Soliciting from a Single Source Documentation – FAR 13.5

(1) Agency and Contracting activity:

The Office of Personnel Management (OPM) intends to solicit on the basis of only one responsible source and no other supplies or services will satisfy the agency’s requirements. The following rationale is provided in accordance with (IAW) the requirements of FAR 13.501(a)(1)(i) which authorizes Contracting Officers to solicit from one source if it’s determined that the circumstances of the contract action deem only one source is reasonably available. Accordingly, OPM’s Office of Procurement Operations (OPO) proposes to enter into a non-competitive contract in support of the OPM Office of the Inspector General (OIG)’s mission. This documentation is prepared using the format at 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 were used IAW 41 U.S.C. 1901.

(2) Nature and/or description of the action being approved

A firm-fixed price (FFP), sole source contract to Wolters Kluwer Financial Services, Inc.

to provide the required services for a base period of twelve (12) months and four (4) twelve (12) month option periods is contemplated.

(3) Description of Supplies/Services & Estimated Value

The proposed contract action is for the renewal of 75 licenses of the TeamMate Audit Management (AM) software.

The total estimated value of this contract is

Base Year Option Year 1 Option Year 2 Option Year 3 Option Year 4 Total

(4) Identification of Authority Permitting Other than Full and Open Competition

FAR 13.501 (a)(1)(i) – Only One Source Reasonably Available and FAR 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

(5) A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the use of the authority cited

TeamMate is an Audit Management Software System that includes, Risk-Based Auditing, Resource Scheduling, Electronic Work-paper Management, Audit Issue Tracking, Audit Committee Reporting, and Time and Expense Reporting.

TeamMate’s audit management software system increases the efficiency and productivity of the entire internal audit process, including: risk assessment, scheduling, planning, execution, review, report generation, trend analysis, audit committee reporting and storage. By providing an integrated paperless strategy for managing audits, TeamMate's audit software eliminates the barriers associated with paper-filled binders and disconnected electronic files, driving efficiencies into all facets of the internal audit workflow. The above software is used in OIG investigations requiring any type of audit report. This software was approved for use by the OIG, by the OIG Information Technology Systems Group (ITSG) and continued use of TeamMate is required in order to efficiently manage their audit work.

The purchase of a single software that focuses on the entire auditing process is more advantageous to the government than buying several different types of software. The TeamMate software is already in use by multiple departments and changing the software, to include the implications of migrating or transferring all of the information that currently resides in the system, would be cost prohibitive, time consuming, and would increase performance risk to the agency by delaying ongoing audit activities. Changing the software provider would be prohibitively expensive and would require a complete rebuild of existing business processes/procedures, as well as changes to infrastructure to support the implementation of a new product. Use of a different product other would result in delays of critical auditing activities, as well as introduce security risks that could expose sensitive audit information to unauthorized parties.

Only TeamMate provides for full interoperability with the existing hardware and software infrastructure, and overall it is the only source capable of satisfying the agency’s requirements. An award to a source other than Wolters Kluwer would result in substantial duplication of cost that is not expected to be recovered through competition, unacceptable delays in fulfilling the agency’s requirements, and present unnecessary risks to the security of OIG information. Wolters Kluwer is the software owner and sole provider, there are no authorized resellers.

(6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

There are no known sources that can provide this product based on the market research conducted as described below. IAW FAR 5.2, as prescribed by FAR 13.501, a notice of this action will be posted on the FedBizOpps.gov website.

(7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable

The anticipated costs to the Government are expected to be fair and reasonable based on the fact that the TeamMate software is commercial in nature. Prior to award of the proposed contract, price information shall be obtained in accordance with FAR 13.106-3

(a) (2) and an analysis will be performed and documented to sufficiently determine that the cost to the Government of the proposed acquisition is fair and reasonable.

(8) Description of market research
