JUSTIFICATION AND APPROVAL

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION 47QFCA21Q0008

The General Services Administration (GSA) makes this Justification and Approval

(J&A) for Other Than Full and Open Competition orders pursuant to Federal

Acquisition Regulation (FAR) 6.302.

1. Identification of Agency and Contracting Activity:

2. Nature and/or Description of Action Being Approved:

The General Services Administration (GSA) Federal Systems Integration and

Management Center (FEDSIM) intends to award a sole source purchase order for

Symphony software licenses to support solicitation development, proposal submissions, evaluations, contract awards and contract management activities for the ASTRO

Indefinite delivery, indefinite quantity (IDIQ) contract vehicle. The ASTRO contract vehicle shall establish a family of ten separate, individual, Multiple Award (MA), IDIQ contracts that encompass a variety of services related to manned, unmanned, and optionally manned platforms and robotics.

The GSA FEDSIM Contracting Officer has determined a HUBZone sole source to Apex

Logic, Inc. for Symphony software licenses, in accordance with FAR 19.1306, to be the procurement approach that will best satisfy the Agency's requirement.

3. A Description of Supplies/Services Required to Meet Agency’s Need:

The Symphony Procurement Suite (Symphony) is a cloud-based application. Symphony allows for collaborative workflow between GSA and industry partners to create, compete, evaluate and administer multiple award, IDIQ contract requirements.

In Fiscal Year (FY) 2020, GSA FEDSIM selected the Symphony platform to manage the proposal and evaluation process for the ASTRO IDIQ contract vehicle. Specifically, GSA

FEDSIM currently leverages the Symphony software licenses to:

● manage communications with industry,

● manage the ASTRO proposal submission process,

● evaluate ASTRO proposals, and

● perform contract administrative functions.

GSA FEDSIM still requires Symphony software licenses to support ASTRO proposal submissions, conduct evaluations, and perform administrative functions and on-ramping after initial awards. The next six months require development licenses to tailor the software to the ASTRO evaluations and awards. After award is made, standard licenses are required to perform administrative tasks and provide a contract management system.

The Government has included options to upgrade these standard licenses to the development level as needed for further customization and potential tool development.

COST:

The estimated total cost for all mandatory licenses, optional licences, and travel is $2,544,000.

4. An Identification of the Statutory Authority Permitting Other Than Full and Open

Competition:

This Sole Source contract will be awarded pursuant to the authority of 41 United States Code (U.S.C.) 3304 as implemented by FAR 6.302-5(b)(5).

5. A Demonstration that the Proposed Contractor’s Unique Qualifications or the

Nature of the Acquisition Requires Use of the Authority Cited:

The Contracting Officer has determined a HUBZone sole source to Apex Logic, Inc. for Symphony software licenses, in accordance with FAR 19.1306, to be the procurement approach that will best satisfy the Agency's requirement.

6. A Description of Efforts Made to Ensure that Offers are Solicited From as Many

Potential Sources as Practicable:

FAR 19.201 outlines the general policy of the government to provide maximum practicable opportunities to small businesses. Further, FAR 19.1306 instructs the Contracting Officer to consider awarding to a HUBZone small business concern on a sole source basis (up to $4.5 million for non-manufacturing NAICS codes) before considering a small business set-aside.

Through market research, it was determined that Apex Logic Inc. does not have any authorized resellers, nor are the licenses currently available through another HUBZone small business concern. No other efforts were made to solicit other potential sources due to the unique nature of the requirement.

7. A Determination by the Contracting Officer that the Anticipated Cost to the

Government will be Fair and Reasonable:

The Contracting Officer will evaluate Apex Logic’s price quote to ensure that the anticipated cost to the Government will be fair and reasonable.

8. A Description of the Market Research Conducted and the Results or a Statement of the Reason Market Research was not Conducted:

Apex Logic Inc. does not have any authorized resellers, nor are the licenses currently available through another HUBZone small business concern. To validate their findings, in January 2021, GSA FEDSIM searched GSA Advantage and GSA e-Library for Symphony licenses and found no other sources that provide Symphony software licenses.

Market research completed by GSA’s Office of Professional Services and Human Capital (PSHC) Category in 2019 also found the same results. In conclusion, based on market research conducted in accordance with GSAM 510, FAR 8.002, and FAR 10, no Symphony software licenses were found to be available from mandatory or preferred sources of supply.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition:

All other supporting factors have been described above.

10. A Listing of the Sources, if any, That Expressed, In Writing, An Interest in the

Acquisition:

As stated in Section Six of this Justification, no other efforts were made to solicit other potential sources due to the unique nature of the requirement. As a result, no sources expressed interest in this acquisition.

11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome

Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or

Services Required:

The Government is not undertaking any additional actions to remove or overcome barriers to competition at this time. Any subsequent acquisitions for similar requirements will adhere to and comply with all FAR fair opportunity requirements and regulations.
