4. Statutory Authority Permitting Other Than Full and Open Competition

41 U.S.C. 1901 as implemented in FAR Subpart 13.5.

5. Rationale Justifying Use of Cited Statutory Authority

A Defense MicroElectronics Activity (DMEA) contract was awarded to ASTi for the development and integration of the identified components for the in FY15. The identical system was purchased in FY16, (purchase order N00178-18-C-2038) for the exact system. The success of the current training center is resulting in a need to expand these capabilities at different locations. An additional training location is being established at ; therefore, the exact system and software are needed to replicate the existing capabilities. In order to maintain compatibility with the existing system the requested equipment must be compatible in all aspects (form, fit and function) for existing equipment currently installed at other locations. Proprietary rights limit competition. To date, ASTi is the only company to successfully develop and integrate these components in order to satisfy program requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Extensive market research by the engineering team has been conducted to find expert resources to meet the needs of the program. Market research included reviewing online product literature published by manufacturers and consulting with and Subject Matter Experts. As a result of this compatibility and system specifications, it was revealed that these products would be the only solution compatible with the production suite. The proposed contract was synopsized on the SAM.gov website on 09 September 2021 and only ASTi and one other vendor (who is not authorized to resell) expressed interest in this requirement.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than ASTi to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
