observed by Contractor personnel on the property. The Contractor shall make it a specific provision of his subcontracts that these regulations be accepted.
(3) At the commencement of the work under this contract, the security facilities and procedures described in the
G15PS00500 EROS Security Booth Project Page 19 of 51 following sub-paragraphs will apply to the Contractor and all Subcontractors.
(A) Do not enter the building without building passes or park without parking permits as required in this section.
(B) Carry out the specific security regulations of the building.
(C) In the case of any questions as to the eligibility of an individual to obtain a pass, notify the Contracting Officer, who will obtain a determination whether the individual can obtain a pass.
(D) The U.S. Geological Survey also reserves the right to close down the job site and order Contractor personnel off the premises in the event of a national emergency or a shut-down, as long as security problems persist. The Contractor may only return to the site with verbal approval from the Contracting Officer.
(E) The Government reserves the right to exclude or remove from the site or building any employee of the Contractor or Subcontractor whom the Government deems incompetent, careless, insubordinate, or otherwise objectionable or whose continued employment on the work is deemed by the Government to be contrary to the public interests. The Government further reserves the right to complete processing of security documentation for Contractor personnel assigned to work within restricted access areas prior to access to such areas by Contractor personnel.
H.15 TRANSPORTING DEBRIS AND MATERIAL
The Contractor shall provide all equipment necessary for transporting construction debris from the job site and for the stocking and transporting of materials. The Government shall provide space designated by COR for positioning of dumpsters. The Contractor shall provide material handling equipment needed for the project. The Contractor shall ensure that all such equipment is marked clearly with the company name, initials, or logo. The Contractor shall not make use of USGS equipment for transporting materials or debris.
H.16 SUBCONTRACTOR CONTROL
The Contractor shall be the Prime Contractor in all cases. The contractor shall contact the COR to make all arrangements for Subcontractor personnel to gain access into the building. The Contractor shall bear complete responsibility of the work of Subcontractors, and shall supervise, direct and control the work of Subcontractors at all times.
H.17 ORGANIZATION AT THE SITE
The Contractor shall utilize the areas only within the project limits to perform work and for the storage of equipment, materials, and trailers during the life of the contract. Storage will be confined to areas approved by the COR or authorized designee.
The Contractor shall be responsible for the security of all tools, materials, and equipment.
The Contractor shall maintain all areas in a clean organized manner.
Upon completion of the contract, the Contractor shall remove all equipment and excess materials, except as otherwise specified, and shall restore the site to its original condition, as approved by the COR or authorized designee, at no additional cost to the Government.
H.18 CONTRACTOR PARKING
Parking directions shall be provided to the Contractor by the COR or authorized designee at the pre-construction meeting or as requested by the Contractor in writing. The Contractor shall keep personal vehicles to a minimum.

H.19 BUILDING SPECIFIC SECURITY REGULATIONS
(a) Standards of Conduct
The Contractor shall be responsible for maintaining satisfactory standards of employee competency, conduct, appearance, and integrity, and shall be responsible for taking such disciplinary action with respect to his/her employees as may be necessary. The Contractor is also responsible for ensuring that his employees do not disturb papers on desks, open desk drawers or cabinets, or use Government equipment, including computers and telephones, except as authorized.
(b) Removal from Duty
The Government may request the Contractor to immediately remove any employee(s) from the work site(s) should it be determined that the individuals are being assigned to duties who have been disqualified for either suitability or security reasons, or who are found to be unfit. All identification cards, keys, cardkeys, and parking permits are to be immediately collected and returned to the Contracting Officer’s Representative. For clarification, a determination of unfit may be made from, but not be limited to, incidents involving the most immediately identifiable types of misconduct or delinquency as set forth below:
(1) Violation of the Rules and Regulations Governing Public Buildings and Grounds, 41 CFR 101-20.3000.
(2) Falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records, or concealment of material facts by willful omission from official documents or records.
(3) Disorderly conduct, use of abusive or offensive language, quarreling, intimidation be words or actions, or fighting. Also participating in disruptive activities, which interfere with the normal and efficient operation of the Government.
(4) Theft, vandalism, immoral conduct, or any criminal actions.
(5) Selling, consuming, or being under the influence of intoxicants, drugs, or substances, which produce similar effects.
(6) Unauthorized use of communications equipment of Government property.
(7) Violation of security procedures or regulations.
(8) Failure to cooperate with Government official or local law enforcement authorities during an official investigation.
The Contracting Officer or his designated representative will make all determinations regarding the removal of any employee(s) from work site(s) based upon a report from the appropriate security authority. Specific reasons for removal of an employee(s) will be provided to the Contractor in writing.
(c) National Security Clearances for Contractors and Consultants
Contractor employees and others engaged in U.S. Geological Survey (USGS) contracts shall neither require nor be given access to national security information.
H.20 GS1417 UTILITIES PROVIDED (JULY 2001)
For the purpose of this contract, utilities such as water, electricity, etc., will be furnished by the Government at no cost to the contractor. The contractor will be required to participate in all USGS utility conservation programs.
Long distance, FTS telephone services, fax and e-mail will not be provided.

H.21 UTILITIES
The Government shall provide water and electricity to the Contractor from existing Government sites only. The Contractor shall provide portable restroom facilities for the project.
H.22 WEARING OF IDENTIFICATION
All Contractor personnel will be required to display photo-identification when entering the EROS Data Center.
Upon entry into the building, all personnel will be scanned by magnetometer and all packages, bags, etc. will be x-rayed by Linescan machine. Upon satisfactory scanning and acceptance of a photo-identification by the Guard Service, Contractor personnel will be issued a green/white self-stick Visitor Badge that must be worn on exterior clothing and be visible at all times.
