I. Agency and Contracting Activity.

II. Nature and/or description of the action being approved.

The subject action will be issued as a modification to an existing order. The existing order basic contract number is FA8771-12-D-1010 and the task order number is FA8232-19-F-0099. The modification will add a FFP CLIN for the Technical Coordination Group (TCG) Database as well as a FFP CLIN for International Digital Technical Order Delivery System (IDTODS).

This J&A is being executed to utilize FAR 52.217-8, Extension of Services due to the fact that the evaluation of the clause was not included in the original contract.

III. Description of supplies/services required to meet agency needs.

The purpose of this service is to support the United States Government (USG) owned, cost-shared European Participating Air Forces (EPAF) and Foreign Military Sales (FMS) Consolidated Technical Coordination Group Web-Enabled Database

. The contractor shall perform engineering and management services required to support, maintain and keep the

TCG Database operational and accessible to all participating FMS partner nations and the USG approved users.

The contractor shall be responsible for all personnel, equipment, supplies, facilities, transportation, tools, materials, and other items necessary to perform the requirements of the contract IAW the Performance Work Statement.

IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.

The current effort was solicited under the NETCENTS contract as a small business set-aside. The government utilized fair opportunity procedures and awarded the resulting task order to SI Systems Technologies. The initial task order was evaluated for a base year and four option years but failed to include the extension of services evaluation. The current contractor, SI Systems Technologies is the only contractor capable of performing on the first day 10 January 2024 that the extension performance will start. SI System Technologies is the only realistic option for continued contractor support for a 6 month extension as they currently have all the required personnel, qualifications and skill-sets on the existing contract to meet the PWS requirements and prevent a lapse in service.

During the development of our acquisition documents, it was brought to the attention of the program management team that IT and Cyber Security requirements had drastically changes over the last 5 years since the current contract was awarded.

There were delays in finding a IT and Cyber Security SME within the SPO to help bring the acquisition within current IT and Cyber Security regulations and requirements.

Due to these delays, if the government does not execute an extension of the current task order, there will be a lapse in services .

While market research has determined multiple vendors are capable of providing this type of support, which was utilized to determine the acquisition strategy of the follow-on effort, an informal review of the existing contract has lead the government to determine that there are no other options to prevent a lapse in services outside of pursuing the up to six month extension with the incumbent contractor. Considering the amount of time before the current contract ends and the status of the follow-on effort, the only realistic option is to execute the up to six month extension and allow the competitive

The extension will enable the government to award and provide the new contractor sufficient time to transition with the incumbent contractor thus minimizing the risk to the USG and FMS countries and posturing all stakeholders for success.

The F-16 TCG program office has determined that award to any other source would result in unacceptable delays in fulfilling the agency's requirements

V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

Due to the time required to competitively award an action, it is not practical to solicit offers from other than SI System Technologies for this up to six month extension. The follow on effort will be competed as a total small business set aside.

The notice of proposed contract action for the sole source contract will be publicized as required by FAR subpart 5.2.

VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer will ensure that the proposal submitted for the extension is consistent with the previously determined fair and reasonable costs under option year 4 of the existing task order and IAW FAR 52.217-8.

VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

A source sought was issued on 16 November 2023 to 1 December 2023. Responses were received from 12 vendors. The vendors are as follows: 22nd Century Tech, A2G, Agile Decisions Sciences, ByteForza, Denamita, DK Shin Laboratories, Echelon Services, Hebco (current subcontractor), Inalab Consulting, Joint Venture, SRR International, and UICGS. The current prime contractor did not respond to the source sought.

The sources sought notice included a list of specific capability requirement questions, one being that the vendor currently have eight static IP addresses available that are approved through the DoDIN network, this is a critical aspect to ensure the least about of downtime and transition time, since the process to obtain one can take up to 6 months.

Of the 12 responses, 7 vendors answered the capability questions and of those 4 have the needed approved IP addresses.

This market research was conducted concurrently for the follow-on effort as well as this up to six month extension.

VIII. Any other facts supporting the use of Other Than Full and Open Competition.

The government failed to add and evaluate FAR 52.217-8 at the time of contract award under contract FA8232-19-F-0099 that was awarded as a one year basic with four option years. If this was captured during contract award it would have negated this J&A effort. This J&A is to allow contracting to add FAR 52.217-8 to the current contract and then another contract modification to fund the contract up to six months.

This was not an easy decision as market research defined up to four potential vendors that might meed the Air Force requirement. Another consideration is this is for FMS countries and if we have a break in service, at what level will this be elevated on the FMS side to come through the USG. There is potential for this to be elevated to the Department of State if not higher, then back down to USAF leadership. By making the decision to award the up to six month extension of services, this eliminates the break in service and leadership elevation and buys enough time to meet all FAR Competition in Contracting Act (CICA) regulations in a small business set aside.

IX. List of any sources that expressed, in writing, an interest in the acquisition.

See VII above.

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.

There are no actions to take to remove barriers to increasing fair opportunity. As outlined above, a competitive acquisition
