Justification and Approval (J&A) for Other Than Full and Open Competition

I. Agency and Contracting Activity.

II. Nature and/or description of the action being approved.
This would be a modification to the current Firm-Fixed Price Indefinite Delivery Indefinite Quantity contract, FA2823-18- D-0001, to increase the contract ceiling by $325,500.00 from $9,625,000.00 to $9,950,500.00. The increased ceiling would be utilized on the current CLIN 4001 and the 6 month extension CLIN 5001 (to be created at extension modification award) in accordance with (IAW) FAR 52.217-8.
The use of the Indefinite Delivery Indefinite Quantity (IDIQ) was significantly underestimated, therefore a contract ceiling increase (to include the 6 month extension) is necessary.
There is a follow-on IDIQ being worked by AFTC/PZZC.
III. Description of supplies/services required to meet agency needs.
Flight Test Support requires the contractor provide aircraft support for wide a variety of electronic system test programs. In addition to just providing aircraft for support, modifications will be required to aircraft for installation of the systems under test. Systems to be installed include radios, GPS systems, sensors, and countermeasures (flares, jammers, etc.) in accordance with the Performance Work Statement (PWS).
The period of performance is 20 September 2018 - 19 September 2023 (19 March 2024 with a 6-month extension IAW FAR 52.217-8).
CLIN 4001: Flight Test Support Services IAW the PWS dated 22 May 2022. This CLIN expires 19 September 2023. Increase of $217,000.00 from $1,750,000.00 to $1,967,000.00
CLIN 5001: Flight Test Support Services IAW the PWS dated 22 May 2022. 20 September 2023 - 19 March 2024. Increase of $108,500.00 from $875K to $983.5K
Funding is provided at the task order level.
IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.
The current IDIQ contractor has the required aircraft in place and the required classified workspace, storage, and hangar space to accommodate the test assets that are not available elsewhere in the local area. SAI being in the local area also saves on TDY costs for multiple testing personnel. It is anticipated that an average per task order would be saved in personnel travel expenses and range fees. Money would be saved by not having a non-local contractor coming to Eglin AFB for testing events, too. In addition, the SAI already has the required clearances/approvals in place to operate in the US Military Test Ranges and US Air Force Installations throughout CONUS, including Hawaii and Alaska where other vendors would need to acquire these authorizations which takes months to complete. The cost for a contractor to get a Top Secret Facility clearance runs anywhere from to , depending on individual factors, and that cost would be passed down the Government.
V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under
FAR 5.202 applies.
Every 5 years this effort is competed as an IDIQ and for the past decade there has only been offeror who provides a proposal.

VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
It is anticipated that prices will be found fair and reasonable by comparing prices from previous purchases.
VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Similar contracts were sought in FPDS-NG ezSearch and none were found. Market research has been conducted and only SAI has met the qualifications needed. The two companies that responded to the 2018 sources sought were contacted to see if they could now meet the hangar space and facility requirements, but have yet to respond. They were both notified of the 2018 Full and Open Competition Request for Proposal and did not respond to the solicitation; they are both in Virginia.
On 27 January 2023 a sources sought (FA248623_SS_FTSS) was posted by AFTC/PZZC who is working the follow-on IDIQ and they received two responses: Grey Wolf Aerospace LLC (Small Business) out of Ohio and CALSPAN Corp (Large Business) out of New York. They are not in the local area and their literature did not speak to being able to meet the facility/hangar space requirements.
In a sole source notice posted for the Digital Flight Termination testing requirement no companies responded objecting to the requirement being sole sourced to Sunshine Aero Industries.

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.
This office will continue to monitor the market for any other vendors that can meet the aircraft type and quantities, that has the capabilities to modify the aircraft, who can meet the hangar and airfield space requirements, and has the necessary facility clearance authorizations while also being within a reasonable location to Eglin AFB, FL.
