JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)
(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.
(2) This justification is for the purchase of one (1) upgrade to an existing Siemens Multitom Rax system under Siemens contract SPE2D1-17-D-0023, which is valid through March 27, 2027. The requirement is for NMC Portsmouth.
(3) The total estimated dollar value for this action is $288,683.40.
(4) The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(B), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
The use of this authority is necessary to support the NMC Portsmouth Radiology Department/Diagnostic Radiology Division ED. The existing Siemens Multitom Rax c-ray system requires an add-on upgrade to increase the system’s capabilities to better diagnose patients. The upgrade includes a software and hardware extension with Real 3D capabilities, advanced security features and installation. Most 3D imaging requires horizontal only positioning while the Real 3D feature allows for 3D x-ray imaging while in lying, weight bearing, and standing positions, in addition to the typical 2D x-ray images. The increased capability allows for better positioning for faster diagnoses for injuries and conditions, particularly for weight bearing positions. The hardware extensions include equipment specific to the Multitom Rax for 3D imaging: transparent grids, a wireless detector and multipurpose stands and supports. The transparent grid (13/92, F115 3D) reduces radiation scatter and provides clearer 3D views for the radiologist. The 14 x 17 MAX WiD wireless detector increases patient position flexibility and is covered under cybersecurity Risk Management Framework (RMF). The 3D multipurpose supports and stands attach and fit uniquely with the existing Siemens Multitom Rax x-ray system and aid in the stabilization of patients while doing 3D imaging. The robotic movement of the tube head requires specifically sized attachable supports and multipurpose stands for operation. Additionally, the add-on upgrade is maintained under Siemens’ current RMF. Siemens Medical Solutions USA, Inc. is the only manufacturer that can provide an add-on proprietary software and hardware upgrade that is compatible with the currently installed Multitom Rax system at NMC Portsmouth.
Only Siemens can perform the upgrade due to the proprietary nature of the equipment and software.
If another vendor were to perform work on the Siemens Equipment, all warranties from Siemens would be voided and not covered by Siemens’ RMF. This includes the stand, grid and detector.
Without RMF being maintained, the unit would not be permitted to operate on the DoD network.
(5) The required items for the Multitom Rax upgrade are available on the Siemens radiology contract SPE2D1-17-D-0023. The contract pricing has previously been determined fair and reasonable via comparison with commercial pricing and other than cost or pricing data for these items. The Contracting Officer has determined that the anticipated cost will be fair and reasonable, and that the subject procurement represents the best value to the Government.
(6) Market research was conducted by technical experts in July 2020. This research consisted of reviews of similar previous procurements and a market survey through search engines of open market contractors and Federal Supply Schedule contractors. Search engines utilized include Google, Bing, GSA Advantage and the ECRI sourcebook catalog. Vendors that can provide an add-on upgrade include GE Healthcare (GE), Siemens Medical Solutions USA, Inc. (Siemens), Philips Healthcare (Philips), Samsung Healthcare (Samsung), AGFA Corporation (AGFA), Fujifilm Medical Systems USA, Inc. (FUJI), and Carestream Health (Carestream). While the
