Statement of Work Computational Fluid Dynamics (CFD) Software

Version Date: 07/22/2016

1. Statement of Need

Within the Office of Generic Drugs OGD, computational fluid dynamics (CFD) modeling is useful for the evaluation of bioequivalence for certain complex drug products, especially oral and nasal inhalation drug products. Bioequivalence recommendations are based on a comparison of the availability of the test product at the site of action with that of the reference product. Since most inhalation drug products act locally in the nasal cavity or in the lungs, traditional pharmacometric analysis does not give an indication of the availability of the drug product at the site of action. Therefore, bioequivalence recommendations for inhalation products should be based on the amount of drug that deposits, dissolves, and absorbs at the local site of actions. In particular, fluid mechanics modeling is useful for understanding how much drug deposits at the site of action, a process which may vary greatly depending on a number of conditions. Fluid mechanics modeling may take many forms, but CFD is particularly well suited to this task because of its ability to handle complex geometries such as lung and nasal airways. Moreover a computational approach to modeling inhalation drug product deposition (as opposed to in vivo or in vitro) allows for combining CFD with physiologically based pharmacokinetic (PBPK) modeling to provide a whole system estimate of both safety and efficacy.

2. Objective

The objective is to procure computational fluid dynamics (CFD) software for modeling aerosolized drug transport in human airway models (nasal and lung).

3. Requirement

Computational fluid dynamics (CFD) Specifications

The Contractor shall provide Computational fluid dynamics (CFD) software for modeling aerosolized drug transport in human airway models (nasal and lung). The software shall have the following salient characteristics:

3.1 Shall possess the ability to handle biological systems and medical devices. These problems typically involve Eulerian modeling of the fluid flow with Lagrangian tracking of discrete particles that are injected into the system.

3.2 Shall possess the capability to model incompressible or compressible flow, heat transfer (convection, conduction, and radiation), multiphase flow, species transport, particle tracking (including turbulent dispersion modeling, droplet breakup/atomization, and discrete element modeling), turbulence (including LES), two-way coupled flow, and transient or steady state conditions.

3.3 Physical models shall be fully customizable with user-defined code using C/C++ or some similar language. Specifically, the code shall be able to correct fluid velocities and turbulence parameters at the boundaries using code that defines the boundary layer with user-defined specifications, to account for any inaccuracies in these locations.

3.4 Possess fluid-structure interface (FSI) modeling and reacting flow capabilities. Parallel processing of fluid flow modeling is required, and the software shall have parallel processing capabilities for particle tracking as well (through POSIX threading or some other means). The package shall allow for processing on eight computing cores.

3.5 Shall be able to run on Red Hat Linux.

3.6 Shall include meshing software that allows for creating unstructured, structured, and hybrid meshes, and where some kind of prism layering should be available for unstructured meshes.

3.7 Shall include some native CAD software that is capable of importing files from professional CAD packages, as well as some type of post-processing/visualization software.

The Contractor shall provide the following maintenance for the Computational fluid dynamics (CFD) software: Customer service that includes phone and email access during normal business hours and a response time of 24 hours or less, full and current software documentation, training materials, and access to the latest software version when it is released.

4. Requirement

Software and licensing key, Software and User Manuals or equal to in a digital copy provided on a CD, DVD or digital download. CD, DVD and hard copies of deliverables shall not be required to be returned to the Contractor. All deliverables are property of the Government.

Schedule: Delivery shall be no later than 30 days after contract award.

5. Inspection and Acceptance

Working media: FDA will load the software and licensing to verify that the media is functioning properly.

The Government shall have 30 working days to inspect and verify that the software is operational, functional and compatible with FDA server and software.

6. Perpetual License

Perpetual License: Term of Use shall not be limited to five (5) years. FDA shall be able to continue the use of the software without purchasing additional support or updates from the contractor. The licenses shall not expire after the initial f i ve (5) years.

7. Period of Performance

The period of performance is one (1) one-year Base period and four (4) one-year Option periods.

8. Options

The Government will be purchasing one Computational fluid dynamics (CFD) software license and one

(1) base year of software license maintenance with four (4) one-year options for software license maintenance.

9. Order Type

The order type is firm-fixed-price.

10. Contracting Officer’s Representative

The COR assigned to this contract is the person at the delivery location who will receive the goods, schedule and ensure proper installation, is responsible for maintaining the contract record, timely receiving of receipts, and for communicating with the Contracting Officer to ensure the vendor is meeting the requirements of the contract. The COR for this contract will be Robin Jeffries.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.217-8: Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor any time prior to contract expiration.

(a) The Government may extend the term of this contract by written notice to the Contractor any time before contract expires; provided that the Government gives the Contractor a preliminary written notice of its intent to extend any time before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

12. Section 508 Standards Requirement

Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d) requires Federal agencies to purchase electronic and information technologies (EIT) that meet specific accessibility standards. This law helps to ensure that federal employees with disabilities have access to, and use of, the information and data they need to do their jobs. Furthermore, this law ensures that members of the public with disabilities have the ability to access government information and services.

There are three regulations addressing the requirements detailed in Section 508. The Section 508 technical and functional standards are codified at 36 CFR Part 1194 and may be accessed through the Access Board’s Web site at http://www.access-board.gov. The second regulation issued to implement Section 508 is the Federal Acquisition Regulation (FAR). FAR Part 39.2 requires that agency acquisitions of Electronic and Information Technology (EIT) comply with the Access Board’s standards. The entire FAR is found at Chapter 1 of the Code of Federal Register (CFR) Title 48, located at http://www.acquisition.gov. The FAR rule implementing Section 508 can be found at http://www.section508.gov. The third applicable regulation is the HHS Acquisition Regulation (HHSAR).

Regardless of format, all Web content or communications materials produced for publication on or delivery via HHS Web sites - including text, audio or video - must conform to applicable Section 508 standards to allow federal employees and members of the public with disabilities to access information that is comparable to information provided to persons without disabilities. All contractors (including subcontractors) or consultants responsible for preparing or posting content intended for use on an HHS-funded or HHS-managed Web site must comply with applicable Section 508 accessibility standards, and where applicable, those set forth in the referenced policy or standards documents below. Remediation of any materials that do not comply with the applicable provisions of 36 CFR Part 1194 as set forth in the SOW, shall be the responsibility of the contractor or consultant retained to produce the Web-suitable content or communications material.

Unless an agency exception to this requirement exists, the Contractor must conform to applicable Section 508 standards and must apply best practices associated with Section 508 compliance during the application design, development, and testing phases. The Contractor shall utilize FDA approved tools to verify the compliance with the Section 508 standards and ensure the delivery of the fully compliant products.

13. FDA Three-Way Invoicing Instructions

The contractor shall submit one (1) original copy of each invoice to the address specified below:

Invoices submitted under this contract must comply with the requirements set forth in FAR clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment By Electronic Funds Transfer – System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:

(i) name and address of the contractor;

(ii) invoice date and invoice number;

(iii) purchase order/award number;

(iv) description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including: (a) period of performance for which costs are claimed; (b) itemized travel costs, including origin and destination; and (c) any other supporting information necessary to clarify questionable expenditures;

(v) shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;

(vi) terms of any discount for prompt payment offered;

(vii) name and address of official to whom payment is to be sent (must be the same as that in the purchase order/award, or in a proper notice of assignment)

(viii) name, title, and phone number of person to notify in event of defective invoice;

(ix) taxpayer identification number (tin);

(x) electronic funds transfer (EFT) banking information, including routing transit number of the financial institution receiving payment;

(xi) name and telephone number of the FDA Contracting Officer’s Representative (COR) or other program center/office point of contact, as referenced on the purchase order;

(xii) any other information or documentation required by the purchase order/award; and

(xiii) Contract Line Item Number (CLIN) that is being invoiced against.

An electronic invoice is acceptable.

14. Order of Precedence

The Contractor shall following the terms and conditions of this order. Should the Contractor include any additional terms and conditions resulting in conflicts between this document and the Contractor’s document, the Order of Precedence shall be as specified in FAR Clause 52.212-4, dated May 2015. Any indemnification and governing law language in the Contractor’s terms and conditions shall be invalid and shall be stricken and removed from the contract. Any additional terms and conditions shall not be prohibited by applicable laws and regulations. Any additional terms and conditions identified with a web link and/or incorporated by reference shall be stricken and removed from this order (not the Schedule).

The Contractor shall provide all terms and conditions with their quotations as attachments, appendixes, etc.

15. Authorized Contractor

The Contractor shall be the software Original Equipment Manufacturer (OEM) or an authorized reseller/servicing agent of the software OEM.

The Quoter shall notify the Contract Specialist / Contracting Officer immediately if this requirement is registered by a reseller with the Original Equipment Manufacturer (OEM).

16. Instructions to Quoters

Quoter shall certify their quotes to be valid for 60 days.

All quotes will be evaluated on a Lowest Priced Technically Acceptable (LPTA) basis. FDA anticipates that this contract will be firm fixed price.

Quoters shall submit one (1) copy of their quotation with pricing information to Steven Chang at tzeleong.chang@fda.hhs.gov by the due date specified in FedBizOpps. Quotations shall meet all the salient characteristics in order to be considered technically acceptable. If the part numbers are different from the vendors’ part numbers, Quoters shall map their part numbers to the vendor’s part numbers.

Technical quotation with detailed point-by-point description of how the product meets all the salient characteristics of this SOW. Technical quotation shall not contain pricing information.

Quoters shall submit all applicable terms and conditions in full text as attachments, appendix, or exhibits.

Quoters shall submit Product Accessibility Templates (PAT) in full text with their quotations.

Quoters providing quotations must clearly state the overall cost to the Government.

Quoters shall submit all assumptions in their quotation.

The Quoter shall notify the Contract Specialist / Contracting Officer immediately if this requirement is registered by a reseller with the Original Equipment Manufacturer (OEM).

Quoters are advised that additional terms and conditions submitted with their quotation that is in conflict of the terms and conditions of this solicitation may be deems as technically unacceptable and may not be considered for award.

17. Award Determination

All quotations will be evaluated on a Lowest Priced Technically Acceptable (LPTA) basis.The award will be made to the lowest price Quoter that demonstrates they can meet all the requirements of this solicitation. Failure to demonstrate meeting any of the requirements will result in a rating of technically unacceptable and will not be considered for award.
