C.1. Performance Work Statement

I. GENERAL INFORMATION

A. Introduction Petrographic thin sections of core samples that will be used for microscopic examination are needed for up to six hundred (600), representative core samples. The core and well-cuttings (small rock chips) samples are to be generated from a new Cretaceous well and multiple Floridian Aquifer wells to be drilled or existing in southern Florida.

B. Background Petrographic thin-section analysis has been used for core sample description and aquifer characterization by the United States Geological Survey Florida Water Science Center (USGS FLWSC) in Fort Lauderdale, Florida, for about the last 17 years. The utilization of petrographic thin-section analyses has proven to be essential to understanding the hydrogeology of the aquifers in southern Florida. The need for similar analyses using petrographic thin sections has increased considerably with the initiation of a five-year, large-scale regional aquifer study of southern Florida in summer 2014. Many hundreds of petrographic thin sections will be required to complete the objectives of the five-year study, which will utilize a new Cretaceous well and multiple Floridian Aquifer wells to be drilled or existing in southern Florida.

C. Definitions/Applicable documents A thin section (or petrographic thin section) is a laboratory preparation of a rock, mineral, soil, pottery, bones, or even metal sample for use with a polarizing petrographic microscope, electron microscope and electron microprobe. A thin sliver of rock is cut from the sample with a diamond saw and ground optically flat. It is then mounted on a glass slide and then ground smooth using progressively finer abrasive grit until the sample is only 30 micrometers thick. Thin sections are prepared in order to investigate the optical properties of the minerals in the rock. This work is a part of petrology and helps to reveal the origin and evolution of the parent rock. Well cuttings are the soil, rock fragments, and pulverized materials that are removed from a drilled borehole.

D. Scope The vendor is required to produce one (1) petrographic thin section for each core or well-cuttings sample submitted to them by the USGS FLWSC.

II. WORK REQUIREMENTS

A. Technical Requirements

1. Description of specific work requirements and/or work products:

The vendor is required to produce standard sized thin section for each sample submitted to them by the USGS FLWSC. The quantity of thin sections will be up to 600 produced. Pre-cut core or bagged cuttings samples will be shipped to vendor by the USGS FLWSC in batches of approximately 50 samples and thin sections sent back to the USGS FLWSC, Fort Lauderdale, Florida in batches of approximately 50 samples. Specific technical requirements for each thin section are:

1. 27x46 mm slide—standard size

2. Slide composition of glass

3. Acrylic mounting composition

4. No glass cover slips to be installed

5. Microprobe quality polish on one-side of sample surface opposite of glass slide

6. 30-µm rock slice thickness

7. Vacuum embedding of epoxy into each rock sample

8. Use blue dye to color embedding epoxy

9. Mark the stratigraphic orientation and sample number on the glass slide of each thin section

10. Delivery of product will be within 6 weeks of vendor’s receipt of core or cuttings samples.

2. Criteria for acceptance of Product or Service:

Product must meet industry standard thickness of 30 micrometers (µm) across the entire length and width of the thin section. The USGS FLWSC will check for accurate standard birefringence of quartz and calcite mineral grains for each thin section.

B. Deliverables

1. Deliverables include up to six hundred (600) thin sections stored in sturdy storage boxes over a period of one year.

(a) The performance required herein shall be subject to the technical direction of the Technical Liaison (TL) as identified below. As used herein, "technical direction" is defined as direction to the contractor that fills in details, suggests possible lines of approach, or otherwise supplements the scope of the work set forth herein and shall not constitute a new assignment, and does not supersede or modify any article or clause of this contract.

(b) The Technical Liaison is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government. Only a warranted Contracting Officer is authorized to obligate funds on this or any other contract action.

(c) The contractor shall immediately notify the Contracting Officer in writing if the Technical Liaison has taken an action (or fails to take action) or issues direction (written or oral) that the contractor considers to exceed the above limitations.

G.2. GS1104 AVAILABILITY OF FUNDS UNDER CONTINUING RESOLUTION JULY 2001

(a) In the event funding is appropriated under one or more Continuing Resolutions covering less than the full fiscal year, the Contracting Officer will advise the Contractor in writing of the amount of funds available and the period of performance covered by such funding. Under a Continuing Resolution, the contract price will be prorated for the period of time covered by the Continuing Resolution.

(b) The Government's obligation under this contract for performance after the period covered by any Continuing Resolution is contingent upon the availability of additional appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment in excess of the amount obligated hereunder may arise until funds are made available to the Contracting Officer for this contract and the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. Until such notice is received, the contractor is not obligated or authorized to continue performance beyond the period covered by previously obligated funds.

(c) In the event of a lapse in funding upon expiration of an annual appropriation or Continuing Resolution, the contractor will not be paid for any costs incurred during the unfunded period, including unrecovered indirect costs, unless and until funds are appropriated and authorized for retroactive payment of Government employees and contractors. If nonavailability of contract funding requires the contractor to suspend work, the contractor will entitled to an equitable adjustment under the clause FAR 52.242-14, Suspension of Work, if and when the Contractor is notified by the Contracting Officer that additional appropriations are available to resume performance under the contract.

(d) If the Government has not provided additional funds to resume performance within 30 days after expiration of the period established in (a) above, the contractor may, by written notice, require that the contract be considered to be completed without prejudice to him or further liability to the Government. Such a termination shall not be considered to be a termination for convenience under the terms of the clause FAR 52.249-02, Termination for Convenience of the Government.

(e) The provisions of this clause also apply in the event future full year appropriations are not available for funding of option periods.

G.3. DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Internet Payment Platform (IPP) (September 2011)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

G.4. Unilateral Deobligation of Unexpended Funds (May 2013)

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

G.5. NOT TO EXCEED INSTRUCTIONS

The contractor shall maintain a continuing record of charges against this order. When 80% of the total "not-to-exceed" amount of this order has been reached, notify the contact person below before proceeding further. This notification is required to ensure that the total labor, materials and travel do not exceed the amount obligated on this order. Charges in excess of the total "not-to-exceed" amount of this order will not be paid unless approved in writing by the Contracting Officer.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or constructive placement as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including piggyback) is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for heavy or bulky freight.

When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(b) The Contractor shall -

(1)(i) Pack and mark the shipment to comply with contract specifications; or

(ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements;

(2) Prepare and distribute commercial bills of lading;

(3) Deliver the shipment in good order and condition to the point of delivery specified in the contract;

(4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract;

(5) Furnish a delivery schedule and designate the mode of delivering carrier; and

Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
