SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITION
UNDER THE TEST PROGRAM FOR COMMERCIAL ITEMS (FAR 13.5)
PROJECT NAME:
WebCast Service for the
Federal Energy Regulatory Commission (FERC)
The following Sole Source Justification for Simplified Acquisition Under the Test Program for Commercial Items is prepared in accordance with FAR Subpart 6.302-3 and 13.5, Test Program for Certain Commercial Items.
1. ORGANIZATION:
Federal Energy Regulatory Commission Office of the Executive Director Logistics Management Division 888 1st Street, N E Washington, DC 20426
2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:
The Federal Energy Regulatory Commission (FERCL an independent regulatory agency within the Department of Energy. The Commission promotes dependable, affordable energy through sustained competitive markets. The FERC requires continued support to broadcasts live video and audio webcasts for Commission meetings and special events. Due to the unexpected need to extend the offer evaluation period for Solicitation No. FERC-15-Q-0010, WebCast Service for the FERC an extension of 4 months (4/1/2015- 7 /31/2015) is necessary to avoid an unacceptable break in service. The addition of this extension will be issued by modification to the current contract as a mutual agreement of both parties lAW FAR 52.212-4-(c) Changes. The tasks required during the extension period are identical to those currently being performed.
3. DESCRIPTION OF REQUIREMENT & VALUE:
The requirement includes providing complete remote access to FERC Commission Meetings, technical conferences and other special events for live and/or archived on-demand viewing over the Internet. The contractor provides equipment and services to meet contract requirements. Work includes:
• Audio, Video. Presentation and Video Teleconferencing services originating from the FERC Commission Meeting Room.
• Networks Webcast Streams
• Media Webcast Streams
• Media Webcast Streams dedicated to FERC employees
• Closed Captioned Streams
• Recording Services
• Television Services
It is in the best interest of the Government to have the incumbent vendor, Capitol Connections, continue this support for this extension period. Any other vendor would not have enough ramp-up time to become effective and a break in service is unacceptable to the Government.
ANTICIPATED DOLLAR VALUE: $38,732.00
4. STATUTORY AUTHORITY:
The proposed action may be awarded on a sole source basis under the authority of 41 U.S. Code§ 1901 -Simplified acquisition procedures, and FAR Part 13.5, Test Program for Certain Commercial Items (section 4202 of the Clinger-Cohen Act of 1996).
5. DEMONSTRATE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS:
The incumbent contractor has its equipment currently onsite and is performing the requirement under an existing contract. The incumbent contractor is uniquely qualified because this action will be a continuation of the previous requirement and not the planned upgrade described in FERC-15-Q-0010.
No other vendor can satisfactorily perform the required service and guarantee that there is no break in service.
6. SOURCES SOUGHT EFFORTS:
This requirement is exempt from publicizing in accordance with FAR 5.202(a) (11). Other offers were not solicited for this extension period due to the unexpected requirement for an extension.
Additionally, there would not be enough time for a different contractor to ramp-up without a break in service. However, as stated above the FERC has issued a competitive solicitation to not only meet the existing requirement but provide needed upgrades to keep pace with changing technology.
7. DETERMINATION OF FAIR & REASONABLE PRICING:
The Government intends to issue a modification to the current contract to add a 4 month period of performance and the vendor will be asked to provide a proposal for this new period, which the Contracting Officer's Representative (COR) and Contracting Officer will review. The contractor should utilize the current unit prices on contract, which were previously determined to be fair and reasonable.
8. DESCRIPTION OF MARKET RESEARCH CONDUCTED & RESULTS:
Additional market research was not conducted for this extension period.
9. ANY OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION:
An additional 4 months of support is urgently needed to avoid a break in service. Capitol Connection is the only responsible source capable of providing continued services without significant ramp-up time and a break in service is unacceptable to the Government. Continuous webcast services are required to make FERC open meetings public as directed under 5 U.S. Code § 552b- Open meetings . These meetings are to disclose information contained in or related to examination, operating or condition reports prepared by, on behalf of, or for the use of an agency responsible for the regulations. Open meetings allow majority of the entire membership (Chairman and Commissioners) of the agency to vote on actions. The vote of each agency member participating in such vote shall be recorded and no proxies shall be allowed.
The performance start date is required because these open meetings take place on the third Thursday of every month, except for August. Any change in one of the preceding, and the name and phone number of the official designated by the agency to respond to request for information about the meeting, are required to be submitted for publication in the Federal Register.
10. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION.

11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY
BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SERVICES REQUIRED:
