This solicitation will utilize the policies contained in the Federal Acquisition Regulations (FAR) Part 12 in conjunction with the policies and procedures for solicitation evaluation and award prescribed in FAR Part 13, Simplified Acquisition Procedures, as appropriate for this acquisition.
Specifications for Digestion Block
I. Technical Specifications:
Block digestion systems are being requested and will be used to digest environmental water samples in preparation for the simultaneous determination of total Kjeldahl nitrogen (TKN) and total phosphorus (TP) on a high volume-production line. Block digesters shall meet requirements of the method of Patton and Truitt, 2000. These specifications shall be met or exceeded in order to fulfill NWQL requirements:
a. Quantities: Six individual 50 position digestion blocks with six 50 position tube racks, 12 additional 50 position tube racks, and 900 straight sided 100 mL digestion tubes
b. System:
i. Each individual tube rack and digestion block shall accommodate a minimum of
50 samples in 100 mL volume test tubes.
ii. Each block digester shall be an integrated system consisting of a digestion heating block, cooling rack, and temperature control unit. Each digestion block shall include a tube rack and temperature control unit with the purchase of the block.
iii. 12 additional tube racks for a combined total of 18 tube racks when including the six racks that are included with the digestion blocks.
iv. 900 straight sided 100 mL borosilicate digestion tubes that fit the tube racks and digestion blocks.
v. The system shall not include a scrubber manifold with the purchase of the digestion block. The system shall instead be able to operate within our existing fume hood which is already fitted with a Kjeldahl digestion scrubber. The system shall not require the purchasing of an additional scrubber for safe operation.
vi. The system shall have a temperature heating range covering all temperatures between ambient and 450 °C.
vii. The system shall have a temperature set point accuracy of ±2 °C for all holding temperatures within the operation range for the required digestion times. This currently includes holding at 220 ±2 °C for 45 minutes and 370 ± 2 °C for 15 minutes.
viii. Shall guarantee the system will provide even heating across the block. This means the temperature may vary by no more than ±2 °C for all samples throughout the block during heating. This shall be true for all temperatures within the specified operating range.
ix. The system shall include a cooling stand that can hold the tube rack with samples for cooling after digestion is complete. A total of six tube rack cooling stands are required to accompany the requested six digestion blocks.
x. The system shall accommodate 100 mL sample test tubes with a 25 mm O.D.,
21.5 mm I.D., and 255 mm height.
xi. Sample test tubes shall be maintain their integrity through at least 100 temperature cycles as described in Patton, C.J., and Truitt, E.P., 2000.
xii. Sample test tubes and racks shall be able to be cleaned using the existing Kjeldahl test tube and rack cleaning protocol. This includes being able to clean the test tubes upside down in their racks within an industrial dishwasher between uses.
xiii. The heating block shall be able to digest 25 test samples at the long-term method detection level (LT-MDL) for both total Kjeldahl nitrogen (i.e. 0.07 mg/L) and total phosphorus (i.e. 0.02 mg/L) and obtain results within ±10% of the true value. This shall be accomplished with the test LT-MDL samples dispersed throughout the heating block between field samples.
xiv. Blank samples interspersed throughout the heating block with field samples shall not be contaminated by the tubes or other samples: Post digestion measured blank values shall be ≤0.02 mg P/L and ≤0.05 mg N/L.
xv. Complete digestion shall be accomplished for samples containing up to 2.00 mg P/L and up to 5.00 mg N/L.
xvi. The digestion block system shall use a power supply with an operating range of 200-260 V (50-60 Hz).
c. Software (optional):
i. Shall be compatible with Windows 7 and higher operating systems.
ii. The software shall have a safety power cut out to protect from overheating.
iii. The software shall be able to run the digestion block unattended from the start until the end of the digestion time.
iv. The software shall be able to create and store multiple digestion methods.
v. Software shall allow for simple user control of method parameters including digestion holding temperature and temperature holding time.
d. Sensitivity, accuracy, and reproducibility:
i. Digestion blocks will be evaluated for sensitivity, accuracy, and reproducibility using two test digestions to include a minimum of seven quality control samples, seven quality assurance samples, and 25 method detection limit samples as describe below for both total Kjeldahl nitrogen and total phosphorus.
ii. Total Kjeldahl Nitrogen (TKN)
1. Quality control samples in the range of 1.25 – 3.75 mg/L shall be within
±10% of the most probable value (MPV). Quality assurance samples in the range of 1.00 – 1.80 mg/L shall be within ±10% of the MPV.
2. Results of TKN digestion (n=7) shall be within 10% of the MPV at the 95% confidence level when measured at the LT-MDL or 0.07 mg/L.
iii. Total Phosphorus (TP)
1. Quality control samples in the range of 0.50 – 1.50 mg/L shall be within
±10% of the most probable value (MPV). Quality assurance samples in the range of 0.40 – 0.60 mg/L shall be within ±10% of the MPV.
2. Results of TP digestion (n=7) shall be within 10% of the MPV at the 95% confidence level when measured at the LT-MDL or 0.07 mg/L.
II. General System Specifications:
a. Vendor shall comply with all USGS and Department of Interior computer security protocols and requirements.
b. Vendor shall certify that all software and hardware are free of malicious code.
c. Vendor supplied software shall not interfere with the operating system’s assistive technologies.
d. System shall have a minimum one-year warranty which starts on the date of instrumentation acceptance; the warranty period shall not start on the date of instrumentation shipping or on the date of installation.
III. Acceptance Criteria:
a. Standard solutions and standard reference materials may be used to verify that (a) the system meets the specifications described above, and (b) the system meets the sensitivity requirements for the TKN and TP methods. See System Description under Technical Specifications for criteria that will be used. If these specifications are not met the instruments will be deemed unacceptable.

52.212-2 Evaluation -- Commercial Items (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. The government seeks to purchase the best value instrument that supports and enhances the ability of the laboratory to accomplish its science mission. The NWQL is a fee-for-service organization that relies on customer samples to fund continuing operations. Therefore, instrumentation used by the laboratory shall contribute to the efficient and effective operation of the laboratory while providing high quality, reproducible scientific analyses. The best value instrument will provide ease of compatibility with existing laboratory procedures. Best value will be based upon: the ability of the contractor to meet or exceed all of the technical specifications, compatibility with NWQL’s current methods, efficiency with minimal training of analysts, and the efficiency with regard to instrumentation reliability, maintenance required, and ability for unattended operation.
2. Technical Capabilities: The contractor shall include the company’s technical brochure, referencing the specific equipment and capabilities referenced in the first three pages of this document including temperature range, temperature accuracy, temperature evenness through the block, power requirements, dimensions, and automation capabilities.
3. Past Performance (quality, timeliness, and business relations): The contractor shall submit references from two (2) customers that have purchased similar equipment and services within the last three years.
Contractors shall provide a point of contact name, phone number, and company address for those references. Statements by past clients may be used in the evaluation of the contractor's technical quote under any and all applicable evaluation criteria. Any information obtained by the Government from references outside the contractor's quote may be used in a similar manner.
Award:
The award of this requirement shall be made using the policies in FAR Part 12 in conjunction with the policies and procedures found in Part 13.1 – “Procedures” of the Federal Acquisition Regulations (FAR).
Award shall be made to the vendor whose quotation, conforming to this RFQ, is determined to be the most advantageous to the government, cost or price and the other non-cost or non-price factors listed above. In determining which quotation offers the greatest value or advantage to the Government, overall technical merit will be considered more important than price or cost. The degree of importance of price or cost as an evaluation factor will increase with the degree of equality in the technical merits of the quotations. Between acceptable quotations with a significant difference in technical merit, a determination will be made as to whether the additional technical merit or benefits reflected by a higher priced quotation warrants payment of the additional price or cost.
Quotation Preparation
The vendor is cautioned to study the Evaluation Factors stated above along with their relative importance.
Your quotation package shall address each of these factors since these are the standards against which your quotation will be evaluated. It is the vendor’s responsibility to include the appropriate documentation in its quotation package to allow a complete technical/price evaluation. Failure to submit the appropriate documentation may result in the rejection of the vendor’s quotation.

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (APR 2013)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.
Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
GS1117 Deobligation of Unexpended Funds MAY 2013
The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer.
After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. 52.212-3 Offeror Representations and Certifications -- Commercial Items (MAR 2015)
The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service— http://www.acquisition.gov/
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror.
Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).
Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C.
101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern --
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
