About this file
This document is a justification and approval for use of other than full and open competition. It details a sole source contract award to Resodyn Acoustic Mixers for resonant acoustic mixer equipment including mixing vessels and associated equipment needed for a RAM-5 mixer. The estimated dollar value of the contract is $555,445.40. The justification cites 10 U.S.C. 2304(C)(1) and FAR 6.302-1, stating that Resodyn is the only responsible source that can provide mixing vessels and equipment that can safely operate continually at the resonance frequency of the RAM-5 mixer, as they hold the patent for this unique mixing technology and have the required design expertise and testing capabilities. Sources sought and synopsis notices from March and April 2021 generated no expressions of interest from other sources. The contracting officer will determine if costs are fair and reasonable using FAR Part 12 analysis prior to award.

DEPARTMENT OF THE NAVY
NAVAL SURFACE WARFARE CENTER
INDIAN HEAD EXPLOSIVE ORDNANCE DISPOSAL TECHNOLOGY DIVISION
3767 STRAUSS AVENUE
SUITE 201

J&A Number: FY21-MAY12-21 Code:026F
Contracts Department - Form 13 (Rev 5/18)
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, NSWC Indian Head Division, Contracts Office Code 026.
2. Description of the Action Being Approved
This action will award a Firm Fixed Price (FFP) contract as a sole source to Resodyn Acoustic Mixers on a basis they are the only responsible source for Resonant Acqoustic Mixer (RAM) equipment. Resodyn will manufacture mixing vessels and associated equipment needed for the RAM-5 mixer at NSWC IHD.
The prime contractor for this effort is:
Resodyn Acoustic Mixers 130 North Main Street, Suite 630 Butte, Montana 59701
3. Description of Supplies/Services
Mixing vessels and lids of varying capacity are needed to improve adaptability of RAM-5 mixing batch production processes. Associated equipment, such as gaskets and clamp assemblies, are needed to accommodate multiple consecutive mixes.
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
“SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104”
Estimated Dollar Value1 Totals
CIP $555,445.40
Total $ 0 $555,445.40
4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C.2304(C)(1), as implemented by FAR 6.302-1 – Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Unlike most traditional mixers, which use mixing blades or impellers, RAMs vibrate the mixing vessel to mix their contents. A RAM mixer adjusts the vibration frequency to match the resonance frequency of the vessel, which results in a powerful mixing action.
The resonance frequency is immediately adjacent to the natural frequency of a system. All mechanical systems have a natural frequency at which they vibrate at low amplitude.
Continual vibration at this resonance frequency increases the amplitude of natural vibrations in, for example, a mixing vessel, causing large deflections in the walls of the vessel.
RAM mixers harness the deflections to mix their materials.
Large defelctions in the walls of a mixing vessel at this resonance frequency puts significant stress on the vessel.
In addition, the RAM-5 mixer is more powerful than other RAMs, putting even more stress on the vessels. Such considerable forces require unique test capabilities to ensure the vessels do not rupture.
Resodyn holds the patent for this unique mixing technology.
At the moment they are the only supplier with the design

expertise and test capabilities to ensure their mixing vessels can safely operate continually at the resonance frequency.
Resodyn designs their mixing vessels and systems from the “ground-up” using their proprietary Process Development Services. They are the only supplier capable of verifying and validating their vessel designs using their proprietary computational mixing software, as well as functioning RAMs themselves.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A Sources Sought notice was posted on 15 March 2021 to the beta.SAM website to satisfy requirements for Defense Acquisition Regulation Supplement 206.302-1(d). 0 responses were received.
The Government also synopsized the proposed contract on 22 April 2021 via the beta.SAM website. There were no expressions of interest.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine whether the cost to the Government for the supply end items covered by the J&A is fair and reasonable by using cost and price analysis techniques described in FAR Part 12, prior to award.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC IHEODTD has no plans to compete future contracts for the type of supply end item required.
