I. GENERAL INFORMATION

A. Introduction.

The U.S. Geological Survey, WRD, Kansas Water Science Center, Organic Geochemistry Research Laboratory (OGRL) has a requirement for a multi-year service contract for an AB/ Sciex API 5500 triple quadrupole mass spectrometer (TQMS).

B. Background.

The OGRL is a $1.3 million dollar per year research laboratory investigating the occurrence, fate, transport, and effects of a variety of herbicides, pesticides, insecticides, emerging contaminants, and cyanotoxins in ground and surface waters, manures, biosolids, soils, and sediments. OGRL’s mission is highly dependent on the instrumentation which includes an AB/Sciex API 5500 TQMS. This instrument is tasked with sample loads which require this instrument to be fully utilized 24 hours a day/7 days a week. Continuous instrument operation, proper maintenance, and prompt repair is critical for the OGRL to fulfill its mission and obligations to collaborators which include multiple USGS programs and centers and also municipal, state, federal, and international funding sources. The API 5500 TQMS current warranty just expired.

C. Definitions/Applicable Documents.

i. Repaired – Defined for purposes of this document as the OGRL API 5500 TQMS meeting or exceeding OEM specifications and the instrument meets all of the OGRL’s minimum reporting and detection level specifications as defined in section I.C.iii.

ii. OEM Specifications for an Applied Biosystems/MDS Sciex API 5500 triple quadrupole mass spectrometer (source Applied Biosystems/MDS Sciex API 5500 Installation Guide, Document Number: D1000036325 D, May 2005) – all ranges and setting tolerances shall be adhered to in order for OGRL to consider the instrument in compliance with OEM specifications.

iii. After meeting OEM specification, the instrument usability for normal work may be tested. If the performance for normal work is still adversely affected, by using selected compounds that OGRL has benchmarked through infusion, service shall continue on the instrument until the OEM and OGRL specifications are met.

D. Scope (state general purpose, objectives, magnitude).

The U.S. Geological Survey, WRD, Kansas Water Science Center, Organic Geochemistry Research Laboratory (OGRL) has a requirement for a service contract for an Applied Biosystems/MDS Sciex API 5500 triple quadrupole mass spectrometer. All parts, labor, and travel are considered as included items for purposes of this agreement.

II. WORK REQUIREMENTS

A. Technical Requirements.

USGS reserves the right to request specific contractor engineers.

2. The contractor shall guarantee that they have direct access to API 5500 factory certified engineers that may be required for repairs. Non-compliance may be grounds for terminating this contract.

3. The contractor shall provide an equivalent loner instrument from the same manufacturer if a repair cannot be completed on the API 5500 TQ within 14 working days from the time the service call was logged.

4. The service contract shall at a minimum include the following:

a. Two scheduled preventative maintenance (PM) visits per year to be spaced not less than 6 months apart. PM visits may be requested by OGRL staff at alternate times, but generally one visit shall fall in the second quarter of the fiscal year and the second visit in the fourth quarter of the fiscal year. Preventative maintenance services shall include at minimum the following:

To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(2)(i) If a Contractor has legally changed its business name, "doing business as" name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in FAR subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to (A) change the name in the SAM database; (B) comply with the requirements of subpart 42.12; and (C) agree in writing to the timeline and procedures specified by the responsible Contracting Officer. (3) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see Subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the SAM database. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the "Suspension of payment" paragraph of the EFT clause of this contract.
