About this file

This document is a justification and approval for use of other than full and open competition for a federal contract award. The Naval Sea Systems Command, Naval Surface Warfare Center, Port Hueneme Division intends to award a sole source contract to Rochester Electronics LLC for the purchase of 10,000 obsolete Texas Instruments Microcircuits part number TMS320F240PQA and 15,236 obsolete Maxim Integrated Products Microcontrollers part number MAX6413UK44. These parts are required to manufacture microcontroller and sensor board products and there are no suitable alternatives. Texas Instruments and Maxim Integrated Products are the original equipment manufacturers for these parts and Rochester Electronics is the only authorized reseller able to provide the obsolete items. The total estimated value of the contract is approximately $$$ and is funded from Fiscal Year 2020 appropriations.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Port Hueneme Division, (NSWC PHD).

2. Description of the Action Being Approved

NSWC PHD intends to award a new sole source contract on a Firm-Fixed-Price basis for other than full and open competition to Rochester Electronics LLC, 16 Malcolm Hoyt Drive, Newburyport, MA 01950 for an end-of-life purchase of 10,000 Texas Instruments Microcircuits part number (p/n) TMS320F240PQA and 15,236 Maxim Integrated Products Microcontrollers p/n MAX6413UK44.

3. Description of Supplies/Services

NSWC PHD and Air Dominance Department (Code A107) require Texas Instruments Microcircuit TMS320F240PQA and Maxim Integrated Products Microcontroller MAX6413UK44 provided by Rochester Electronics. TMS320F240PQA and MAX6413UK44 are used to manufacture the Microcontroller CCA and SBR/29V respectively.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The total estimated value of the requirement is and is composed of the following funding sources reflected in Table 1 below:

Table 1

Fund Type Year: FY20 Total Contract

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. Section 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1; The proposed action may be awarded on a sole source basis under the authority of FAR Subpart 13.5 for certain commercial items

NSWC-PHD-JA-20-25

Code: 0243

(section 4202 of the Clinger-Cohen Act of 1996). The specific statutory justification permitting other than full and open competition is, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Rationale Justifying Use Of Cited Statutory Authority

Texas Instruments is the OEM for the Microcircuit TMS320F240PQA. Maxim Integrated Products is the OEM for the Microcontroller MAX6413UK44. Both parts are currently obsolete. Rochester Electronics has been identified as the only reseller authorized by the OEMs that is able to provide these obsolescent parts.

An attempt to identify and qualify alternate parts (other than Texas Instruments Microcircuit TMS320F240PQA or Maxim Integrated Parts Microcontroller MAX6413UK44) that will meet the requirements will cause a substantial duplication of cost to the Government that is not expected to be recovered through competition.

Specifically, the Navy would incur a non-recurring cost of in order to identify and qualify alternate sources with the capability to produce the required equipment which would not be able to be recovered through competition. The estimate derives from Baseline VII Tech Refresh efforts from 2011-2016 which included taking steps to ensure that any new sources are capable of producing a product that meets the established performance requirements, which include the Government incurring costs to conduct First Article Tests, Confidence and Functional testing for form, fit and function.

If the alternate part is determined to be qualified, then all applicable documentations will need to be updated through Engineering Change Process (ECP) to introduce the new alternate part.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Sources Sought was posted on Beta.SAM from 2/18/20 – 03/02/20. No companies responded saying they were interested in this requirement.

7. Determination Of Fair And Reasonable Price

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by this J&A is fair and reasonable.

8. Actions To Remove Barriers To Future Competition

For the reasons set forth in Paragraph 5, NSWC PHD has no plans at this time to compete future contracts for the types of supplies covered by this document. If any potential sources emerge, the Government will assess whether competition for future requirements is feasible.
